A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING MAJOR USE PERMIT 8~-050
ASSESSOR'S PARCEL NUMBER 323-090-34, 35, 36, 50 AND 51
WHEREAS, Major Use Permit 81-050, submitted by Axtell Development
Corporation, applicant, requests a lot size averaging design for a 19 lot
subdivision (Tentative Tract Map 4278) for the property located Southeast
of the southerly terminus of Gate Drive, in the R-R-5 (Rural Residential),
and A-70-4 (Limited Agricultural) zone; and
WHEREAS, on July 27, 1982, the City Council held a duly advertised
public hearing to solicit comments from the public, both pro and con,
relative to this application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: Findings:
That the location, size, design, and operating characteristics of
the proposed use will be compatible with and will not adversely
affect or be materially detrimental to adjacent uses, residents,
buildings, structures, or natural resources because adjacent uses
are also single family residential with similar characteristics.

That the harmony in scale, bulk, coverage and density is
consistent with adjacent uses because surrounding uses are also
low density single family residential.
3. That there are available public facilities, services and
utilities.
That there will not be a harmful effect upon desirable
neighborhood characteristics because residential development is
consistent with characteristics of surrounding area.

That the generation of traffic will not adversely impact the
surrounding streets and/or the City circulation element because
this impact is mitigated by improvements and payment of
mitigation fees.

That the site is suitable for type and intensity of use or
development which is proposed because adverse geologic and soils
conditions can be mitigated.

That there will not be significant harmful effects upon
environmental quality and natural resources because significant
environmental impacts can be mitigated.

That there are no other relevant negative impacts of the proposed
use that cannot be mitigated.
That the impacts, as described above, and the location of the
proposed use will not adversely affect the City of Poway General
Plan for future as well as present development because the
proposed residential development is consistent with the General
Plan.
Section 2: Environmental Findings.
The City Council finds that this project will not have a significant
adverse impact on the environment and hereby certifies the
Environmental Impact Report complete and in compliance with the
California Environmental Quality Act.
Section 3: City Council Decision.
~ne City Council hereby APPROVES Major Use Permit 81-050 subject to the
following condition:
Ail conditions of approval for Tentative Map 4278 shall be
fulfilled and Major Use Permit 81-050 shall remain valid until
the expiration of Tentative Tract Map 4278 (July 27, 1984), or any
extensions granted for said map. Expiration of the tentative
tract map shall result in expiration of the major use permit.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
California, this 27th day of July, 1982.
