Res P-83-16RESOLUTION NO. P-83-16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW 83-02 ASSESSOR'S PARCEL NUMBER 273-100-24 WHEREAS, Development Review Approval 83-02, submitted by Ross Rizzo, Bernardo Winery Village, applicant, requests Development Review for Phase II of the Winery complex including an historical museum, craft shop, two workshops, and a gazebo for the property located at 13330 Paseo Del Verano Norte, in the R-RO (Residential Recreation Oriented); and WHEREAS, on March 22, 1983, 1982, the City Council held a hearing on the above referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: That the proposed development is in conformance with the Poway General Plan, because it is consistent with requirements for recreation oriented uses within residential areas. 2e That the proposed development will not have an adverse aesthetic, health, safety, or architecturally related impact upon adjoining properties, because proposed buildings have low profiles and the colors, styles, and building materials are similar to adjacent residential uses. That the proposed development is in compliance with the Zoning Ordinance, because it meets standards for this type of development. 4e That the proposed development encourages the orderly and harmonious appearance of structures and property within the City for the reasons stated above. Section 2: Environmental Findings: The City Council finds that this project will not have significant adverse impact on the environment and hereby issues a Mitigated Negative Declaration with mitigation for erosion (Standard Condition C-1). Resolution P-83-16 DR 83-02 Page 2 Section 3: City Council Decision: The City Council hereby approves Development Review Approval 83-02 subject to the following conditions: The new drives and parking areas shall be paved in accordance with the standards of City Ordinance 74 (3 inch/6 inch AB - parking; 3 inch AC/8 inch AB drives). Existing drives and parking areas shall be capped as necessary to the satisfaction of the Director of Public Services. All paving shall be accomplished prior to the granting of occupancy on any new buildings. A City standard driveway and curb depression shall be installed at the northerly entrance prior to the granting of occupancy. Vegetation at both entrances shall be triced or removed to eliminate sight distance problems and lighting shall be installed at the new driveway location as required by the Director of Public Services. Ail paved drives shall be a minimum of 24 feet wide (two way) and 14 feet wide (one way). Existing utility poles shall be relocated as necessary to provide clearance. 4. Ail new buildings shall be located outside of the 60 foot IOD and building line setback as described on PM 10710. Prior to the issuance of any building permits, the existing covenant on PM 10710 for access to Parcel 1 must be revised to require improved access to Parcel 1 from a public street at such time as that parcel is further divided or developed by providing access to 1) Valle Verde (via Paseo Del Vinedo), or 2) improvement to the 60 foot IOD, or 3) connection by an improved private easement to Paseo Verano Del Norte. Prior to the issuance of building permits, the applicant shall provide evidence to the City Engineer, based upon the previous 100 year flood study, that proposed buildings are outside of the 100 year floodplain. 7e Prior to occupancy of the buildings, interim flood control measures (berm swale, ditch) shall be installed to the satisfaction of the Director of Public Services to protect existing buildings and confine sheet flow. Resolution No. P-83-16 DR 83-02 Page 3 Revised site plans shall include a delineation of the boundaries of the winery complex and with any further division of either parcel an individual parcel conforming to the described boundaries shall be proposed. An open space buffer 100 feet in width shall be granted around the perimeter of the winery boundary to separate the site from future residential development. This buffer area shall include landscaping (trees), earthern berming or wall, or a combination berm/wall. Improvements to the buffer area shall be installed within 60 months of this approval and shall include the Paseo Del Verano Norte frontage. 10. Directional signage shall be provided in accordance with the City's Sign Ordinance to direct traffic to the on-site parking areas prior to occupancy and buses shall be required to utilize those parking areas. 11. A historical study of the winery shall be completed within 36 months of this approval to the satisfaction of the Director of Planning Services. 12. A list of acceptable uses for the winery complex shall be developed by the Department of Planning Services for City Council approval prior to the issuance of building permits. 13. Road improvements to nondedicated rural standards shall be installed to connect Valle Verde B~ad and the winery complex within 36 months. Section 4: City Council Decision: The City Council hereby approves Development Review 83-02, subject to the following standard conditions: I. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: A. SITE DEVELOPMENT Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Planning Services Department prior to issuance of building permits. 3e 2o 3. C. 1. Resolution No. P- 83-16 DR 83-02 Page 4 Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at time of Building Permit issuance. Trash receptacle areas shall be enclosed by a 6 foot high masonry wall with view obstructing gates pursuant to City standards. Location shall be subject to approval by the Planning Services Department. Ail roof appurtenances, including air conditioners, shall be architecturally integrated, shielded from view and sound buffered from adjacent properties and streets as required by the Planning Services Department. PARKING AND VEHICULAR ACCESS Parking lot lights shall be a maximum height of 18 (eighteen) feet from the finished grade of the parking surface and directed away from all property lines, adjacent streets and residences. Parking lot trees shall be a minimum 15 gallon size. Ail parking spaces shall be double striped. LANDSCAPING A detailed landscape and irrigation plan shall be submitted to and approved by the Planning Services Department prior to the issuance of building permits. Ail landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. SIGNS A Comprehensive Sign Program for this development shall be submitted to the Planning Services Department for their review prior to occupancy for any of the new buildings. Approval shall be by the City Council. RECREATION No Conditions ADDITIONAL APPROVALS REQUIRED No Conditions Resolution No. P- 83-16 DR 83-02 Page 5 II. APPLICANT SHALL CONTACT THE BUILDING DIVISION REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: G. SITE DEVELOPMENT The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of approval of this project. Prior to issuance of building permits for combustible construction, evidence shall be submitted to the Director of Safety Services that water supply for fire protection is available. Where additional fire protection is required by the Director of Safety Services, it shall be serviceable prior to the time of construction. Prior to the issuance of a building permit for a new commercial or industrial development, or addition to an existing development, the applicant shall pay development fees at the established rate. Such fees may include, but not be limited to: Drainage Fee, Permit, Plan Checking Fees, Water and Sewer Service Fees. H. EXISTING STRUCTURES Provide compliance with the Uniform Building Code for property line clearances considering use, area and fire-resistiveness of existing buildings. I. GRADING No Conditions III. APPLICANT SHALL CONTACT THE PUBLIC SERVICES DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: STREETS AND SIDEWALKS Prior to any work being performed in the public right-of-way, an encroachment permit shall be obtained from the Public Services Office and appropriate fees paid, in addition to any other permits required. Resolution No. P-83-16 DR 83-02 Page 6 2e DP~AINAGE AND FLOOD CONTROL The applicant will be responsible for construction of all onsite drainage facilities required by the Director of Public Services. UTILITIES Developer shall be responsiblle for the relocation and undergrounding of existing public utilities, as required. Water and sewer system plans shall be designed and constructed to meet requirements of the City of Poway and the Health Department of the County of San Diego (a letter of availability from the sewer division will be required prior to recordation or issuance of a building permit whichever comes first. Prior to the issuance of building permit the developer shall pay the Bridge and Major Thoroughfare Construction Fee at the established rate. M. GENERAL REQUIREMENTS AND APPROVALS No Conditions PASSED, APPROVED, and ADOPTED by the City Council of the city of Poway, California, at a regular meeting thereof this 22nd day of March 1983.
