A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
REVIEWING CONDITIONAL USE PERMIT 81-01
ASSESSOR'S PARCEL NUMBER 277-07-14
WHEREAS, the review of Conditional Use Permit, CUP 81-01,
submitted by Signal Master, Inc., applicant, a review of the
Conditional Use Permit to allow the installation of a five (5) meter
dish type antenna and an accessory building for the property located
at the Boca Raton Reservoir site, in the RR-A (limited agriculture)
zone; and
WHEREAS, on April 2, 1985, the City Council held a duly
advertised public hearing to solicit comments from the public, both
pro and con, relative to this application;
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: Findings:
That the location, size, design, and operating
characteristics of the proposed use will be compatible with
and will not adversely affect or be materially detrimental
to adjacent uses, residents, buildings, structures, or
natural resources, with consideration given to:
a. Harmony in scale, bulk, coverage, and density;
b. The availabilty of public facilities, services, and
utilities;
c. The harmful effect, if any, upon desirable neighborhood
character;
d. The generation of traffic and the capacity and physical
character of surrounding streets;
e. The suitability of the site for the type and intensity
of use or development which is proposed;
f. The harmful effect, if any, upon environmental quality
and natural resources; and to
g. Any other relevant impact of the proposed use.

That the impacts as described in paragraph "1" of this
section, and the location of the proposed use will not
adversely affect the Powa¥ General Plan.
Section 2: Environmental Findings:
The City Council has found that this project will not have a
significant adverse impact on the environment and has previously
issued a Negative Declaration.

Section 3: City Council Decision:
The City Council hereby APPROVES Conditional Use Permit, CUP 81-01
for a period of 120 days subject to the following conditions:
1. Approval of application CUP 81-01 is subject to the continued
consent of the City of Poway and the Federal Communication
Commission (FCC) for Signal Master to operate a cable TV
system in Poway.
2. Upon successful completion of the required conditions, the
approval of application CUP 81-01 shall be valid through
August 11, 1988, which is the expiration date of the Signal
Master License Agreement.
3. The applicant shall obtain building permits for existing
structures prior to any work on the site (double fees shall
be assesed). Prior to the erection of additional equipment
or improvements, the applicant shall obtain a Minor
Development Review approval and shall obtain appropriate
excavation and construction permits from the City.
4. The applicant shall provide a plan and install cable service
to the Fire Station 92 within 120 days from the date of this
hearing subject to the approval of the Directors of Community
Services, Planning Services, and Public Services. This
condition will remain in effect unless cable service is
provided to these areas by an outside company or agency.
5. The applicant shall secure an updated lease contract with the
City for the use of the Boca Raton Reservoir site within 30
days.
6. The applicant shall submit to the City all past and present
records of complaint within 30 days.
7. A revised landscaping plan with an automatic watering system
shall be submitted to the City for approval. Upon City
approval, the landscaping and irrigation shall be installed
within 30 days or face the possible revocation of the
Conditional Use Permit.

The five (5) meter satellite dish antenna shall be painted
within 30 days from the date of this hearing. The paint
shall be of color that blends with the surrounding area and
be subject to the satisfaction of the Director of Planning
Services.
Unused equipment shall be removed from the site.
APPROVED and ADOPTED by the City Council of the City of Poway,
California this 2nd day of April, 1985.
