Res P-84-69RESOLUTION NO. P-84-69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW 84-21 ASSESSOR'S PARCEL NUMBER 314-050-18 WHEREAS, Development Review 84-21, submitted by Standard Pacific of San Diego, applicant, requests approval for the construction of a swim and tennis club development located at 14291 Silverset Street, in the RR-C (Rural Residential) zone; and, WHEREAS, on November 13, 1984, the City Council held a hearing on the above-referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: That the proposed development is in conformance with the Poway General Plan. That the proposed development will not have an adverse aesthetic, health, safety or architecturally related impact upon adjoining properties· e That the proposed development is in compliance with the Zoning Ordinance. That the proposed development encourages the orderly and harmonious appearance of structures and property within the City. Section 2: Environmental Findings: The Environmental Impact Report certified on July 15, 1976, and revised on May 17, 1979, provided for the environmental impacts associated with the development. Section 3: City Council Decision: The City Council hereby approves Development Review 84-12 subject to the following conditions: A maximum 12 foot high fence (measured from the finished grade of the court) shall be allowed for all recreation courts. The chain link vinyl fence shall be covered with a wind screen and shall be approved by the Director of Planning Services prior to occupancy or use of the premise. e The surface area of any recreation court shall be designed, painted, colored, and/or textured to reduce the reflection from any light incident thereon. Resolution No. P-84-69 Page 2 A maximum of eight lights per court shall be permitted at a height not to exceed 18 feet. All lights and light fixtures shall be certified by a qualified lighting engineer to: Se be designed, constructed, mounted, and maintained such that, the light source is cut off when viewed from any point above five feet measure outside of the lot at the lot line; be designed, constructed, mounted, and maintained such that the maximum illumination intensity measured at the wall of any residential building on abutting property shall not exceed one-half foot candle above ambient levels; and c. be used between 7:00 a.m. and 10:00 p.m. Monday through Saturday and 7:00 a.m. and 10:00 p.m. on Sundays. The applicant shall install all landscaping as shown on the approved landscape plan including the irrigation sytem. No loudspeaker or sound amplification system shall be used to produce sounds in violation of the City's Noise Ordinance. Special events, tournament, or similar outdoor entertainment that are beyond the normal operation of a swim and tennis club shall require the approval of a Temporary Use Permit by the Director of Planning Services. The applicant shall equally treat all building elevations with similar window and decorative tile treatments subject to approval by the Director of Planning Services. Hours of operation shall be 7:00 a.m. to 10:00 p.m. seven days a week. 10. Letter of Approval No. 78 is to be paid up to 50 percent of the total amount and shall be paid within 30 days of approval of DR 84-21. 11. The emergency vehicle access shall be relocated per recommendation of the Director of Safety Services. 12. 13. 14. 15. Resolution No. P-84-69 Page 3 A revised site development plan shall be submitted to the Director of Planning Services which shows the location of the required handicapped parking spaces, bicycle parking facilities and trash receptacle area. The entrance to the tot lot shall be designed to prohibit direct access to the swimming pool and deck areas. Said location shall be approved by the Director of Planning Services. Handicapped access shall be provided to the swimming pool and all other facilities according to code. Access design shall be approved by the Director of Planning Services. The development of the site shall be in conformance with the conditions of DR 84-21 and all conditions of approval for Major Use Permit P 81-013. Section 4: City Council Decision: The City Council hereby approves Development Review 84-21 subject to the following Standard Conditions: APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING AND BUILDING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: A. SITE DEVELOPMEI~T 1. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. 2. Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Planning Services Department prior to issuance of building permits. 3. Approval of this request shall not waive compliance with all sections of the Zoning Development Code and all other applicable City Ordinances in effect at the time of building permit issuance. 4. Trash receptacle areas for commercial, manufacturing, and multifamily developments shall be enclosed by a 6 foot high masonry wall with view-obstructing gates pursuant to City standards. Location shall be subject to approval by the Planning Services Department. 5. All roof appurtenances, including air conditioners, shall be architecturally integrated, shielded from view and sound buffered from adjacent properties and streets as required by the Planning Services Department. PARKING AND VEHICULAR ACCESS Ail parking lot landscaping shall consist of a minimum of one fifteen (15) gallon size tree for every three (3) parking spaces. For parking lot islands, a minimum 12 inch wide walk adjacent to parking stalls shall be provided and be separated from vehicular areas by a 6 inch high, 6 inch wide portland concrete cement curbing. Parking lot lights shall be low pressure sodium and have a maximum height of eighteen (18) feet from the finished grade of the parking surface and be directed away from all property lines, adjacent streets and residences. Ail two-way traffic aisles shall be a minimum of 24 feet wide and emergency access shall be provided, maintained free and clear, a minimum of 24 feet wide at all times during construction in accordance with Safety Services Department requirements. Ail parking spaces shall be double striped. LANDSCAPING A detailed landscape and irrigation plan shall be submitted to and approved by the Public Services Department and Planning Services Department prior to the issuance of building permits. Ail landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. SIGNS No Conditions Any signs proposed for this development shall be designed and approve~ RECREATION The developer shall improve the equestrian/pedestrian trail system in accordance with the adopted sign standards and to the satisfaction of the Directors of Public and Planning Services prior to building permit issuance. Jw e APPLICANT SHALL CONTACT THE PUBLIC SERVICES DEPARMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: GRADING No Conditions STREETS AND SIDEWALKS Ail damaged off-site public works facilities, including parkway trees, shall be repaired or replaced prior to exoneration of bonds and improvements, to the satisfaction of the Department of Public Services. Prior to any work being performed in the public right-of-way, an encroachment permit shall be obtained from the Public Services office and appropriate fees paid, in addition to any other permits required. DRAINAGE AND FLOOD CONTROL No Conditions UTILITIES Ail proposed utilities within the project shall be installed underground including existing utilities along Circulation Element roads and/or highways less than 34.5 KV. Water, sewer, and fire protection systems plans shall be designed and constructed to meet requirements of the City of Poway and the Health Department of the County of San Diego. L.
