A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
DENYING TENTATIVE TRACT MAP 4180R TIME EXTENSION
ASSESSOR'S PARCEL NUMBER 317-090-39 and 40
WHEREAS, Tentative Tract Map No. 4180R/TE, hereinafter "Map"
submitted by Sierra Pacific Corporation, applicant, for the purpose
of subdividing the real property situated in the City of Poway,
County of San Diego, State of California, described as 11.9 acres
located at the northeast intersection of Poway Road and Carriage
Road; Lot 1 of Golden City Unit No. 1, Map 6877, together with
portion of Section 14, Township 14 South, Range 2 West, S.B.M. into
three lots, regularly came before the City Council for public
hearing and action on November 27, 1984 and December 4, 1984; and
WHEREAS, the Director of Planning Services has recommended
DENIAL of the Map subject to all conditions set forth in the
Planning Services Department report; and
WHEREAS, the City Council has read and considered said report
and has considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council of the City of Poway does
resolve as follows:
Section 1: Findings:
The City Council makes the following findings in regard to
Tentative Tract No. 4180R and the Map thereof:

The tentative tract is not consistent with all
applicable interim and proposed general and specific
plans; in that Policy 15.a of the Comprehensive Plan
limits intensive development, such as condominium
developments, to properties with slopes of less than
25 percent. Approximately 38 percent of the site is
buildable, this flat area cannot meet the performance
standards for 71 units.

The design or improvement of the tentative tract is
not consistent with all applicable interim and
proposed general and specific plans.

The site is not physically suitable for the type of
development proposed; in that the topographical
constraints of the site limit the amount of usable
building and usable active recreation areas. The
proposed site plan (Plot Plan P 79-170) does not
provide active recreation facilities such as
landscaped park-like quite areas; children's play
area; family picnic area; and swimming pool with
cabana or patio cover as required by the Zoning
Development Code.

The site is not physically suitable for the density of
the development proposed; in that the project's
proposed flat buildable area of approximately 4.5 net
acres cannot provide the required parking area
storage area, private open space and recreation
facilities as required by the Zoning Development Code
for the development of the proposed 71 units.
The design of the subdivision is not likely to cause
substantial environmental damage and avoidable injury
to humans and wildlife or their habitat.

The tentative tract is not likely to cause serious
public health problems.
The design of the tentative tract will not conflict
with any easement acquired by the public at large, now
of record, for access through or use of the property
within the proposed subdivision.
That this project will not create adverse impacts on
the environment and a Negative Declaration is issued.
The effect of subdivision denial on the housing needs
of the San Diego region has been considered and
balanced against the public service needs of Poway
residents and available fiscal and environmental
resources.
Section 2:
Tentative Tract Map No. 4180, a copy of which is on
file in the Planning Services office, is hereby
denied.
APPROVED and ADOPTED by the City Council of the City of Poway,
State of California, this 4th day of December, 1984.
