P 84-20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TENTATIVE PARCEL MAP 16711 TIME EXTENSION ASSESSOR'S PARCEL NUMBER 317-153-17 WHEREAS, Tentative Parcel Map No. 16711 Time Extension, hereinafter "Map", submitted by the Pomerado Group, Limited, applicant, for the purpose of subdividing the real property situated in the City of Poway, County of San Diego, State of California, described as Lot 2 of Poway Shopping Plaza, Unit 2, Map 8564 into four (4) lots, regularly came before the City Council for public hearing and action on March 27, 1984; and WHEREAS, the Director of Planning Services has recommended approval of the Map subject to all conditions set forth in the Planning Services Department report; and WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council of the City of Poway does resolve as follows: Section 1: Findings: The City Council makes the following findings in regard to Tentative Parcel No. 16711 and the Map thereof: a® The tentative tract is consistent with all applicable interim and proposed general and specific plans, because it allows commercial development in a General Commercial land use area. be The design or improvements of the tentative parcel is consistent with all applicable interim and proposed general and specific plans, because proposed improvement meets General Plan requirements for commercial development. Co The site is physically suitable for the type of development proposed, because it is adjacent to similar commercial development and conditions of traffic/circulation would be improved by conditions of approval. The design of the subdivision is not likely to cause substantial environmental damage and avoidable injury to humans and wild life or their habitat, because no significant environmental impacts are evident. Resolution No. P 84-20 TPM 16711 Time Extension Page 2 ee The tentative parcel is not likely to cause serious public health problems, because water and sewer service are available for the site. fe The design of the tentative parcel will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. ge That this project will not create adverse impacts on the environment and a Conditional Negative Declaration has been previously issued. Section 2: Tentative Parcel Map No. 16711 Time Extension, a copy of which is on file in the Planning Services office, is hereby approved subject to all of the following conditions: a. Ultimate Road Widths Prior to preparation of the Parcel Map, the engineer or surveyor prepaying the Map shall contact the Department of Public Services to determine the desired location of the centerline for Poway Road which is shown on the Circulation Element of the City General Plan as a major highway. The following shall be shown on the Parcel Map: 1. The location of the centerline of the road as approved by the Director of Public Services. 20 The width of the right-of-way which is 51 feet from the centerline and identified by a line drawn at the appropriate location and labeled "Limit of Proposed Street widening." 3® A building line which is 51 feet from the centerline of the road identified by a line drawn at the appropriate location and labeled "Building Line." 4e A realignment of Oak Knoll Road on the north side of Poway Road to the satisfaction of the Director of Public Services shall be shown on the Parcel Map and an irrevocable offer of dedication for the realignment shall be provided. Road Dedications and Access 3e Grant an easement to the City for the right-of-way required to complete a 51-foot wide, one-half right-of-way plus slope rights and drainage easements for Poway Road. Access shall be allowed by a single driveway along the western boundary of the land division when improvements to Oak Knoll Road along that boundary are installed. An access agreement to be exercised at the option of the City shall be provided by the applicant allowing access across the common property line with the Von's/Sav-On center. Said agreement shall be in a form acceptable to the City Attorney. Bridge and Major Thoroughfare Construction Fund Prior to recordation of the parcel Map, the developer shall place a $65,296 deposit in the Bridge and Major Thoroughfare Construction Fund for Area No. 5 to mitigate this development's traffic impact on existing and future circulation element roads in the Poway Community Plan area. d. Community Services Trust Fund The developer shall deposit in the Community Services Trust Fund an amount of $3,700 as the developer's fair share of the cost of traffic signals at the intersection of Poway Road and Oak Knoll Road. e. Road Improvements (Public) Poway Road shall be graded to one-half width of 51 feet. The median shall be removed and reconstructed between the most easterly termination and the westerly edge of the easterly driveway. Reconstruction of the median shall include a cash deposit for median landscaping improvements in accordance with Resolution No. P 84-20 TPM 16711 Time Extension Page 4 City-approved design to the satisfaction of the Directors of Planning Services and Public Services. Fees associated with the median reconstruction shall be paid within thirty (30) days from the approval date of the time extension. Removal of the median shall occur so as not to allow egressing traffic from the easterly driveway to make left turns onto Poway Road, a "Right Turn 0nly" sign shall be installed, and any of the existing palm trees which must be removed shall be relocated to the satisfaction of the Director of Planning Services and Public Services. The applicant shall provide a cash deposit of $1600 to insure reconstruction of the removed portion of the median when improvements to Oak Knoll Road permit access along the shopping center's westerly boundary approximately one hundred (100) feet. f. Sewerage/Water Certification by the Public Health Department with respect to water supply and sewage disposal shall be shown on the Parcel Map. g. Fire Protection Five (5) fire hydrants together with an adequate water supply shall be provided in accordance with the specifications of the City of Poway as follows: 1. North side of Poway Road, 375 feet west of southeast corner of Parcel No. 4. 2. North side of Poway Road, 205 feet east of southwest corner of Parcel No. 2. 3. Northwest corner of Parcel No. 1. 4. North line of Parcel No. 1, 340 feet east of the northwest corner. 5. Northeast corner of Parcel No. 1. If compliance with this condition is to be guaranteed by a secured agreement, improvement plans shall be prepared by a registered civil engineer and submitted to the Director of Public Services prior to execution of said agreement. Solar Access The following note shall appear on the Parcel Map: "This is a solar subdivision as required by Section 81.401(n) of the Subdivision Ordinance. All lots have at least 100 square feet of unobstructed access to sunlight on the buildable portion of the lot." i. Other Requirements Prior to the approval of the Parcel Map by the Department of Public Services, the subdivider shall provide the Department of Public Services with a copy of the deed by which the subject property was acquired. 2e At the time of recordation of the Parcel Map, the name of the person authorizing the map and whose name appears in the SURVEYOR'S CERTIFICATE as the person who requested the Map, shall be the name of the owner of the subject property and shall be the same party or parties as shown on the Tentative Parcel Map unless the Director of Planning Services has approved the substitution of a successor in interest to such party or parties. The Director of Planning Services has determined that, for reasons of public safety and as necessary prerequisite to the orderly development of the surrounding area, Conditions "e" and "g" should be complied with prior to approval of the Parcel Map or within a reasonable time following such approval. If any of these conditions are to be met following approval, a secured agreement must be executed with the City of Poway prior to the recordation of a Parcel Map. Such agreement requires posting security in the form of bond, a cash deposit, or instrument of credit, or irrevocable letter of credit valued at or more than the estimated improvement cost. It also requires the improvements be completed within twenty-four (24) months from the date of recording the Parcel Map, and prior to the issuance of a permit or other grant of approval for the development of a parcel created by this Map, except building and associated permits can be issued requiring the completion of public improvements prior to occupancy of the building. This time extension shall expire on March 8, 1985. APPROVED and ADOPTED by the City Council of the City of Poway, State of California, this 27th day of March, 1984. Linda L.
