P 82-57 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POW-AY, CALIFORNIA APPROVING MAJOR USE PERMIT MODIFICATION P 79-18(M) ASSESSOR'S PARCEL NUMBER 317-471-13 AND 317-472-13 WHEREAS, Major Use Permit Modification P 79-18(M), submitted by the City of Poway, applicant, requests to modify the approved site plan to include an expansion of the Weingart Center building for the property located at Community Park, in the A-70-4, R-S-7 and R-V-15, (Limited Agriculture, Single Family Residential and Residential Variable) zones; and WHEREAS, on September 28, 1982, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: That the location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources because the characteristics of surrounding use have similar urban qualities. That the harmony in scale, bulk, coverage and density is consistent with adjacent uses because the adjacent residential and commercial uses are separated from the building envelope by passive and active open space and because the adjacent school is complementary with the use of the Community Center complex. Architectural features of the addition are designed to blend with the existing Community Center complex. 3. That there are available public facilities, services and utilities. That there will not be a harmful effect upon desirable neighborhood characteristics because the Community Park and community Center complex is a designated use on the site. That the generation of traffic will not adversely impact the surrounding streets and/or the City's Circulation Element because adequate on-site parking is proposed and because this impact is mitigated by existing road improvements. Resolution No. P 82-57 Use Permit Modification P 79-18(M) Page 2 That the site is suitable for the type and intensity of use or development which is proposed because the property has undergone previous development and because only minor grading is required. That there will not be significant harmful effects upon environmental quality and natural resources because the building envelop is located outside of the limits of the floodway and due to previous development on the property. 8. That there are no other relevant negative impacts of the proposed use that cannot be mitigated. 9e That the impacts, as described above, and the location of the proposed use will not adversely affect the City of Poway General Plan for future as well as present development because the use is consistent with the designation, goals, objectives and policies of the General Plan. Section 2: Environmental Findings: The City Council finds that this project is categorically exempt from environmental review under the provisions of the California Environmental Quality Act. Section 3: City Council Decision: The City Council hereby APPROVES Major Use Permit Modification P 79- 18(M) subject to the following conditions: The site shall be developed in accordance with the approved site plans on files in the Planning Services Department and the conditions contained herein. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit issuance. The facade shall be architecturally compatible with the existing building to the satisfaction of the Director of Planning Services. Resolution No. P 82-57 Use Permit Modification P 79-18(M) Page 3 The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of approval of this project. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. Ail necessary fire protection devices shall be installed prior to the finalization of building permits. All conditions of the original approval (P 79-18) shall remain in effect.
