Res P-83-28RESOLUTION NO. P-83-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW APPROVAL 83-04 ASSESSOR'S PARCEL NUMBER 314-670-01-54, 314-681-01-39 WHEREAS, Development Review Approval 83-04, submitted by Barratt, San Diego, applicant, requests development review of an initial 77 single family dwelling units and 16 future and is to be known as Adobe Ridge for the property located at the SW corner of Camino Del Notre and Pomerado Road, in the R-S-4 (Residential Single Family); and WHEREAS, on May 10, 1982, the City Council held a hearing on the above referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: 2e That the proposed development is in conformance with the Poway General Plan for residential use, density, and improvements. That the proposed development will not have an adverse aesthetic, health, safety or architecturally related impact upon adjoining properties because rooflines, building materials' and housing sites are compatible adjacent development. That the proposed development is in compliance with the Zoning Ordinance. That the proposed development encourages the orderly and harmonious appearance of structures and property within the City because it is similar and complements adjacent residential development. Section 2: Environmental Findings: The City Council finds that the Environmental Impact Report certified on October 23, 1976, covers the environmental impacts associated with the development. Section 3: City council Decision: The City Council hereby approves Development Review 83-04, subject to the following conditions: The developer shall install front yard landscaping and a front yard sprinkler system for each dwelling unit. The developer shall install a six-foot-high fence with a three- foot-wide gate between each unit and a six-foot-high fence located outside of and parallel to the ultimate public right-of-way on properties with exterior side yards prior to occupancy. Sidewalk mailboxes that conform to the United States Postal Service requirements shall be installed by the developer two to a post located between properties prior to occupancy. The developer shall preplumb each house for a solar hot water heating system. Building plans shall be modified to provide the plumbing prior to the issuance of building permits for units other than the models. The developer shall construct a noise atteunation wall in the location approved with the tentative map. Any modification of the location, materials, or design of the wall shall be to the satisfaction of the Director of Planning Services. The buyers of lots which have frontage along Camino Del Norte and Pomerado Road shall be provided with a cross-section of and related text describing the noise attenuation fence and shall sign a statement indicating knowledge of the noise study conducted for the project and the purpose of the wall for noise attenuation. (This condition will replace Standard Conditions F-7, 8, 9, and 10.) The developer shall offer to the City of Poway as a dedicated open space the northern slopes associated with Parcels 82 through 94 with exclusive rights to the City of Poway. The developer shall require the property owners to participate in a landscaping maintenance district. Said district shall include the maintenance of all landscaping associated with the dedicated open planted slopes outside the noise attenuation wall and the noise attenuation walls; the costs involved in district formation shall be borne by the developer. Ail signs proposed for this development shall be designed in conformance with the City's Sign Ordinance for on- and off-site subdivision signs. Necessary sanitary facilities for the sales office must be provided. Any modification of the proposed units in the model home complex shall be to the satisfaction of the Director of Planning Services. Distribution the propsed Spanish elevations will be subject to the satisfaction of the Director of Planning Services and shall be determined prior to the issuance of building permits on units other than the models. The developer shall install an equestrian/pedestrian trail on Camino del Norte in accordance with city standards and to the satisfaction of the Planning Services Director. 13. An administrative variance for lots 83, 84, and 89 is hereby issued to allow for a maximum reduction of 3' - 0" for sideyards. 14. Sidewalks in accordance with city standards shall be installed on Pomerado Road to the satisfaction of Director of Public Services. SECTION 4: City Council Decision: The City Council hereby approves Development Review 83-04, subject to the following Standard Conditions: APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: A. SITE DEVELOPMENT Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Planning Services Department prior to issuance of building permits. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at time of Building Permit issuance. Mail boxes, in areas where sidewalks are required, shall be installed and located by the developer subject to approval by the Planning Services Department. B. PARKING AND VEHICULAR ACCESS No Conditions C. LANDSCAPING A detailed landscape and irrigation plan shall be submitted to and approved by the Planning Services Department prior to the issuance of building permits. Resolution No. P-83-28 Page 4 Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the Master Plan of street trees for the City of Poway and shall be planted at an average of every 30 feet on interior streets and 20 feet on exterior streets. Ail landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. SIGNS Any signs proposed for this development shall be designed in conformance with the Sign Ordinance and shall require review and approval by the City Council. RECREATION The developer is required on lots having a private or public equestrian/pedestrian/bicycling trail on or adjacent to their property to have contained within the C. C. & R.'s the following statement: In purchasing the home, I have read the CC&R's and understand that said Lot is subject to an easement for the purpose of allowing equestrian/pedestrian/bicycling traffic to gain access. The developer shall improve and maintain, or cause to be maintained, the Equestrian/Pedestrian/ Trail system in accordance with the adopted design standards and to the satisfaction of the Directors of Public and Planning Services. ADDITIONAL APPROVALS REQUIRED The developer shall display a current Zoning and Land Use Map in the sales office at all times, and/or suitable alternative to the satisfaction of the Director of Planning Services. Ail sales maps that are distributed or made available to the public shall include but not be limited to trails, future and existing schools, parks, and streets. II. III. Resolution No. P-83-28 Page 5 APPLICANT SHALL CONTACT THE BUILDING DIVISION REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: G. SITE DEVELOPMENT The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of approval of this project. Prior to the issuance of a building permit for a new residential dwelling unit(s), the applicant shall pay development fees at the established rate. Such fees may include, but not be limited to: Park Fee, Drainage Fee, Permit and Plan Checking Fees, School Fees (in accordance with city-adopted policy and/or ordinance), Water and Sewer Service Fees. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. 4. Street addresses shall be provided by the Building Official. Se Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. H. EXISTING STRUCTURES No Conditions I. GRADING Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading Standards and accepted grading practices. APPLICANT SHALL CONTACT THE PUBLIC SERVICES DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: J. STREETS AND SIDEWALKS Ail Circulation Element roads shall be dedicated and improved to Circulation Element road standards and to the specifications of the Director of Public Services. 3e Ke Resolution No. P-83-28 Page 6 Street striping and signing shall be installed to the satisfaction of the Director of Public Services. Prior to any work being performed in the public right-of-way, an encroachment permit shall be obtained from the Public Services Office and appropriate fees paid, in addition to any other permits required. DRAINAGE AND FLOOD CONTROL No Conditions UTILITIES Prior to acceptance of property for sewer service, annexation to the sewer improvement District shall occur. M. GENERAL REQUIREMENTS AND APPROVALS An open space easement be granted to the City over, upon, across and under the area defined on the final maps as an equestrian trail and no building, structures or other things shall be constructed, erected, placed or maintained on subject easements except for the construction and maintenance of said trail and structures appurtenant to the trail. Dedicate the Master Planned Equestrian/Pedestrian/Bicycling trails to the satisfaction of the Directors of the Departments of Public and Community Services in accordance with the Master Plan of Trails Element.
