A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TENTATIVE PARCEL MAP 17075 TIME EXTENSION
ASSESSOR'S PARCEL NUMBER 321-271-18
WHEREAS, Tentative Parcel Map No. 17075 Time Extension, hereinafter
"Map" submitted by Jordana Bauman, applicant, for the purpose of
subdividing the real property situated in the City of Poway, County of
San Diego, State of California, described as 1.95 acres of land located
330 feet south of Stone Canyon Road on the east side of Pomerado Road
into two (2) lots, regularly came before the City Council for public
hearing and action on July 24, 1984; and
WHEREAS, the Director of Planning Services has recommended APPROVAL
of the Map subject to all conditions set forth in the Planning Services
Department report; and
WHEREAS, the City Council has read and considered said report and
has considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council of the City of Poway does resolve
as follows:
Section 1: Findings:
The City Council makes the following findings in regard to Tentative
Parcel No. 17075 Time Extension and the Map thereof:

The tentative parcel is consistent with all applicable
interim and proposed general and specific plans;

The design or improvement of the tentative parcel is
consistent with all applicable interim and proposed
general and specific plans;

The site is physically suitable for the type of
development proposed;
The site is physically suitable for the density of the
development proposed.

The design of the subdivision is not likely to cause
substantial environmental damage and avoidable injury to
humans and wildlife or their habitat;

The tentative parcel is not likely to cause serious public
health problems;

The design of the tentative parcel will not conflict with
any easement acquired by the public at large, now of
record, for access through or use of the property within
the proposed subdivision.

That this project will not create adverse impacts on the
environment and a Mitigated Negative Declaration has been
issued.
The effect of subdivision approval on the housing needs of
the San Diego region has been considered and balanced
against the public service needs of Poway residents and
available fiscal and environmental resources.
The design of the subdivision has provided, to the extent
feasible, for future passive or natural heating or cooling
opportunities in the subdivision.
Section 2:
Tentative Parcel Map No. 17075, a copy of which is on file in
the Planning Services office, is hereby approved subject to all
of the following conditions:
A. ACCESS ROADS
The developer shall relinquish vehicular access rights to
Pomerado Road.
B. ULTIMATE ROAD WIDTHS
Prior to preparation of the Parcel Map, the engineer or
surveyor preparing the map shall contact the Department of
Public Services to determine the desired location of the
centerline for Pomerado Road (SA-760) which is shown on
the Circulation Element of the General Plan as a Major
Highway. The following shall be shown on the Parcel Map:
The location of the centerline of the road as
approved by the Director of Public Services.

The width of the right-of-way which is 51 feet from
the centerline and identified by a line drawn at the
appropriate location and labeled "Limit of Proposed
Street Widening"

A building line which is 71 feet from the centerline
of the road identified by a line drawn at the
appropriate location and labeled "Building Line".
ROAD DEDICATIONS
Grant an irrevocable offer of dedication to the City for
the right-of-way required to complete a 40-foot wide,
right-of-way width plus the right to construct and
maintain slopes and drainage improvements as required
beyond the 40-foot limit from the land division to Country
Squire Drive, including a 20-foot radius property line
corner roundings at street intersections.
BRIDGE AND MAJOR THOROUGHFARE CONSTRUCTION FUND
Prior to recordation of the Parcel Map, the developer
shall place a $1,374.00 deposit with the City of Poway to
mitigate this development's traffic impact on existing
and future Circulation Element roads.
ROAD IMPROVEMENTS (Private)
The Private Easement to Country Squire Drive shall be
improved to a graded width of 40 feet with AC paving over
approved base and PCC curbing on both sides. Minimum
clear width between curbs shall be 32 feet with a 30 foot
radius off-set cul-de-sac, and an Irrevocable Offer of
Dedication of Planning and Public Services.
Improvement plans shall be prepared by a registered civil
engineer and submitted to the Director of Public
Services. The following items shall also apply:
Street alignment and grade, including the change of
any existing or proposed street alignment and grade,
as required by the Director of Public Services.
Improve all drainage easements by culvert or
drainage channel of adequate size, whichever is
required by the Director of Public Services. Any
required drainage channel shall be lined with a
suitable material as specified by the Director of
Public Services. All such drainage easements shall
be monumented along property lines at locations
approved by the Director of Public Services.

The installation of all underground utilities shall
be completed before surfacing the streets and
installing concrete curbs, gutters, and sidewalks.
This is not intended to include the undergrounding
of existing overhead utilities.
The installation of all street name signs.
A street safety lighting system conforming to City
of Poway Standards, to be installed at no cost to
the public. There shall be deposited with the City,
through the Director of Public Services, a cash
deposit sufficient to:

Energize, maintain, and operate the street
lighting system until revenues begin to accrue
from the land division for those purposes.

Augment the Reserve Fund of the existing
District by an amount equal to three months'
operating cost of the subdivision.
c. Augment the Contingency Fund by one month's
operating costs.
Pay the cost of annexation including the cost of
processing through the State Board of
Equalization. The land division shall be
annexed, without notice or hearing, to an
existing special district to operate and
maintain the system.
Sight distance requirements at all intersections
shall conform to the intersectional sight distance
criteria as provided by the American Association of
State Highway Officials in the publication "Geometric
Design for Local Roads and Streets - 1971" or as
revised.
That the plans and specifications for the improvement
of all streets rights-of-way, drainage easements and
all culverts, drainage structures and drainage
channels and all private easements meet with the
approval of the Director of Public Services.

FLOODING/DRAINAGE
Grant a drainage easement to the City of Poway
encompassing all public drainage improvements. Grant
an access easement to each drainage system
maintenance access point not directly accessible from
a public roadway.

Drainage improvements built to City of Poway
Standards shall be constructed to carry the peak
runoff from a 100-year flood on the watercourse which
flows through the property. Improvement plans shall
be prepared by a Registered Civil Engineer and
approved by the Department of Public Services. If
the outlet velocity of storm waters from the drainage
improvements is greater than the velocity of storm
waters under natural conditions, a velocity
dissipator shall be required at the outlet. If in
any drainage system the maintenance access point is
not directly accessible from a public roadway, the
access easement shall be improved, fenced and aligned
to the satisfaction of the Department of Public
Services.
SEWERAGE/WATER
Certification by the Public Health Department with
respect to water supply and sewage disposal shall be
shown on the Parcel Map.

The developer shall install a minimum water supply
pipe to serve this minor subdivision in accordance
with the standards of the City of Poway Public
Services Department in the public right-of-way.
If compliance with this condition is to be guaranteed by a
secured agreement, improvement plans shall be prepared by
a registered civil engineer and submitted to the Director
of Public Services prior to execution of said agreement.
FIRE PROTECTION
Fire hydrants together with an adequate water supply shall
be provided in accordance with the specifications of the
City of Poway Public Services Department.
Compliance with this condition may be guaranteed by an
agreement with a registered civil engineer and submitted
to the Directors of Safety and Public Services prior to
execution of said condition.

SOLAR ACCESS
The following note shall appear on the Parcel Map:
Ail parcels within this subdivision have a minimum of 100
square feet of solar access for each parcel and for each
future building site within this subdivision as required
by Section 81.401(n) of the Subdivision Ordinance.
OTHER REQUIREMENTS
Zoning regulations require that each parcel shall
contain a minimum net area of 10,000 square feet.
If, as a result of survey calculations, required
easements or any other reason, the area of any parcel
shown on this Tentative Parcel Map is determined by
the Department of Public Services to be below the
zoning minimum, it becomes the responsibility of the
subdivider to meet zoning requirements by lot
redesign, or other applicable technique. The
subdivider must comply with the zoning area
requirements in full before the Department of Public
Services may file a Parcel Map with the County
Recorder.

Prior to the approval of the Parcel Map by the
Department of Public Services the subdivider shall
provide the Department of Public Services with a copy
of the deed by which the subject property was
acquired.

At the time of recordation of the Parcel Map, the
name of the person authorizing the map and whose name
appears in the SURVEYOR'S CERTIFICATE as the person
who requested the map, shall be the name of the owner
of the subject property and shall be the same party
or parties as shown on the Tentative Parcel Map
unless the Director of Planning Services has approved
the substitution of a successor in interest to such
party or parties.
Prior to the issuance of a building permit for a new
residential dwelling unit(s), the applicant shall pay
development fees at the established rate. Such fees
may include, but not be limited to: Park Fee,
Drainage Fee, Permit and Plan Checking Fees, School
Fee, Water and Sewer Service Fees.

The Poway City Council has determined that, for
reasons of public safety and as a necessary
prerequisite to the orderly development of the
surrounding area, Conditions E, F-2, G-2 and H should
be complied with prior to recordation of the Parcel
Map or within a reasonable time following such
approval. If any of these conditions are to be met
following approval, a secured agreement must be
executed with the City of Poway prior to the
recordation of a Parcel Map. Such agreement requires
posting security in the form of a cash deposit, or
instrument of credit, or irrevocable letter of credit
valued at or more than estimated improvement cost.
It also requires the improvements be completed within
24 months from the date of recording the Parcel Map,
and prior to the issuance of a permit or other grant
of approval for the development of a parcel created
by this map, except building and associated permits
can be issued requiring the completion of public
improvements prior to occupancy of the building.

The tentative map time extension approval shall
expire on July 24, 1985, unless an application for
time extension is received 30 days prior to
expiration in accordance with the City's Subdivision
Ordinance.
NOISE
Prior to recordation of the Parcel Map the applicant
shall:
Grant an Open Space Easement to the City of Poway on
the portion of proposed Parcel 2 subject to noise
impact, to designate that there are unacceptable
acoustical conditions for residential development
within that area on the property when the applicant
submits a site plan or grading plan.

This Open Space Easement allows residential or
recreational (pools, patios, etc.) uses within its
boundaries when the applicant submits a site plan or
grading plan with acceptable noise mitigation
measures to the satisfaction of the Director of
Planning Services.

Section 3:
Tentative Parcel Map No. 17075 Time Extension, a copy of which
is on file in the Planning Services office, is hereby approved
subject to the following Standard Conditions:
APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING AND BUILDING
SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS:
SITE DEVELOPMENT
For a new residential dwelling unit(s), the applicant shall pay
development fees at the established rate. Such fees may include,
but not be limited to: Permit and Plan Checking Fees, School Fees
(in accordance with City-adopted policy and/or ordinance), Water and
Sewer Service Fees. These fees shall be paid prior to building
permit issuance.

RECREATION
The developer shall improve the equestrian/pedestrian trail system
in accordance with the adopted sign standards and to the
satisfaction of the Directors of Public and Planning Services prior
to building permit issuance.
Parkland Dedication or payment of Park Fees at the established rate
shall be made prior to building permit issuance.
EXISTING STRUCTURES No Conditions
ADDITIONAL APPROVALS REOUIRED No Conditions
APPLICANT SHALL CONTACT THE PUBLIC SERVICES DEPARTMENT REGARDING
COMPLIANCE WITH THE FOLLOWING CONDITIONS:
GRADING
Grading of the subject property shall be in accordance with the
Uniform Building Code, City Grading Ordinance, approved grading plan
and geotechnical report, and accepted grading practices.
A soils report shall be prepared by a qualified engineer licensed by
the State of California to perform such work prior to building
permit issuance.

STREETS AND SIDEWALKS
Vehicular access rights to Circulation Element roads shall be
dedicated to the City of Poway and labeled on the final map to the
satisfaction of the Director of Public Services or by separate
document.
Ail street structural sections shall be submitted to, and approved
by the Director of Public Services.
Street improvement plans prepared on standard size sheets by a
Registered Civil Engineer shall be submitted for approval by the
Director of Public Services. Plan check and inspection expenses
shall be paid by the developer.
Prior to any work being performed in the public right-of-way, an
encroachment permit shall be obtained from the Public Services
office and appropriate fees paid, in addition to any other permits
required.
The developer shall pay the Traffic Mitigation Fee at the
established rate prior to final map.
DRAINAGE AND FLOOD CONTROL
A drainage system capable of handling and disposing of all surface
water originating within the subdivision, and all surface waters
that may flow onto the subdivision from adjacent lands, shall be
required. Said drainage system shall include any easements and
structures as required by the Director of Public Services to
properly handle the drainage.
The Master Plan of Drainage Fee shall be paid at the established
rate in accordance with the Drainage Ordinance prior to building
permit issuance.
UTILITIES
Utility easements shall be provided to the specification of the
serving utility companies and the Director of Public Services.

GENERAL REOUIRENENTS AND APPROVALS
Prior to final map approval, all of the above improvements and
requirements shall be installed and provided, or deferred by
guaranteeing installati on within two years from map recordation or
prior to building permit issuance, whichever occurs first, by the
execution of a performance agreement, secured with sufficient
securities, in a form approved by the City Attorney. All necessary
processing fees, deposits, and charges shall be paid prior to final
map approval.
