P-83-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TENTATIVE PARCEL MAP 17326 ASSESSOR'S PARCEL NUMBER 322-010-8, 9 WHEREAS, Tentative Parcel Map No. 17326, hereinafter '~4ap" submitted by Walter Peterson, applicant, for the purpose of subdividing the real property situated in the City of Poway, County of San Diego, State of California, described as Lot 2, Section 3, Township 74 South, Range 1 West, San Bernardino Base Meridan, County of San Diego, State of California into four (4) lots, regularly came before the City Council for public hearing and action on July 72, 1983; and WHEREAS, the Director of Planning Services has recc,~.emded APPROVAL of the Map subject to all conditions set forth in the Planning Services Department report; and WHEREAS, the City Council has read and considered said report and bm.~ considered other evidence presented at the public hearing. NOW, IHEREFORE, the City Council of the City of Poway does resolve as follc~s: Section 1: Findings: The City Council retakes the following findings in regard to Tentative Parcel No. 7 7326 and the Map thereof: be Co The tentative parcel is consistent with all applicable interim and proposed general and specific plans, because the proposed lot sizes meet the minimum slope requirements of the existing land use element. Although not consistent with the intensity of residential development proposed by the new General Plan, there is little or no probability of substantial detriment or interference with the future adopted General Plan if the use proposed is ultimately inconsistent with the new General Plan. The design or improvement of the tentative parcel is consistent with all applicable interim and proposed general and specific plans, because the lot configurations, road and drainage improvements are designed to meet the existing requirements. The site is physically suitable for the type of development proposed, because the low density, single family detached cbmracter of the proposed development will not result in %a~ecessary grading or disruption of the environment which can not otherwise be mitigated. The site is physically suitable for the density of the development proposed for the reasons mentioned above. Resolution No. P-83-37 Page 2 The design of the subdivision is not likely to cause substantial emvir~,.~ental damage and avoidable injury to humans and wildlife or their habitat, because minimal improvements are associated with the proposed development and an open space easement will cover the most sensitive area of the property. fe The tentative parcel is not likely to cause serious public health problems, because all necessary public facilities and services will be available to serve the proposed project. The design of the tentative parcel will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. ho That this project will not create adverse impacts on the environment and a Mitigated Negative Declaration is issued with mitigation for biology (Condition 3, Section 2) and aesthetics (Condition 3 and 4, Section 2). Section 2: Tentative Parcel Map No. 17326, a copy of which is on file in the Planning Services office, is hereby approved subject to all of the following conditions: The on- and off-site roadways shall be improved to City standards for non-dedicated rural local streets in accordance with City Ordinance. Crossings of existing drainage courses shall be improved with drainage structures designed to carry a ]00-year storm flow. The precise location of roads as shown on the tentative parcel map may vary as required because of the rugged topography of the area and to minimize road grading· The pavement width may also vary for these same reasons for short reaches only to the satisfaction of the City Engineer. Access from Highway 67 to the subject property shall be provided to the satisfaction of the City Engineer. 2. A paved tumaround area shall be provided on each parcel and at the end of the roadway to the satisfaction of the City Engineer. An open space easement as described in attachment 3 of the staff report of July ]2, ]983, shall be granted to the City in a form approved by the City Attomey to mitigate potential impacts associated with biology (Mountain Mahogony) and aesthetics (vista preservation). Resolution No. P-83-37 Page 3 o e Grading for pad sites shall be minimized through the use of split level or extended foundation construction or other reduced grading construction techniques to the satisfaction of the Director of Planning Services as mitigation of a potentially significant envir~.~ental impact. A groundwater study demonstrating the existence of adequate water for the parcels proposed and based on the requirements of City Resolution No. 294 shall be cuupleted to the satisfaction of the City Engineer. o Prior to final map approval, all of the above improvements and requirements may be deferred by guaranteeing installation within two years from map recordatien or prior to building permit issuance, by the execution of a performance agreement, secured with sufficient bonds, in a form approved by the City Attorney. Ail necessary processing fees, deposits, end charges shall be paid prior to final map approval. 0 The tentative map approval shall expire on July 12, 1985, unless an applicantion for time extension is received 30 days prior to expiration in accordance with the City's Subdivision Ordinance. Section 3: Tentative Parcel Map No. 17326, a copy of which is on file in the Planning Services office, is hereby approved subject to the following Standard Conditions: APPLICANT SHB~. CONTACT THE DEPARTMMqT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLTOWING OONDITIONS: Ae J SITE DEVMLOPMENT Site shall be developed in accordance with the approved site plans on file in the Planning Services DepaLtment and the conditions contained herein. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at time of Building Permit iss~mnce. All roof appurtenances, including air conditioners, shall be architecturally integrated, shielded from view and sound buffered from adjacent properties and streets as required by the Planning Services Department. Resolution No. P-83-37 Page 4 II. e Prior to any use of the project site or business activity being c~a~enced thereon, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning Services. Street names shall be approved by the Planning Services Department prior to the recordation of the final map. B. PARKING AND VEHICUIAR ACCESS No Conditions C. Dead, decaying or potentially d_~ngerous trees shall be approved for removal at the discretion of the Planning Services Depa£tment during the review of theM aster Plan of Existing On-Site Trees· Those trees which are approved for removal shall be replaced on a tree-for-tree basis as required by the Planning Services Department. APPLICANT SHALL CONTACT THE BUILDING DIVISION REGARDING COMPLIANCE WITH THE FOLIDWING CONDITIIONS: G. SITE DEVELOPMENT The applicant shall comply with the latest adopted Uniform Build- ing Code, Uniform Mechmnical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of approval of this project. Resolution No. P-83-37 Page 5 III. e Prior to issuance of building permits for combustible construc- tion, evidence shall be submitted to the Director of Safety Services that water supply for fire protection is available. Where additional fire protection is required by the Director of Safety Services, it shall be serviceable prior to the time of construction. Be Prior to the issuance of a building permit for a new residential dwelling unit(s), the applicant shall pay developmemt fees at the established rate. Such fees may include, but not be limited to: Park Fee, Drainage Fee, Permit and Plan Checking Fees, School Fees (in accordance with city-adopted policy and/or ordinance), Water and Sewer Service Fees. e Street addresses shall be provided by the Planning Services Department. H. EXISTING STRUCTURF-q No Conditions I. GRADING Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading Standards and accepted grading practices. The grading plan shall contain a certificate signed by a regis tered civil engineer that the grading plan has preserved a minimum of 100 square feet of solar access for each dwelling unit and for each future building site within the subdivision. 3. A soils report shall be prepared by a qualified engineer licensed by the State of California to perform such work. A geological report shall be prepared by a qualified engineer or geologist and submitted at the time of application for grading plan check. The final grading plan shall be subject to review and approval by the Planning Services and Public Services Departments and sbmll be c~pleted prior to recordation of the final subdivision map or iss, mnce of building permit whichever comes first. Resolution No. P-83-37 Page 6 e 0 me Lo e Street improvement plans prepared on standard size sheets by a Registered Civil Engineer shall be submitted for approval by the Director of Public Services. Standard plan check and inspection fees shall be paid by the developer. DRAINAGE AND FLOOD CONTROL The applicant will be responsible for construction of all onsite drainage facilities required by the Director of Public Services. A drainage system capable of handling and disposing of all surface waters originating within the subdivision, and all surface waters that may flow onto the subdivision from adjacent lands, shall be required. Said drainage system sbmll include any easements and structures as required by the Director of Public Services to properly handle the drainage. The Master Plan of Drainage Fee shall be paid at the established rate in accordance with the Drainage Ordinance. UTILITIES Ail proposed utilities within the project shall be installed underground including utilities along Circulation Element roads and/or highways less than 34.5 KV. Utility easements shall be provided to the specification of the serving utility companies and the Director of Public Services. Developer shall be responsiblle for the relocation and undergrounding of existing public utilities, as required. Water sewer and fire protection system plans shall be designed and constructed to meet requirements of the City of Poway and the Health Department of the County of San Diego (a letter of availability from the sewer division will be required prior to recordation or issuance of a building permit whichever comes first. Prior to recordation of the final map, the developer shall pay the Bridge and Major Thoroughfare Construction Fee at the established rate. Resolution No. P-83-37 Page 6 M. G~I~ERAL RMQUIRMMENTS AND APPRDVAT-q 1. Final parcel and tract maps shall conform to City standards and procedures. 2. All provisions of Subdivision Ordinance of the Pc~ay City Code shall be met as they relate to the division of land.
