A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVAL OF ZONING ADMINISTRATIVE PERMIT 78-14M TIME EXTENSION
ASSESSOR'S PARCEL NUMBER 321-210-34
WHEREAS, Conditional Use Permit, submitted by Prensatt, Inc.,
applicant, requests a time extension for a use permit to conduct a
Montessori day care facility for 50 children located at 14911 Espola Road,
in the A-70-1 (limited agricultural) zone; and,
WHEREAS, on August 23, 1983, the City Council held a duly advertised
public hearing to solicit comments from the public, both pro and con,
relative to this application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section l: Findings:

That the location, size, design, and operating characteristics of
the proposed use will be compatible with and will not adversely
affect or be materially detrimental to adjacent uses, residents,
buildings, structures, or natural resources because the
characteristics of surrounding use have similar urban qualities.
That the harmony in scale, bulk, coverage and density is
consistent with adjacent uses because the adjacent residential
uses are separated from the building envelope by passive and
active open space and road alignments and because surrounding
uses are complementary with the use of the site for a preschool.
Architectural features of the structure blend with the
surrounding residential buildings.
That there are available public facilities, services and
utilities.
That there will not be a harmful effect upon desirable
neighborhood characteristics because the use of the site as a
child care center is compatible with surrounding residential
uses.
That the generation of traffic will not adversely impact the
surrounding streets and/or the City's Circulation Element because
adequate on-site parking is proposed.
That the site is suitable for the type and intensity of use or
development which is proposed because the property has undergone
previous development.
That there will not be significant harmful effects upon
environmental quality and natural resources because the building
envelope is located outside of the limits of the floodway and as
a result of previous development on the property.

That there are no other relevant negative impacts of the proposed
use that cannot be mitigated.
That the impacts, as described above, and the location of the
proposed use will not adversely affect the City of Poway General
Plan for future as well as present development because the use is
consistent with the designation, goals, objectives and .policies
of the General Plan.
Section 2: Environmental Findings:
The County of San Diego found that this project will not have a
significant adverse impact on the environment and issued a Mitigated
Negative Declaration on June 15, 1978 with mitigation measures for
sewage and noise.
Section 3: City Council Decision:
The City Council hereby approves Zoning Administrative Permit 78-14M
subject to the following conditions:

The hours of operation shall be between 7:00 a.m. and 6:00 p.m.
Monday through Friday.
The number of children shall be limited to 50 at any one time,
and their ages shall be limited from two to nine years old.
Ail outdoor activities shall be located to the rear of the
existing dwelling.
The facility shall not be equipped with outside amplification
system except that necessary for safety purposes such as a fire
alarm system.
The landscaping shall be nurtured, encouraged and maintained
along the rear property line in such a manner as to provide a
vegetative screen between the subject property and properties
adjoining the rear yard. Shrubbery shall be used to the
satisfaction of the Director of Planning Services to provide the
vegetative screen.
The burglar alarm system shall be modified to the satisfaction of
the Director of Planning Services to reduce the volume of the
alarm operated by that system.

7. ~nis Conditional Use Permit shall expire on Auqust 23, 1987
unless extended by the City Council pursuant to a written request
from the applicant at least thirty (30) days prior to expiration.
APPROVED AND ADOPTED by the City Council of the City of Poway, State
of California, the 23rd day of Auqust, 1983.
