Res P-82-63RESOLUTION NO. P 82-63 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW APPROVAL 82-04 ASSESSOR'S PARCEL NUMBER 321-190-17 WHEREAS, Development Review Approval 82-04, submitted by, Twin Peaks Assembly of God, applicant, requests to construct a 5860 square foot sanctuary for the property located at 14047 Twin Peaks Road, in the R-S-4 (Single Family Residential) zone; and WHEREAS, on October 26, 1982, the City Council held a hearing on the above referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: That the proposed development is in conformance with the Poway General Plan because it is an expansion of an existing religious facility. That the proposed development will not have an adverse aesthetic, health, safety or architecturally related impact upon adjoining properties because of design compatibility and appropriate conditions of approval. 3. That the proposed development is in compliance with the Zoning Ordinance. 4e That the proposed development encourages the orderly and harmonious appearance of structures and property within the City because it is similar in appearance to existing structures and it resolves potentially hazardous access concerns. Section 2: Environmental Findings: The City Council finds that this project will not have significant adverse impact on the environment and hereby issues a Mitigated Negative Declaration for traffic/circulation, drainage/hydrology, light/glare, noise, aesthetics and vegetation removal is issued per Condition 19 and Standard Conditions K-6, L-6, B-2, C-3 and C-1, 2, 4 and 5 for drainage, circulation, lighting, vegetation removal, and aesthetics respectively. Section 3: City Council Decision: Resolution No. P 82-63 DRA 82-04 Page 2 The City Council hereby approves Development Review Approval 82-04 subject to the following conditions: me 3e 4e Se The cross located on the north face of the architectural tower shall be relocated so as not to exceed 35 feet in height, measured from finished grade. The cross on the existing structure shall be removed prior to the installation of the new CROSS, 7e Exterior finishes of the existing structure shall be coordinated with the finishes proposed for the new sanctuary within one year of the finalization of the building permits. The walls and trim of the existing building shall be painted to match the facades of the finished sanctuary. Ail roof appurtenances on the existing structure shall be screened to the satisfaction of the Director of Planning Services prior to building permit finalization. The existing structure when reroofed shall be reroofed with the materials selected for the new sanctuary or the new sanctuary shall be roofed to match the existing structure to the satisfaction of the Director of Planning Services. The Director of Planning Services shall approve the distribution of automobile parking spaces per Section 6752 of the Zoning Ordinance or any amendments thereto prior to approval of interior improvements for classroom activities in the existing structure by the Fire Marshall or building permit issuance. The applicant shall remove the existing driveway onto Twin Peaks Road and reconstruct said driveway with an alley curb return at the location depicted in staff's proposal, along the easterly property line. The easterly driveway shall be improved to a width of 25 feet measured from the property line for a minimum distance of 124 feet from the face of curb on the south side of Twin Peaks Road to the satisfaction of the Director of Public Services prior to the building permit finalization. A minimum five-foot wide landscape island shall be installed at a distance measured 25 feet west of the easterly property line, as depicted in staff's proposal, to the satisfaction of the Director of Planning Services, prior to building permit finalization. 15. The applicant shall make an Irrevocable Offer of Dedication for the 25-foot driveway along the easterly property line for a distance 124 feet south of the ultimate right-of-way of Twin Peaks BDad and shall also offer a minimum of 20 feet along the easterly property line after an acceptable distance of transition from the end of the 25-foot wide driveway to the southerly property line, to the satisfaction of the City Engineer and the Director of Public Services, prior to building permit issuance. The south side of Twin Peaks Road shall be improved and widened by the construction of a full section of street pavement and concrete curb, gutter, with curb line located 41 feet south of the street centerline. A paved taper lane shall be constructed at both ends of the widened section to allow transition to the existing pavement section, as required by the City Engineer. All road improvements shall be installed prior to building permit finalization. Sidewalk improvements may be deferred until the next phase of development, to the satisfaction of the Director of Public Services. The existing culvert at the east end of the street widening shall be extended northerly to the south street right-of-way line and an outlet shall be constructed as required by the City Engineer prior to building permit finalization. The existing earthen drainage swale along the east side of the property shall be cleaned and graded to drain efficiently to the satisfaction of the Director of Public Services prior to building permit finalization. A drainage easement, seven and onehalf feet wide, shall be offered for dedication to the City of Poway along the east side of the property prior to building permit issuance. Prior to grading or building permit issuance, a grading and drainage plan shall be prepared and submitted by the applicant, showing the method of disposal of sheet runoff and concentrated flows likely to come from this site upon its development, to the satisfaction of the City Engineer and the Director of Public Services. No parking shall be permitted on Twin Peaks Road and signs shall be installed as required, to facilitate the installation of a bicycle lane to the satisfaction of the Director of Public Services, prior to building permit finalization. The location of the westerly driveway shall be relocated approximately 10 feet to the east and shall be improved with a minimum 24-foot wide curb cut to the satisfaction of the Director of Planning Services prior to building permit finalization. The landscape strip along the westerly property line shall be improved to a minimum width of 17 feet as shown in staff's proposal. A 10-foot and 5-foot wide equestrian/pedestrian trails easement shall be dedicated along the entire length of the westerly property line and along Twin Peaks Road respectfully, prior to building permit issuance, as shown in staff's proposal, to the satisfaction of the Directors of Planning and Public Services. Automobile parking spaces may be reduced to a minimum length of 17.5 feet with 2.5-foot overhangs atop low ground cover, as shown in staff's proposal, to the satisfaction of the Director of Planning Services. A six-foot high solid fence shall be installed on the southerly and westerly property lines to the satisfaction of the Director of Planning Services prior to building permit finalization, as a mitigation for potentially significant noise impacts upon surrounding residential properties. The westerly fence shall be located 10 feet from the westerly property line. The most easterly freestanding sign shall be removed unless a valid sign permit can be provided by the applicant. Prior to the issuance of building permits, the required improvements shall be guaranteed to be installed by the developer by the execution of a performance agreement, secured with sufficient improvement securities in a form approved by the City Attorney. All required dedications or offers of dedication shall be made and all required fees, deposits and charges shall be paid prior to building permit issuance. The applicant shall meet all requirements set forth in previous approvals, except where modified herein, including but not limited to the use of loudspeakers or sound amplification systems. Development Review for Phase III Development shall occur prior to building permit issuance. The location of the approved footprint may be adjusted due to the improvements required above. Resolution No. P 82-63 DRA 82-04 Page 5 Section 4: The City Council hereby approves Development Review Approval 82-04 subject to the following standard conditions: I. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: A. SITE DEVELOPMENT Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Planning Services Department prior to issuance of building permits. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at time of Building Permit issuance. 3e Trash receptacle areas shall be enclosed by a 6 foot high masonry wall with view obstructing gates pursuant to City standards. Location shall be subject to approval by the Planning Services Department. Ail roof appurtenances, including air conditioners, shall be architecturally integrated, shielded from view and sound buffered from adjacent properties and streets as required by the Planning Services Department. So Prior to any use of the project site or business activity being commenced thereon, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning Services. B. PARKING AND VEHICULAR ACCESS Ail parking lot landscaped islands shall have a minimum inside dimension of 4 feet and shall contain a 12 inch wide walk adjacent to parking stall and be separated from vehicular areas by a 6 inch high, 6 inch wide portland concrete cement curbing. Parking lot lights shall be a maximum height of 18 (eighteen) feet from the finished grade of the parking surface and directed away from all property lines, adjacent streets and residences. 3. Parking lot trees shall be a minimum 15 gallon size. Emergency access shall be provided, maintained free and clear, a minimum of 24 feet wide at all times during construction in accordance with Safety Services Department requirements. Resolution No. DRA 82-04 Page 6 82-63 LANDSCAPING 1. A detailed landscape and irrigation plan shall be submitted to and approved by the Planning Services Department prior to the issuance of building permits. 2. A Master Plan of the existing on-site trees shall be provided to the Planning Services Department prior to the issuance of building permits and prior to grading, to determine whichh trees shall be retained. 3. Existing on-site trees shall be retained wherever possible and shall be trin~ed and/or topped. Dead, decaying or potentially dangerous trees shall be approved for removal at the discretion of the Planning Services Department during the review of the Master Plan of Existing On-Site Trees. Those trees which are approved for removal shall be replaced on a tree-for-tree basis as required by the Planning Services Department. 4. Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the Master Plan of street trees for the City of Poway and shall be planted at an average of every 30 feet on interior streets and 20 feet on exterior streets. 5. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. D. SIGNS 1. Any signs proposed for this development shall be designed in conformance with the Sign Ordinance and shall require review and approval by the City Council. E. RECREATION 1. The developer shall improve and maintain, or cause to be maintained, the Equestrian/Pedestrian/Bicycling Trail system in accordance with the adopted design standards and to the satisfaction of the Directors of Public and Planning Services. F. ADDITIONAL APPROVALS REQUIRED (No Standard Conditions) Resolution No. DRA 82-04 Page 7 82-63 II APPLICANT SHALL CONTACT THE BUILDING DIVISION REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: G. SITE DEVELOPMENT The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of approval of this project. Prior to issuance of building permits for combustible construction, evidence shall be submitted to the Director of Safety Services that water supply for fire protection is available. Where additional fire protection is required by the Director of Safety Services, it shall be serviceable prior to the time of construction. Prior to the issuance of a building permit for a new commercial or industrial development, or addition to an existing development, the applicant shall pay development fees at the established rate. Such fees may include, but not be limited to: Drainage Fee, Permit, Plan Checking Fees, Water and Sewer Service Fees. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. EXISTING STRUCTURES (No Conditions) GRADING Grading of the subject property shall be in accordance with the City Grading Code and accepted grading practices. A soils report shall be prepared by a qualified engineer licensed by the State of California to perform such work. Resolution No. DRA 82-04 Page 8 82-63 III APPLICANT SHALL CONTACT THE PUBLIC SERVICES DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: J. STREETS AND SIDEWALKS Ail Circulation Element roads shall be dedicated and improved to Circulation Element road standards and to the specifications of the Director of Public Services. Developer shall pay a pro-rata share for the installation or modification of the traffic signals at Twin Peaks and Espola Roads and at Twin Peaks and Tierra Bonita Roads. Sidewalks shall be required on the south side of Twin Peaks Road. Street striping and signing shall be installed to the satisfaction of the Director of Public Services. 5. Ail street structural sections shall be submitted to, and approved by the Director of Public Services. Street improvement plans prepared on standard size sheets by a Registered Civil Engineer shall be submitted for approval by the Director of Public Services. Standard plan check and inspection fees shall be paid by the developer. 7. Street improvements that include, but are not limited to: X a. Sidewalks e. Cross gutter X b. Driveways f. Alley gutter c. Wheel chair ramps X g. Street paving X d. Curb and gutter h. Alley paving shall be constructed prior to the to occupancy of the units and the satisfaction of the Director of Public Services. 8e Prior to any work being performed in the public right-of-way, an encroachment permit shall be obtained from the Public Services Office and appropriate fees paid, in addition to any other permits required. 2e 3e Lo 2o 3e Se Resolution No. 82-63 DRA 82-04 Page 9 DRAINAGE AND FLOOD CONTROL The applicant will be responsible for construction of all onsite drainage facilities required by the Director of Public Services. A drainage system capable of handling and disposing of all surface waters originating within the subdivision, and all surface waters that may flow onto the subdivision from adjacent lands, shall be required. Said drainage system shall include any easements and structures as required by the Director of Public Services to properly handle the drainage. The Master Plan of Drainage Fee shall be paid at the established rate in accordance with the Drainage Ordinance, prior to building permit issuance UTILITIES Ail proposed utilities within the project shall be installed underground including utilities along Circulation Element roads and/or highways less than 34.5 KV. Developer shall be responsiblle for the relocation and undergrounding of existing public utilities, as required. Water, sewer and fire protection systems shall be designed and constructed to meet requirements of the City of Poway. Prior to the issuance of building permit the developer shall pay the Bridge and Major Thoroughfare Traffic Mitigation Fee at the established rate. Developer shall construct a light system conforming to City of Poway Standards at no cost to the public, subject to the following: ae be ce Cut-off luminaries shall be installed which will prove true 90 degree cutoff and prevent projection of light above the horizontal from the lowest point of the lamp or light emitting refractor or device. Ail fixtures shall use a clear, high pressure sodium vapor light source. Advance energy charge shall be paid by the developer. No mercury vapor, quartz, metal halide or diffuse coated high pressure sodium lamps shall be installed. Annexation to the Lighting and Maintenance District shall occur prior to building permit issuance. Resolution No. 82-63 D~A 82-04 Page 10 GENERAL REQUIREMENTS AND APPROVALS An open space easement be granted to the City over, upon, across and under the area defined on the final maps as an equestrian trail and no building, structures or other things shall be constructed, erected, placed or maintained on subject easements except for the construction and maintenance of said trail and structures appurtenant to the trail. Dedicate the Master Planned Equestrian/Pedestrian trails to the satisfaction of the Directors of the Departments of Public and Community Services in accordance with the Master Plan of Trails Element.
