A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING CONDITIONAL USE PERMIT 84-08
ASSESSOR'S PARCEL NUMBER 317-540-63
WHEREAS, Conditional Use Permit, submitted by Carmine Randazzo
applicant, requests the approval of a conditional use permit for a
restaurant including alcoholic beverages and entertainment located at
12511 Poway Road, in the CG (Commercial General) zone; and,
WHEREAS, on June 12, 1984, the City Council held a duly advertised
public hearing to solicit comments from the public, both pro and con,
relative to this application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: Findings:
That the location, size, design, and operating
characteristics of the proposed use will be compatible with
and will not adversely affect or be materially detrimental to
adjacent uses, residents, buildings, structures, or natural
resources;

That the harmony in scale, bulk, coverage and density is
consistent with adjacent uses;

That there are available public facilities, services and
utilities;

That there will not be a harmful effect upon desirable
neighborhood characteristics;

That the generation of traffic will not adversely impact the
surrounding streets and/or the City's Circulation Element;
That the site is suitable for the type and intensity of use
or development which is proposed;

That there will not be significant harmful effects upon
environmental quality and natural resources;
That there are no other relevant negative impacts of the
proposed use that cannot be mitigated; and

That the impacts, as described above, and the location of the
proposed use will not adversely affect the City of Poway
General Plan for future as well as present development.

Section 2: Environmental Findings:
This project is categorically exempt from the CEQA (Class 1:
Existing Facilities) as specified in the City of Poway procedures
to implement CEQA and an exemption has been issued.
Section 3: City Council Decision:
The City Council hereby approves Conditional Use Permit 84-08
subject to the following conditions:
Ail necessary fire protection devices shall be installed to
the satisfaction of the Fire Marshall prior to occupancy.
2. Ail signs shall comply with the City's Sign Ordinance.

Ail roof aparatus, including dish antennas shall be
adequately screened to the satisfaction of the Director of
Planning Services.

The doors should remaind closed during the hours the band is
playing.

The hours of operation will be from 9 am to 2 am daily with
any variation to be subject to the approval of the Director
of Planning Services.
6. An entertainment permit must be obtained prior to occupancy.
APPROVED and ADOPTED by the City Council of the City of Poway,
State of California, this 12th day of June, 1984.
