Res P-83-48RESOLUTION NO. P-83-48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA DENYING CONDITIONAL USE PERMIT CUP 83-02 ASSESSOR'S PARCEL NUMBER 275-400-11 WHEREAS, Conditional Use Permit, CUP 83-02 submitted by San Diego Preparatory School, Andrew Casey, applicant, requests to convert a portion of an existing single family dwelling unit into a private school for the property located on the northeast corner of Stone Canyon Road and Avenida Del Norte, in the R-R-C (Rural Residential) zone; and, WHEREAS, on October 11, 1983, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: 5e That the location, size, design, and operating characteristics of the proposed use will not be compatible with and will adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, because the use is opposed by surrounding property owners on the basis of increased noise, traffic, and deed restrictions which preclude uses other than single family residential. That the harmony in scale, bulk, coverage and density is consistent with adjacent uses. That there are available public facilities, services and utilities. That there will be a harmful effect upon desirable neighborhood char- acteristics in that surrounding property owners oppose the use because it is not consistent with existing deed restrictions for that subdivi- sion and may result in unacceptable noise and traffic increases. That the generation of traffic will not adversely impact the surrounding street capacity and/or the City's Circulation Element. That the site is not suitable for the type and intensity of use or development which is proposed, because of the inconsistency with the objectives of the residential zone. That there will not be significant harmful effects upon environmental quality and natural resources. Resolution No. P-83-48 Page 2 8. That there are no other relevant negative impacts of the proposed use that cannot be mitigated. 9e That the impacts, as described above, and the location of the proposed use will not adversely affect the City of Poway General Plan for future as well as present development. SECTION 2: Environmental Findings: The City Council finds that this project is categorically exempt from environmental review as stipulated in the California Environmental Quality Act. Section 3: City Council Decision: The City Council hereby denies Conditional Use Permit CUP 83-02.
