A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING CONDITIONAL USE PERMIT 82-02
ASSESSOR'S PARCEL NUMBER 317-090-39 AND 40
WHEREAS, Conditional Use Permit 82-02, submitted by Sierra Pacific
Corporation, applicant, requests a lot averaging approach for a maximum of 71
dwelling units in two phases (Lot 1, potential 56 units and Lot 2, potential 15
units, Phase I and Phase II respectively) for the property located at the
northeast corner of Poway PDad and Carriage Road, in the R-V-3 and R-V-10,
(Residential Variable) zone; and
WHEREAS, on September 14, 1982, the City Council held a duly advertised
public hearing to solicit comments from the public, both pro and con, relative
to this application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: Findings:
That the location, size, design, and operating characteristics of the
proposed use will be compatible with and will not adversely affect or
be materially detrimental to adjacent uses, residents, buildings,
structures, or natural resources because adjacent uses are mixed
residential land and commercial shopping areas with urban
characteristics.

That the harmony in scale, bulk, coverage and density is consistent
with adjacent uses because the open space area preserves an
existing natural feature and permits development in character with
surrounding land uses.
3. That there are available public facilities, services and utilities.
That there will not be a harmful effect upon desirable neighborhood
characteristics because residential development is consistent with
characteristics of surrounding area.
That the generation of traffic will not adversely impact the
surrounding streets and/or the City's Circulation Element because this
impact is mitigated by improvements and payment of mitigation fees.

That the site is suitable for the type and intensity of use or
development which is proposed because adverse geologic/soils and
drainage conditions can be mitigated.
That there will not be significant harmful effects upon environmental
quality and natural resources due to previous grading and proposed
mitgation measures for aesthetics, noise and light/glare intrusion.

That the impacts, as described above, and the location of the proposed
use will not adversely affect the City of Poway General Plan for future
as well as present development because the proposed residential
development is consistent with the General Plan.
Section 2: Environmental Findings:
The City Council has reviewed the Environmental Impact Report (EAD No. 80-
13-5) for Lot 1, certified January 7, 1981, and the mitigation measures
contained in application TM 4180R and thereby issues a Mitigated Negative
Declaration with mitigation for geology/soil conditions, grading,
drainage/hydrology, traffic/circulation, noise, light/glare, aesthetics,
schools, police protection and sewage.
Section 3: City Council Decision:
The City Council hereby APPBDVES Conditional Use Permit 82-02 subject to
the following conditions:
All conditions of approval for Tentative Map application TM 4180R
shall be fulfilled and Conditional Use Permit shall remain valid until
the expiration of Tentative Tract Map TM 4180R (October, 1982), or any
extensions granted for said map. E~piration of the tentative tract
map shall result in expiration of the conditional use permit.
2. This lot averaging permit shall constitute approval a minimum of 56
and a maximum of 71 attached or detached dwlling units.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
California, this 14th day of September, 1982.
