A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TENTATIVE TRACT MAP 395] TIME EXTENSION
ASSESSOR'S PARCEL NUMBER 321-01-1
WHEREAS, Tentative Tract Map No. 3951, hereinafter "Map" submitted by Blue
View Inc./North Poway Ltd., applicant, for the purpose of subdividing the real
property situated in the City of Poway, County of San Diego, State of
California, described as 39.31 acres located on the NW corner of the
intersection of Via Molinero and Del Poniente Road in the R-R-1 (Rural
Residential) zone into 36 lots, regularly came before the City Council for
public hearing and action on August 9, ]983; and
WHEREAS, the Director of Planning Services has recommended approval of the
Map subject to all conditions set forth in the Planning Services Department
report; and
WHEREAS, the City Council has read and considered said report and has
considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council of the City of Poway does resolve as
follows:
Section 1: Findings:
The City Council makes the following findings in regard to Tentative Tract
No. 3951 and the Map thereof:

The tentative tract is consistent with all applicable interim and
proposed general and specific plans, as it provides for the
continuance of residential development in the rural residential area
and zone.
The design or improvement of the tentative tract is consistent with
all applicable interim and proposed general and specific plans, because
the proposed improvements meet the General Plan requirements for
residential development.
c. The site is physically suitable for the type of development proposed,
because it is adjacent to similar residential development.

The site is physically suitable for the density of the development
proposed, because it meets the minimum lot size requirements of the
rural residential zone.

The design of the subdivision is not likely to cause substantial
environmental damage and avoidable injury to humans and wildlife or
their habitat, because no significant environmental impacts are
evident.

The tentative tract is not likely to cause serious public health
problems, because water is available and adequate sewer systems can be
provided.
The design of the tentative tract will not conflict with any easement
acquired by the public at largel, now of record, for access through or
use of the property within the proposed subdivision.
That this project will not create adverse impacts on the environment
and a Mitigated Negative DeclarRtion has been previously issued with
mitigation for Traffic Circulation.
Section 2:
Tentative Tract Map No. 3951, a copyiof which is on file in the Planning
Services office, is hereby approved subject to all of the following
conditions:
The subdivider shall submit plans and specifications for improvements
of all streets, rights-of-way, drainage easements, culverts, drainage
structures and drainage channel~ to the Department of Public Services
for approval. Unless specifically waived herein, such plans and
specifications shall provide for and be subject to the following
conditions number 2 through 16.
2. Street alignment and grade, including the change of any existing or
proposed street alignment and grade, as required by the Director of
Public Services.
3. A drainage system capable of hagdling and disposing of all surface
waters originating within the subdivision and all surface waters that
may flow onto the subdivision from adjacent lands. Said drainage
system shall include any easements and structures required by the
Director of Public Services to properly handle the drainage.
4. The improvement of all drainageieasements by culvert or drainage
channel of adequate size, whichever is required by the Director of
Public Services. Any required drainage channel shall be lined with a
suitable material as specified by the Director of Public Services.
All such drainage easements shakl be monamented along property lines
at locations approved by the Director of Public Services. An access
easement shall be provided to each drainage system maintenance access
point not directly accessible from a public roadway. Such access
easement to be improved, fenced and aligned to the satisfaction of the
Director of Public Services.

The installation of all gas, electric, sewer, and water lines; and any
other below surface utilities to take place before the installation of
any concrete curbs, gutters, and sidewalks, and the surfacing of the
streets.
Portland cement concrete cross gutters to be installed where water
crosses the roadways.
The exact depth of imported base material to be based on soil tests
which have been approved by the Director of Public Services.
A street lighting system conforming to San Diego County standards to
be shown and to be installed at no cost to the public.
Ail lighting devices, or combinations thereof, on a common fixture
that are to be placed in the public right-of-way are subject to the
following conditions:

Cut-off luminaires shall be installed which will prove true ninety
degree (90%) cutoff and prevent projection of light above the
horizontal from the lowest point of the lamp or light emitting
refractor or device.
b. Ail fixtures shall use a clear, low pressure sodium vapor light
source.
c. No mercury vapor, quartz, metal halide or phosphor coated high
pressure sodium lamps shall be installed.
Sight distance requirements at all public street intersections to
conform to the intersectional sight distance criteria as provided by
the American Association of State Highway Officials in the publication
"Geometric Design for Local Roads and Streets - 1971" or as revised.
If the improvement plans show a need to excavate in any public road
right-of-way, the developer shall place a cash deposit with the
Director of Public Services to insure that any damage to the existing
roadway is repaired in a timely manner.
Unless specifically waived herein, the San Diego County Standards
shall apply in preparing improvement plans irrespective of what is
shown on the approved tentative map.
Improve Del Poniente road to a graded width of 40 feet with 28 feet of
A.C. pavement over approved base and P.C.C. curb, gutter and sidewalk
with curb at 20 feet from centerline on the north side.

Improve Del Poniente Road offsite from the subdivisions easterly
boundary to Espola Road to a graded width of 40 feet with 28 feet of
A.C. pavement over approved base, A.C. dikes at 14 feet from
centerline and all necessary drainage structures. All transitions
shall be entirely offsite.
Improve the Riding and Hiking Trail System to the following design
standards to the satisfaction of the Director of Public Services:

The trail shall contain eight (8) feet of tread width on passable
turf of approved material and shall include any necessary slope
rights adjacent to the trail.

Trail gradients shall not exceed 15%. Where natural grades exceed
15%, sufficient width for switchbacks shall be provided to
accommodate a 15% gradient trail.
c. Trails shall intersect roads at 90° angles.
d. The trail system shall be continuous through the subdivision and
shall provide for local access within the subdivision.
e. Points where the trail exits the subdivision shall be coordinated
with existing or planned trail locations on adjacent property.
Each building lot shall have a flood-free site for a residence. The
building site shall be safe from the flood flow peak of a 100-year
frequency storm.
Adequate energy dissipators are to be constructed at the outlets of
the storm drains.
Hydrology and hydraulic calculations for determining the water surface
profile and adequate field survey cross sections data shall be
provided satisfactory to the Department of Public Services.
Prior to the issuance of a grading permit the subdivider shall comply
with the following conditions lettered a and b:

The subdivider shall submit grading plans and grading permit
application and all grading permit fees and deposits to the
Department of Public Services. Grading plans shall be approved
prior to or concurrently with the approval of the Improvement
Plans.

No grading shall be permitted within this subdivision until the
subdivider obtains sewer commitment from the City of Poway Public
Services Department.
Submit to the Department of Public Services a letter from the Contract
Compliance Office stating its approval of an affirmative fair housing
marketing plan.
Cause all of the land within this subdivision to be annexed to the
City of Poway Public Services Department; obtain the commitment of
said Department to connect all lots within the property within this
subdivision to said Department's sewer system; and obtain the approval
of said Department of Public Services plans and specifications for the
installation of a sewer system serving each lot within the
subdivision.
Submit a letter from the City of Poway Public Services Department
stating satisfaction with the type and location of fire hydrants and
the minimum water supply pipe size.
The final map shall show or provide for the following lettered a
through f:

Dedicate all on-site drainage easements, including easements for
access thereto, and show monumentation for such easements, as
required by the Director of Public Services.
b. No lot shall contain a net area of less than one (1) acre.
The final map shall include the entire area shown on the
tentative map and shall not be filed as units; lot numbering and
design on the final map shall be in substantial conformance to
that shown on the tentative map.
Offer to dedicate the south half of North Crest Lane on the
northerly boundary to a width of 26 feet plus slope rights. The
offer may be by separate doument and shall terminate at the most
westerly easement road on Parcel 3 (three) 278-170-55 of P.M.
2745 with an offer for a County Standard knuckle plus slope
rights.
Dedicate a riding and hiking trail along the entire westerly
boundary, easterly boundary and northerly boundary adjacent to
the irrevocable offer to dedicate North Crest Lane: the
easements shall be 20 feet in width except where they are
adjacent to road right-of-ways or offers, where the easement
shall be ten (10) feet, or to the satisfaction of the Director of
Public Services.

The 100-year flood line of the natural channels crossing all lots,
and draining watersheds in excess of 25 acres, shall be clearly
delineated on the final map.
24. The subdivider shall accomplish the following lettered a through k:
The subdivider shall grant to the appropriate agency by recorded
document all required off-site easements and all on-site water
main easements that serve fire hydrants.
b The subdivider shall deposit with the Department of Public
Services, a cash deposit sufficient to:
1. Energize, maintain and operate the street lighting system
until tax revenues begin accruing from the subdivision for
those purposes.
2. Augment the Contingency Fund of the existing Department by an
amount equal to three months' operating cost of the
subdivision.
3. Augment the Reserve Fund by one month's operating cost.
4. Pay the cost of annexation to an appropriate special district
including the cost of processing through the State Board of
Equalization. After recording of the final map, the
subdivision shall be annexed without notice or hearing, to an
existing special district to operate and maintain the system.
The subdivider shall install or agree to install a sewer system as
a subdivision improvement and dedicate to the public that portion
of such system which is within an existing or proposed public
right-of-way.

Streets shown on the tentative map to be given street names
approved by the Street Address Section of the Department of
Planning Services and the subdivider shall install all street name
sights as a part of the subdivision street improvements.

The subdivider shall deposit with the Department of Public
Services $200.00 at the time the Lot Grading Plan or Improvement
Plan is submitted. The deposit will be made with whichever plan
is first submitted. Said deposit shall be used to cover the cost
of site inspection by a Geologist to determine whether or not any
geologic hazard exists and, if such is found, to review the
geologic report prepared by the developer's Engineering Geologist.
The developer shall reimburse the Department of Public Services
for any cost in excess of the deposit prior to recording the Final
Map. Any unused portion of the deposit will be refunded.

The subdivider shall deposit fees in the amount of seven thousand
two hundred dollars ($7,200.00) with the City of Poway, or
guarantee payment of those fees as may be required pursuant to
Sections 810.106 and 810.107 of the Park Lands Dedication
Ordinance.
The subdivider shall provide the Director of Public Services with
documentation from a licensed cable television operator stating
that arrangements for the underground installation of cable
television lines have been made or that a waiver of the underground
installation has been granted by the Poway City Council, upon
consideration of a report by the CATV Review Commission that no
licensed CATV operator is found to be willing and able to install
cable television lines in the subdivison.
The subdivider shall comply with Section 66436 of the Government
Code by furnishing to the Department of Public Services a
certification from each public utility and each public entity
owning easements within the proposed subdivision stating that: (a)
they have received from the developer a copy of the proposed final
map; (b) they object or do not object to the filing of the map
without their signature; (c) in the case of a street dedication
affected by their existing easement, they will sign a
"subordination certificate" or "joint-use certificate" on the map
when required by the governing body.
The subdivider shall secure recertifications satisfactory to the
Director of Public Services of availability of adequate public
services and utilities including but not necessarily limited to:
fire, water and sewer services to the site, said recertifications
dated within 90 days prior to the City Council approving final
map. (CND)
The developer shall place a cash deposit in the amount of
$13,147.00 with the City of Poway for the improvement of future
Circulation Element roads in the Poway Area.
The developer shall participate in the cost of traffic signal
installation at the intersection of Espola road (SF 1407) and Del
Poniente. The amount of the developer's portion of the entire
cost of each signal shall be determined by the Director of Public
Services.

The protection of the public interest requires that the subdivider,
contractors, builders, lot or parcel owners, and other persons, firms
and corporations concerned with the development of said subdivision
conform to the following standards; and all permits required by the
City of Poway will be issued pursuant to such standards:
a. Ail domestic water supplied for this subdivison shall come from
the City of Poway Public Services Department.

Ail buildings constructed in this subdivison shall be connected to
the public sewer system of the City of Poway Public Services
Department.
c. Sewer and water lines shall not be laid in the same trench in any
part of this subdivision.
d. Proper drainage shall be maintained throughout this subdivison so
as to prevent ponding and/or storage of surface water.
Tentative Tract Map 3951 Time Extension shall expire on June 16, 1984
unless a request for time extension is received in accordance with the
City's Subdivision Ordinance.
APPROVED AND ADOPTED by the City Council of the City of Poway, State of
California, this 9th day of August, 1983.
