Res P-83-06RESOLUTION NO. P-83-06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW 82-03 ASSESSOR'S PARCEL NUMBER 323-190-75 WHEREAS, Development Review 82-03, submitted by, Honda (motorcycles) of Poway, applicant, requests to expand the structure on the property located at 14010 Poway Road, in the C-36 (General Com~ercial) zone; and, WHEREAS, on February 15, 1983, the City Council held a hearing on the above referenced item; NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: That the proposed development is in conformance with the Poway General Plan because the proposed use is consistent with the current land use designation. 2e That the proposed development will not have an adverse aesthetic, health, safety or architecturally related impact upon adjoining properties because it is designed to blend with the characteristics of the surrounding business area setting. 3. That the proposed development is in compliance with the Zoning Ordinance because of conditions contained in Section 3 below. That the proposed development encourages the orderly and harmonious appearance of structures and property within the City. Section 2: Environmental Findings: The City Council finds that this project is categorically exempt under the provisions of the California Environmental Quality Act. Section 3: City Council Decision: The City Council hereby approves Development Review 82-03 subject to the following conditions: 1. Ail conditions of application VAR 82-09 shall be met. Ail materials and/or finishes shall be matched with the existing structure prior to building permit issuance to the satisfaction of the Director of Planning Services. The resawn cedar facade on the existing structure shall be extended in the area of the proposed addition. Resolution No. P-83-06 DR 82-03 Page 2 9e 10. 11. The maximum area of expansion shall not exceed 2140 square feet of gross floor area, based upon the approval of application VAR 82-09. Prior to building permit issuance, the applicant shall submit a revised site plan, including park space and aisle details, in accordance with the exhibit prepared by staff, to the satisfaction of the Director of Planning Services. The applicant shall redirect on-site circulation in accordance with staff's proposal. Signs for exiting and right turn only shall be installed prior to building permit finalization, to the satisfaction of the Director of Planning Services. The applicant shall eliminate the westerly curb cut and reconstruct a concrete curb and gutter in that location, with a 5-foot wide concrete sidewalk and other work as required by the Director of Public Services, prior to building permit finalization. The applicant shall improve his portion of the raised median on Poway Road prior to building permit finalization or provide a cash deposit in lieu of installation, to the satisfaction of the Director of Public Services. The applicant shall install an eight foot high noise attenuating wall along the entire length of the westerly property line beginning at the front of the existing building prior to building permit finalization, to the satisfaction of the Director of Planning Services. One row of display vehicles may be placed against the southerly face of the structure. The westerly driveway shall be modified for additional display areas as depicted in staff's proposal, to the satisfaction of the Director of Planning Services. No motorcycles or similar vehicles shall be displayed, parked or otherwise located so as to block or impede pedestrian walks. The applicant shall pay the traffic mitigation fees in accordance with Resolution No. 309, at the rate in effect at the time of permit approval, prior to the issuance of a building permit. Prior to the issuance of a building permit, all of the above improvements shall be guaranteed to be installed by the execution of a covenant or agreement, in a form approved by the City Attorney. Improvement securities for performance, labor and materials, and warranty shall also be posted. Section 4: City Council Decision: The City Council hereby approves Development Review 82-03 subject to the following standard conditions: I. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: A. SITE DEVELOPMENT Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Planning Services Department prior to issuance of building permits. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at time of Building Permit issuance. Trash receptacle areas shall be enclosed by a 6 foot high masonry wall with view obstructing gates pursuant to City standards. Location shall be subject to approval by the Planning Services Department. 40 Ail roof appurtenances, including air conditioners, shall be architecturally integrated, shielded from view and sound buffered from adjacent properties and streets as required by the Planning Services Department. B. PARKING AND VEHICULAR ACCESS Ail parking lot landscaped islands shall have a minimum inside dimension of 4 feet and shall contain a 12 inch wide walk adjacent to parking stall and be separated from vehicular areas by a 6 inch high, 6 inch wide portland concrete cement curbing. II. Resolution No. P-83-06 DR 82-03 Page 4 Parking lot lights shall be a maximum height of 18 (eighteen) feet from the finished grade of the parking surface and directed away from all property lines, adjacent streets and residences. 3. Parking lot trees shall be a minimum 15 gallon size. Emergency access shall be provided, maintained free and clear, a minimum of 24 feet wide at all times during construction in accordance with Safety Services Department requirements. 5. Ail parking spaces shall be double striped. C. LANDSCAPING A detailed landscape and irrigation plan shall be submitted to and approved by the Planning Services Department prior to the issuance of building permits. Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the Master Plan of street trees for the City of Poway and shall be planted at an average of every 30 feet on interior streets and 20 feet on exterior streets. 3. Ail landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. D. SIGNS (No Conditions) E. RECREATION (No Conditions) F. ADDITIONAL APPROVALS REQUIRED (No Conditions) APPLICANT SHALL CONTACT THE BUILDING DIVISION REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: G. SITE DEVELOPMENT The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of approval of this project. 2e 3e III, 4e Se Resolution No. P-83-06 DR 82-03 Page 5 Prior to issuance of building permits for combustible construction, evidence shall be submitted to the Director of Safety Services that water supply for fire protection is available. Where additional fire protection is required by the Director of Safety Services, it shall be serviceable prior to the time of construction. Prior to the issuance of a building permit for a new commercial or industrial development, or addition to an existing development, the applicant shall pay development fees at the established rate. Such fees may include, but not be limited to: Drainage Fee, Permit, Plan Checking Fees, Water and Sewer Service Fees. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. B. EXISTING STRUCTURES (No Conditions) I. GRADING (No Conditions) 2e APPLICANT SHALL CONTACT THE PUBLIC SERVICES DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: STREETS AND SIDEWALKS Reciprocal easements shall be provided insuring access to all parcels over private roads, drives or parking areas to the satisfaction of the Director of Public Services prior to the issuance of building permits. Street improvement plans prepared on standard size sheets by a Registered Civil Engineer shall be submitted for approval by the Director of Public Services. Standard plan check and inspection fees shall be paid by the developer. Ail damaged off-site public works facilities, including parkway trees, shall be repaired or replaced prior to exoneration of bonds and improvements, to the satisfaction of the Department of Public Services. Resolution No. P-83-06 DR 82-03 Page 6 Prior to any work being performed in the public right-of-way, an encroachment permit shall be obtained from the Public Services Office and appropriate fees paid, in addition to any other permits required. DRAINAGE AND FLOOD CONTROL The Master Plan of Drainage Fee shall be paid at the established rate in accordance with the Drainage Ordinance. UTILITIES Ail proposed utilities within the project shall be installed underground including utilities along Circulation Element roads and/or highways less than 34.5 KV. utility easements shall be provided to the specification of the serving utility companies and the Director of Public Services. Developer shall be responsiblle for the relocation and undergrounding of existing public utilities, as required. M.
