A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING THE ELIMINATION OF NON-CONFORMING USE 84-01
ASSESSOR'S PARCEL NUMBER 321-190-31
WHEREAS, Elimination of Non-Conforming Use 84-01 initiated by the
City of Poway requests to eliminate an existing non-conforming use, came
before the City Council for public hearing and action at a regular
meeting on August 7, 1984; and
WHEREAS, the Director of Planning Services has recommended
APPROVAL of the elimination of the non-conforming use; and
WHEREAS, the City Council has read and considered said report and
has considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council of the City of Poway does resolve
as follows:
Section 1: Findings:
The City Council makes the following findings in regard to
Elimination of Non-Conforming Use 84-01:

The elimination of the non-conforming use is consistent
with the City of Poway General Plan and Zoning
Development Code;
The elimination of the non-conforming use followed the
procedures as established in the City of Poway Zoning
Development Code;
The elimination of the non-conforming commercial use to
a residential use is not likely to cause substantial
environmental damage and avoidable injury to humans and
wildlife or their habitat;
That the elimination of the non-conforming use will not
create adverse impacts on the environment and a Negative
Declaration is issued;

As of November 11, 1983 commercial use on the site
ceased to be operated and that cessation of use
continued uninterrupted through April 30, 1984 to
present; and
Ordinance 113, the City of Poway Zoning Development Code
Section 9.2 provides that whenever a non-conforming use
has been discontinued or changed to a conforming use for
a continuous period of one hundred eighty (180) calendar
days or more, the non-conforming use shall not be
reestablished; and

This non-conforming use has been abandoned for one hundred eighty (180)
days from November 11, 1983 to April 30, 1984.
APPROVED and ADOPTED by the City Council of the City of Poway, State
of California, this 7th day of August, 1984.
