Res P-84-12RESOLUTION NO. P-84-12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW 83-15 ASSESSOR'S PARCEL NUMBER 317-151-60 WHEREAS, Development Review 83-15, submitted by, San Diego volvo, Inc. applicant, requests approval of an automobile dealership for property located at 12255 Poway Road, in the CG (Commercial General) zone; and, WHEREAS, on January 24, 1984, the City Council held a hearing on the above referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: 1. That the proposed development is in conformance with the Poway General Plan and its Community Design Element. 2e 3® 4® That the proposed development will not have an adverse aesthetic, health, safety or architecturally related impact upon adjoining properties. That the proposed development is in compliance with the Zoning Development Code. That the proposed development encourages the orderly and harmonious appearance of structures and property within the City by complying with criteria of the Community Design Element. Section 2: Environmental Findings: A categorical exemption has been issued pursuant to the California Environmental Quality Act and the City of Poway Procedures to Implement the California Environmental Quality Act. Section 3: City Council Decision: The City Council hereby approves Development Review 83-15 subject to the following conditions: The color and patterns of wood used by the Oak Knoll Plaza Center (darker wood with a board and batten pattern) shall be used for the new high parapet and roof trim. 2. Heavy wooden timbers (railroad ties) rather than steel shall be installed as posts to define the property frontage. Resolution No. P- Page 2 7e 10. 12. 13. A combination of heavy wooden timbers and concrete curbing shall be installed to separate landscaping and parking areas. The freestanding sign shall be no higher than ten (10) feet and shall include wood as an exterior material and its copy background shall match one of the exterior colors used on the building or other signs. utility boxes located near the easterly driveway and in the northeast corner of the site shall be screened by landscaping or wooden screening structures. London Plane (Sycamore) trees shall be used as the street tree for the project. A minimum of four (4) trees shall be installed using tree wells cut into the sidewalk and covered with a half circle iron grating. The flag pole shall be a maximum height of thirty-five (35) feet. Ail customer parking shall be labeled and the first proposed parking space at the easterly entrance shall be eliminated. Five-gallon poplars shall be installed 10 feet on center along the easterly fence enclosing the service area/employee parking area except where gated access to the creek is required by the City Engineer. A wooden gate shall be installed on the west side of the building as a replacement for the chainlink gate and shall be relocated nearer the front line of the building. Use of the site for automobile sales may begin prior to the completion of all required improvements and payment of all required fees, but all remaining improvements and fees must be guaranteed to be installed and paid within six (6) months of the date of project approval by the execution of the performance agreement, secured by a bond, letter of credit, or other security, acceptable to the City and approved by the City Attorney. The first parking space at the easterly entrance should be removed as a customer space to avoid a potential conflict with incoming traffic. That space may be used for the elevated display of automobiles for sale to the satisfaction of the Director of Planning Services. The exterior stucco shall be a darker beige coloring than originally proposed by the applicant. The color selected shall be to the satisfaction of the Director of Planning Services.
