Res P-85-01RESOLUTION NO. P-85-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA DENYING TENTATIVE PARCEL MAP 82-10 ASSESSOR'S PARCEL NUMBER 321-271-15 WHEREAS, Tentative Parcel Map No. 82-10, hereinafter "Map" submitted by Poway Mountain Group, applicant, for the purpose of subdividing 41.2 acres of real property situated in the City of Poway, County of San Diego, State of California, described as the south half of the northwest quarter of Section 8, T14S, R1W, SBM, lying northerly of the centerline of R.S. 472 and R.S. 1713 on file in the office of the County Engineer into two (2) lots, regularly came before the City Council for public hearing and action on January 8, 1985 ; and WHEREAS, the Director of Planning Services has recommended APPROVAL of the Map subject to all conditions set forth in the Planning Services Department report; and WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council of the City of Poway does resolve as follows: Section 1: Findings: The City Council makes the following findings in regard to Tentative Parcel No. 82-10 and the Map thereof: Se 0 Cm The tentative parcel is consistent with all applicable and proposed general and specific plans in effect at the time the application was filed. The design or improvement of the tentative parcel is consistent with all applicable and proposed general and specific plans in effect at the time the application was filed. The site is not physically suitable for the type of development proposed because access to the property is not possible unless the north facing slope of the property is scarred in an unacceptable manner by the grading of a road which will require the extensive use of retaining walls, cut slopes up to 40 feet in height, or combinations of slopes and retaining walls. The site is not physically suitable for the density of the development proposed, because in order to provide access to both proposed parcels the north facing slope of the property must be scarred in an unacceptable manner because access to the property is not possible unless the north facing slope of the property is scarred in an unacceptable manner by the grading of a road which will require the extensive use of retaining walls, cut slopes up to 40 feet in height, or combinations of slopes and retaining walls. e. The design of the subdivision is likely to cause substantial environmental damage as a result of the grading for access as described above, but is not likely to cause avoidable injury to humans and wildlife or their habitat, because the density is very low and most of the lots will remain as open space. f. The tentative parcel is not likely to cause serious public health problems, because City Water and County approved septic systems will be provided. g. The design of the tentative parcel will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. h. That this project will create adverse impacts on the environment because the property's north facing slope will be scarred for a distance of over 1800 by grading for the access road. This grading would result in the extensive use of retaining walls, cut slopes up to 40 feet in height, or a combination of walls and slopes. i. The effect of subdivision approval on the housing needs of the San Diego region has been considered and balanced against the public service needs of Poway residents and available fiscal and environmental resources. j. The design of the subdivision has provided, to the extent feasible, for future passive or natural heating or cooling opportunities in the subdivision. Section 2: Tentative Parcel Map No. 82-10, a copy of which is on file in the Planning Services office, is hereby denied.
