Res P-83-21RESOLUTION NO. P-83-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW 83-03 ASSESSORS PARCEL NUMBER 321-341-10-12 321-342-1, 6-16 W~EREAS, Development Review 83-03 submitted by Ponderosa Homes, applicant; request development review of 20 single family dwelling units to be known as Phase III and IV of the North County Estates located along the east and west sides of Derrenger BDad from Old Station to Fiddletown Road in the R-R-2 (Rural Residential) zone; and WHEREAS, on April 12, 1983, the City Council held a hearing on the above referenced item; NOW, THEREFORE, the City Council does hereby resolve as follows: SECTION 1: Findings: 3e 4e That the proposed development is in conformance with the Poway General Plan for residential use, density and improvements. That the proposed development will not have an adverse aesthetic, health, safety or architecturally related impact upon adjoining properties because rooflines, building materials, and housing style are compatible with adjacent development. That the proposed development is in compliance with the zoning Ordinance. That the proposed development encourages the orderly and harmonious appearance of structures and property within the City because it is similar to and compliments adjacent residential development. SECTION 2: Environmental Findings: The Tract Map 3087 was submitted prior to the implementation of the California Environmental Quality Act guidelines and that future phases of the subdivision are categorically exempt providing the project is consistent with the design of the existing development. Resolution No. P-83-21 Page 2 SECTION 3: City Council Decision: The City Council hereby approves Development Review 83-03 subject to the following conditions: 2e The developer shall include post a bond for or otherwise guarantee the installation of front yard landscaping by each property owner within ninety (90) days of the close of escrow, with that condition to be enforced by the developer. The developer shall preplumb each house for a solar hot water heating system. Building plans shall be modified to provide the plumbing prior to the issuance of building permits. Distribution and color schemes of the proposed Spanish elevations will be subject to the satisfaction of the Director of Planning Services and shall be determined prior to the issuance of building permits on units other than the models. All signs proposed for this development shall be designed in conformance with the City's Sign Ordinance for on- and off-site subdivision signs and all signs not conforming shall be removed prior to framing inspection. The developer shall develop and design a hierarchical system of street trees for the entire subdivision to be implemented to the satisfaction of the Director of Planning Services prior to occupancy for these units. On lots already sold the developer shall offer to provide and install the trees if desired by the owners. Ail other conditions of TM 3087 shall be completed prior to occupancy of any units. SECTION 4: City Council Decision: The City Council hereby approves Development Review 83-03 subject to .he following Standard Conditions: I. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: SITE DEVELOPMENT Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at time of Building Permit issuance. Mail boxes, in areas where sidewalks are required, shall be installed and located by the developer subject to approval by the Planning Services Department. The developer shall integrate a variety of approved roof materials and colors into the design of the residential development in a manner which is both compatible and complementary among each of the residential units. Ail roof appurtenances, including air conditioners, shall be architecturally integrated, shielded from view and sound buffered from adjacent properties and streets as required by the Planning Services Department. PARKING AND VEHICULAR ACCESS No Conditions LANDSCAPING Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the Master Plan of street trees for the City of Poway and shall be planted at an average of every 30 feet on interior streets and 20 feet on exterior streets. Ail landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. SIGNS No Conditions RECREATION No Conditions ADDITIONAL APPROVALS REQUIRED The developer shall display a current Zoning and Land Use Map in the sales office at all times, and/or suitable alternative to the satisfaction of the Director of Planning Services. When public or private equestrian/pedestrian/ trails are required as a part of the subdivision, the developer shall display a map in the sales office, of said subdivision, indicating the trails. Resolution No. P-83-21 Page 4 II. APPLICANT SHALL CONTANT THE BUILDING DIVISION REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: G. SITE DEVELOPMENT The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of approval of this project. Prior to issuance of building permits for combustible construction, evidence shall be submitted to the Director of Safety Services that water supply for fire protection is available. Where additional fire protection is required by the Director of Safety Services, it shall be serviceable prior to the time of construction. Prior to the issuance of a building permit for a new residential dwelling unit(s), the applicant shall pay development fees at the established rate. Such fees may include, but not be limited to: Park Fee, Drainage Fee, Permit and Plan Checking Fees, School Fees (in accordance with city-adopted policy and/or ordinance), Water and Sewer Service Fees. Se This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color.
