P 82-65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING MAJOR USE PERMIT P 77-71 TE ASSESSOR'S PARCEL NUMBER 275-010-42 W~EREAS, Major Use Permit P 77-71TE, submitted by St. John of Damacus Orthodox Church, applicant, requests to extend the expiration date pursuant with Development Review application DR 81-02TE for the property located on the north side of Espola Road east of Summerfield Lane, in the R-R-1 (Rural Residential) zone; and, W}{EREAS, on November 9, 1982, the City Council held a duly advertised public hearing to solicit co~m~ents from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: 4e That the location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources because the characteristics of surrounding use have similar urban qualities. That the harmony in scale, bulk, coverage and density is consistent with adjacent uses because the adjacent residential and commercial uses are separated from the building envelope by passive and active open space and because the adjacent properties are to be screened by appropriate fencing and landscaping. That there are available public facilities, services and utilities. That there will not be a harmful effect upon desirable neighborhood characteristics because the religious complex is compatible with surrounding residential development. That the generation of traffic will not adversely impact the surrounding streets or the City's Circulation Element because adequate on-site parking is proposed and because this impact is mitigated by conditions of approval requiring road improvements. That the site is suitable for the type and intensity of use or development which is proposed because the property is located in a semi-urban setting and because only minor grading is required. That there will not be significant harmful effects upon environmental quality and natural resources because the proposed development will not endanger known rare biological resources and because of appropriate conditions of approval regulating project design. Resolution P 82-65 P 77-71 Page 2 9e That the impacts, as described above, and the location of the proposed use will not adversely affect the City of Poway General Plan for future as well as present development because the use is consistent with the designation, goals, objectives and policies of the General Plan. That there are no other relevant negative impacts of the proposed use that cannot be mitigated. Section 2: Environmental Findings: The City Council finds that the Negative Declaration issued for the Major Use Permit 77-71 covers the issues environmentally for this application. Section 3: City Council Decision: The City Council hereby approves Major Use Permit 77-71 Time Extension, subject to the following conditions: 2e The date of expiration shall run concurrently with application DPA 81-02TE, or any extensions granted thereto, not to exceed one year (until October 27, 1983). Conditions A-1 and A-3 of the County of San Diego Resolution approving application P 77-71 relative to the improvement of Espola Road, shall be amended to read as follows: "St. John of Damacus Orthodox Church shall work with the City of Poway relative to the vacation of Old Espola Road. Any such vacation shall be contingent upon the dedication and improvement of an alternate roadway access to the properties now using Old Espola Road, in an alignment and location as approved by the Director of Public Services, and further, that any such improvement shall be made at no cost to the City. An agreement to this effect shall be executed between the applicant and the City, to be in a form approved by the City Attorney, and executed prior to issuance of any building permits on the property. Resolution P 82-65 P 77-71 Page 3 Ail conditions of approval of City of Poway Resolution No P 81-17 shall be fulfilled as required, except as modified herein. All other conditions of the original approval of application P 77-71 shall be fulfilled to the satisfaction of the Directors of Planning and Public Services.
