A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
CERTIFYING THE FINAL ENVIRONMENTAL
IMPACT REPORT AND DENYING GENERAL
PLAN AMENDMENT NO. 82-01H
ASSESSOR'S PARCEL NUMBERS 275-232-01 to 06, 36, 42, and 45
WHEREAS, General Plan Amendment No. 82-01H, submitted by Jordan Bauman
et al, applicants, requested an amendment to the Land Use Element of the
the City General Plan for the property located on the southeast corner of
the intersection of Stone Canyon Road and Pomerado Road, and
WHEREAS, on February 22, 1983, and March 8, 1983, the City Council
held duly advertised public hearings to solicit co~m~ents from the public,
both pro and con, relative to this application;
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section l: Findings
That a Draft Environmental Impact Report was prepared, reviewed,
and commented upon and a Final EIR prepared under the provisions
of CEQA.
That the Final EIR found that no adverse environmental impacts
will result from the project development that cannot be
adequately mitigated.
That the proposed application if approved and ultimately
developed would be incompatible with the existing rural land
uses.
That sufficient market demand does not exist to accommodate both
the proposed site and a proposal to construct a supermarket
across Pomerado Road in the City of San Diego.
5. That the subject site could be developed under the existing land
use designation with mitigation for access and noise.
Section 2: City Council Decision
The City Council hereby certifies the Final Environmental Impact
Report prepared for the review of the application as being an
accurate assessment of the environmental impacts that would occur
as a result of project approval and ultimate development based
upon available information at the time of preparation and review.

The City Council hereby denies General Plan Amendment No. 82-01H
based upon the aforemetioned findings.
PASSED, APPROVED, and ADOPTED by the City Council of the City of
Poway, California, at a regular meeting thereof this 5th day of April, 1983.
