Res P-83-15RESOLUTION NO. P 83-15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW DR 82-08 AND TEMPORARY USE PERMIT TUP 83-02 ASSESSOR'S PARCEL NUMBER 314-032-02, 314-050-12 WHEREAS, Development Review 82-08, submitted by, Standard Pacific of San Diego, applicant, requests development review of a 5 unit model home complex and 50 production homes, known as Woodside and a temporary use permit for a mobile sales office for the property located on the north and south side of Camino Del Norte approximately one mile east of its intersection with Pomerado Road in the R-S-4 (Residential Single Family) zone; and WHEREAS, on March 8, 1983, the City Council held a hearing on the above referenced item; NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: 1. That the proposed development is in conformance with the Poway General Plan for residential use, density and improvements. 2e That the proposed development will not have an adverse aesthetic, health, safety or architecturally related impact upon adjoining properties because rooflines and building materials are compatible with adjacent development. 3. That the proposed development is in compliance with the Zoning Ordinance. That the proposed development encourages the orderly and harmonious appearance of structures and property within the City because it's similar to and compliments adjacent development. Section 2: Environmental Findings: The City Council finds that the Environmental Impact Report certified on July 15, 1976 and recertified on May 17, 1979, cover environmental impacts associated with the projects. Resolution No. P 83-15 Page 2 Section 3: City Council Decision: The City Council hereby approves Development Review 82-08 and Temporary Use Permit 83-02 subject to the following conditions: Development Review The developer shall include within the CC&R's a condition requiring the installation of landscaping by each property owner within ninety (90) days of the close of escrow, with that condition to be enforced by the developer. 20 The developer shall install a six foot high fence with a three foot wide gate between each unit and a six foot high fence located outside of and parallel to the ultimate public right-of- way on properties with exterior side yards prior to occupancy. The developer shall utilize varied roofing tile shapes and colors to the satisfaction of the Director of Planning Services, to be determined prior to the issuance of building permits for any units other than the models. 4e Sidewalk mailboxes that conform to the United States Postal Service requirements shall be installed two to a post located between properties prior to occupancy. 5e The developer shall preplumb each house for a solar hot water heating system. Building plans shall be modified to provide the plumbing prior to the issuance of building permits for units other than the models. 6e Proposed accent colors from each color sample board will be enriched and or modified to the satisfaction of the Director of Planning Services prior to the issuance of building permits for units other than the models. 7e Distribution and color schemes of the proposed Spanish elevations will be subject to the satisfaction of the Director of Planning Services and shall be determined prior to the issuance of building permits on units other than the models. The developer shall include within the CC&R's a condition requiring property owners to participate in a landscaping maintenance district. Said district shall include all Camino Del Norte landscaping and the noise attenuating fences, and the engineering costs involved in district formation shall be borne by the developer. Resolution No. P 83-15 Page 3 Ail signs proposed for this development shall be designed in conformance with the City's Sign Ordinance for on- and off-site subdivision signs. 10. The construction of the noise attenuation fence shall include capping to the satisfaction of the Director of Planning Services. 11. Road improvements including paving, curbs and gutters, sidewalks, and bicycle lanes shall be installed along Camino Del Notre from Pomerado Road to the eastern boundary of the Standard Pacific property prior to the opening of any models. Aubrey, south of Camino Del Norte, shall remain unimproved until Camino Del Norte is improved to connect with Community Road and shall be barricaded to the satisfaction of the Director of Public Services. 12. The temporary connection of Treecrest Street to Camino Del Norte shall conform to improvement plans for the tract map and shall be to the satisfaction of the Director of Public Services. 13. The buyers of lots which have frontage along Camino Del Notre shall be provided with a cross section of and related text describing the noise attenuating fence and shall sign a statement indicating knowledge of the noise study conducted for the project and the purpose of the wall for noise attenuation. (This condition will replace Standard Conditions F-7, 8, 9, and 10). 14. Upon the sale of the last model the temporary extension of Treecrest to Camino Del Norte will be removed and returned to a buildable lot condition.. 15. Ail other conditions of TM 3495R, TM 4113 and VAR 81-39R shall be completed prior to occupancy of any units other than the models. Temporary Use Permit 16. A bond, letter of credit or cash deposit for $1000 shall be required to insure the timely removal of the temporary use. 17. Necessary sanitary facilities for the sales office must be provided as required by the Director of Public Services. 18. An agreement shall be executed to the satisfaction of the City Attorney that if all uses and related improvements are not removed as herein required, they maybe removed or demolished and the site restored by the City without further notice. 19. The temporary use permit for the mobile sales office shall expire on March 8, 1984. Resolution No. P 83-15 Page 4 Section 4: City Council Decision: The City Council hereby approves Development Review 82-08 and Temporary Use Permit 83-02 subject to the attached Standard Conditions. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: A. SITE DEVELOPMENT 1. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. 2. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at time of Building Permit issuance. 3. Mail boxes, in areas where sidewalks are required, shall be installed and located by the developer subject to approval by the Planning Services Department. 4. The developer shall integrate a variety of approved roof materials and colors into the design of the residential development in a manner which is both compatible and complementary among each of the residential units. 5. All roof appurtenances, including air conditioners, shall be architecturally integrated, shielded from view and sound buffered from adjacent properties and streets as required by the Planning Services Department. B. PARKING AND VEHICULAR ACCESS Ail parking lot landscaped islands shall have a minimum inside dimension of 4 feet and shall contain a 12 inch wide walk adjacent to parking stall and be separated from vehicular areas by a 6 inch high, 6 inch wide portland concrete cement curbing. C. LANDSCAPING 1. A detailed landscape and irrigation plan shall be submitted to and approved by the Planning Services Department prior to the issuance of building permits. 2. Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the Master Plan of street trees for the City of Poway and shall be planted at an average of every 30 feet on interior streets and 20 feet on exterior streets. 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. Resolution No. P 83-15 Page 5 II F. ADDITIONAL APPROVALS REQUIRED 1. The developer shall display a current Zoning and Land Use Map in the sales office at all times, and/or suitable alternative to the satisfaction of the Director of Planning Services. 2. When public or private equestrian/pedestrian/bicycling trails are required as a part of the subdivision, the developer shall display a map in the sales office, of said subdivision, indicating the trails. 3. All sales maps that are distributed or made available to the public shall include but not be limited to trails, future and existing schools, parks, and streets. APPLICANT SHALL CONTACT THE BUILDING DIVISION REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: G. SITE DEVELOPMENT 1. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of approval of this project. 2. Prior to issuance of building permits for combustible construction, evidence shall be submitted to the Director of Safety Services that water supply for fire protection is available. Where additional fire protection is required by the Director of Safety Services, it shall be serviceable prior to the time of construction. 3. Prior to the issuance of a building permit for a new residential dwelling unit(s), the applicant shall pay development fees at the established rate. Such fees may include, but not be limited to: Park Fee, Drainage Fee, Permit and Plan Checking Fees, School Fees (in accordance with city-adopted policy and/or ordinance), Water and Sewer Service Fees. 4. This approval shallbecome null and void if building permits are not issued for this project within one year from the date of project approval. 5. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color.
