A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING MAJOR USE PERMIT 72-413 TIME EXTENSION
ASSESSOR'S PARCEL NUMBER 321-190-25 AND 26
WHEREAS, Major Use Permit 72-413 Time Extension, submitted by Poway
Valley Riders Association (PV~A), applicant, requests a time extension for
a private equestrian club and facilities for the property located at 14336
Tierra Bonita Road, in the R-R-l, (Rural Residential) zone; and
WHEREAS, on September 28, 1982, the City Council held a duly advertised
public hearing to solicit comments from the public, both pro and con,
relative to this application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: Findings:
That the location, size, design, and operating characteristics of
the proposed use will be compatible with and will not adversely
affect or be materially detrimental to adjacent uses, residents,
buildings, structures, or natural resources because the
surrounding properties are low density residential and separated
by roadways, topography and B~ttlesnake Creek.

That the harmony in scale, bulk, coverage and density is
consistent with adjacent uses because the existing structures
have iow profiles and adequate spacing as is true of adjacent
uses.
3. That there are available public facilities, services and
utilities.
That there will not be a harmful effect upon desirable
neighborhood characteristics because the use is appropriately
given the present rural residential nature of the area.

That the generation of traffic will not adversely impact the
surrounding streets and/or the City's Circulation Element because
substantial road improvements already exist in the area and
adjacent to the site.

That the site is suitable for the type and intensity of use or
development which is proposed because the use is relatively
unintense as are surrounding uses.

That there will not be significant harmful effects upon
environmental quality and natural resources because no changes to
the site are presently proposed.
8. That there are no other relevant negative impacts of the proposed
use that cannot be mitigated.
That the impacts, as described above, and the location of the
proposed use will not adversely affect the City of Poway General
Plan for future as well as present development because this use
does not preclude a residential development of the property at
some point in the future.
Section 2: Environmental Findings:
The City Council finds that this project will not have a significant
adverse impact on the environment and is categorically exempt from
requirements of the California Environmental Quality Act (Class 1:
Existing Facilities).
Section 3: City Council Decision:
The City Council hereby APPROVES Major Use Permit 72-413 Time
Extension subject to the following conditions:
Continuation of the existing facilities shall be subject to the
following conditions:
An Irrevocable Offer of Dedication shall be made to the
City for a drainage and flowage easement for Rattlesnake
Creek, to a width and alignment as required by the Director of
Public Services, within 90 days of approval of this permit.

The channel for Rattlesnake Creek shall be cleaned and graded
to efficiently drain, and said work shall be accomplished in
a timely manner to the satisfaction of the Director of Public
Services.
An Irrevocable Offer of Dedication shall be made to the City
for an equestrian/pedestrian easement 10 feet in width along
the channel for Rattlesnake Creek and Tierra Bonita Road.
Said trail shall be improved to City standards when the trail
system requires that improved linkage for circuit completion.

Ail landscaped areas shall conform to the originally approved
landscaping plans and shall be maintained in a healthy, living
condition, free from trash and debris. Any plants which have
died shall be replaced within 60 days of the time extension
approval.
Ail special events which are anticipated to attract more than 150
people per day per event shall require Temporary Use Permits.
Completed applications for such permits must be submitted to the
Department of Planning Services at least 60 days prior to the
event.
That portion of the property not grassed or paved shall be
watered or otherwise treated, and at all times maintained as as
to prevent the production of dust.
Ail light fixtures shall be designed and adjusted so as to
reflect light downward, away from any road or street and other
premises.
Ail noise and sound produced on the site shall conform to the
requirements of the City's Noise Ordinance.
Approval of this application shall not waive compliance with
all sections of the Zoning Ordinance or other City Ordinances.
Ail off-site signs for PVRA shall be removed when the City's Kiosk
Program has commenced, but PVRA shall be allowed to participate at
their own expense in the City's Kiosk Program or at their own cost
provide a single community directional sign to be provided by the
Department of Public Services.
The following activities shall be considered as permitted under
this use permit, and similar types of activities of the same
nature and scope shall be subject to the approval of the Director
of Planning Services:
1. Trail Rides;
2. Horse Shows;
3. Polo Activities;
4. Pony Club;
5. Dinners;
6. Meetings;
7. Clinics;
8. Youth Camp;
9. P%5~ Queen Contest; and
10. Auction.

That granting the variance or its modification will not be
incompatible with the Poway City General Plan because the
residential use of the variance requested is consistent with the
General Plan.
Section 2: City Council Decision:
The City Council hereby finds that Variance 82-16 is APPROVED subject
to the following conditions:
This approval shall permit the garage addition on the south
encroachment of 7.5 feet on the south side yard only.

The site shall be developed in accordance with the approved site
plans on file in the Planning Services office and conditions
contained herein.
Approval of this request shall not waive compliance with all
sections of the Zoning Ordinance in effect at the time of
building permit issuance.
4. Minor Development Review shall be accomplished prior to the
issuance of a building permit.
The applicant shall comply with the latest adopted Uniform
Building Code, Uniform Electrical Code, Uniform Fire Code, and
all other applicable codes and ordinances in effect at the time
of approval of this project.
This approval shall become null and void if building permits are
not issued for this project within one year from the date of
project approval.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
California, this 28th day of September, 1982.
