Res P-85-30RESOLUTION NO. P-85-30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING CONDITIONAL USE PERMIT 85-06 AND MINOR DEVELOPMENT REVIEW 85-26 ASSESSOR'S PARCEL NUMBER 275-461-04 WHEREAS, Conditional Use Permit 85-06 and Minor Development Review 85-26 submitted by Palomar Pomerado Hospital District applicant, requests approval for a temporary trailer for classroom purpose within the Pomerado Hospital site in the OS (Open Space) zone located at 15615 Pomerado Road. WHEREAS, on June 4, 1985, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: CONDITIONAL USE PERMIT 85-06 o That the location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources; 2. That the harmony in scale, bulk, coveraqe and density is consistent with adjacent uses; ~ 3. That there are available public facilities, services and utilities; 4. That there will not be a harmful effect upon desirable neighborhood characteristics; 5. That the generation of traffic will not adversely impact the surroundinq streets and/or the City's Circulation Element; 6. That the site is suitable for the type and intensity of use or development which is proposed; 7. That there will not be significant harmful effects upon environmental quality and natural resources; 8. That there are no other relevant negative impacts of the proposed use that cannot be mitigated; and 9. That the impacts, as described above, and the location of. the proposed use will not adversely affect the City of Poway General Plan for future as well as present development~~ Resolution No. P85-30 Page 2 MINOR DEVELOPMENT REVIEW 85-26 1. That the proposed development is in conformance with the Poway General Plan. e That the proposed development will not have an adverse aesthetic, health, safety, or architecturally related impact upon adjoining properties. 3. That the proposed development is in compliance with the Zoning ordinance. That the proposed development encourages the orderly and harmonious appearance of structures and property within the City. Section 2: Environmental Findings: A Categorical Exemption, Cass 1, has been issued under the provisions of the California Environmental Act. Section 3: City Council Decision: The City Council hereby approves Conditional Use Permit 85-06 and Minor Development Review 85-26 subject to the following conditions: A bond, letter of credit or cash deposit for $1,000 shall be required to ensure the removal of the trailer prior to building permit issuance for future permanent structure construction on the hospital site. 2. The conditional use permit for the mobile classroom shall expire on June 4, 1987. 3. During construction installation of temporary trailer the contractor shall be required to provide traffic control for all vehicles involved in any phase of the construction project. The contractor shall clean up any debris, dirt, rocks, etc. generated by the construction, ie: spilling loads, mud on city/private streets. The hours of construction shall be 7:00 am - 7:00 pm Monday through Saturday. 4. Annual review of CUP 85-06 is required to monitor compliance with the conditions of approval within said resolution. 5. A building permit is required for construction and siting of the temporary trailer. Resolution No. P-85-30 Page 3 The applicant shall submit and have an approved landscape plan illustrating a proposed landscaping around the base of the trailer to the satisfaction of the Director of Planning Services prior to building permit issuance. Section 4: City Council Decision: The City Council hereby approves Conditional Use Permit 85-06 and Minor Development Review 85-26 subject to the following Standard Conditions: APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING AND BUILDING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: A. SITE DEVELOPMENT 1. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. t 3e e e e Approval of this request shall not waive compliance with all sections of the Zoning Development Code and all other applicable City Ordinances in effect at the time of building permit issuance. Prior to any use of the project site or business activity being commenced thereon, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning Services. The applicant shall comply with the latest adopted uniform Building Code, uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit issuance. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. PAIr,lING AND VEHICULAR ACCESS No Conditions LANDSCAPING A detailed landscape and irrigation plan shall be submitted to and approved by the Public Services Department and Planning Services Department prior to the issuance of building permits. Ail landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. Resolution No. P-85-30 Page 4 D. SIGNS 1. Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance. E. RECREATION No Conditions F. EXISTING STRUCTURES 1. Provide compliance with the Uniform Building Code for property line clearances considering use, area and fire-resistiveness of existing buildings. G. ADDITIONAL APPROVALS REOUIRED 1. This Conditional Use Permit is granted for a period of 24 month(s) at the end of which time the City Council may add or delete conditions, or revoke the Conditional Use Permit. II.
