P 85-44 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING THE SOUTH POWAY PLANNED COMMUNITY (PC 84-01) WHEREAS, the City Council has held various workshops and public hearings on the South Poway Planned Community beginning with the consideration of the Poway Comprehnsive Plan in June, 1983 and culminating on July 30, 1985; and WHEREAS, the City Council has reviewed and considered the proposed Development Plan and the proposed Development Standards (Volumes 1 and 2) for the South Poway Planned Community and considered other evidence presented at the public hearing; and WHEREAS, the City Council has reviewed and considered the Final Environmental Impact Report and its Appendices (Volumes 3 and 4) for the South Poway Planned Community; and WHEREAS, the mitigation measures recommended by the Final Environmental Impact Report are included in the resolution certifying that document and providing the Findings and a Statement of Overriding Considerations; and WHEREAS, the Director of Planning Services has recommended approval of the South Poway Planned Community subject to the conditions set forth in the Planning Services Department report; and WHEREAS, a duly advertised public hearing was held on July 30, 1985 regarding the South Poway Planned Community and its associated documents; NOW, THEREFORE, the City Council of the City of Poway does resolve as follows: Section 1: Findings: The City Council makes the following findings in regard to Planned Community 84-01 and the Development Plan and Standards thereof, which are supported by evidence contained in Volumes 1, 2, 3, and 4 of the South Poway Planned Community and elsewhere in the project records: ae The Plan promotes and protects the public, health, safety, and welfare by providing an orderly system of development which provides all essential residential, commercial, and industrial services; b. The Plan implements the objectives and policies of the General Plan pertaining to the South Poway area; Resolution No. P 85-44 Page 2 c. The Plan safeguards and enhances environmental amenities and the quality of development by providing substantial open space and high standards of development; d. The Plan will attain the physical, social, and economic advantages resulting from comprehensive and orderly planned use of land resources; e. The Plan provides for a lessening of congestion and assures convenience of access; secures safety from fire, flood, and other dangers; provides for adequate light, air, sunlight, and open space; promotes and encourages conservation of scarce resources; prevents overcrowding of land and undue concentration of population; facilitates the creation of a convenient, attractive, and harmonious community; attains a desirable balance of residential and employment opportunities and expedites the provision of adequate and essential public services. f. The Plan facilitates development within the City in accordance with the General Plan by permitting greater flexibility and encouraging more creative and imaginative designs for major urban development projects subject to large-scale community planning. g. The Plan promotes more economical and efficient use of the land while providing a harmonious variety of housing and commercial and industrial activities, a high level of urban amenities, and preservation of natural and scenic qualities of open space. h. The Plan provides a process for initiation, review, and regulation of large-scale comprehensively planned urban communities and affords the maximum flexibility to the developer within the context of an overall development program and specific, phased development plans coordinated with the provision of necessary public services and facilities. i. The City Council hereby finds that the Final Environmental Impact Report and its Appendices (Volumes 3 and 4) for the South Poway Planned Community have been completed in compliance with the California Environmental Quality Act and the information included within those documents has been reviewed and considered, along with the Findings and Statement of Overriding Considerations contained in Resolution No. 85-45. Resolution No. P 85-44 Page 3 Section 2: The Development Plan (Volume 1) and the Development Standards (Volume 2) are hereby adopted collectively as the Development Plan for the South Poway Planned Community with the inclusion of the following modifications to the text of these documents: Volume 1 - Development Plan The following modifications shall be included in the final version of the Development Plan: Land Use The Rural Residential C designation in Subarea 4 located northeast and southwest of the extension of Midland Road shall be limited to a maximum number of 40 lots (including 19 existing lots created by Tentative Map 4278). This actual number of lots shall be based upon the physical constraints of soil/geology conditions, slope criteria for the RR-C zone, and other City criteria for subdivision of land (page 21). The Single Family 2 area located in Subarea 5 to the west of Pomerado Road shall consist of lots located in the vicinity of the major roadways and should not be visible from adjacent areas (Figure 8a). The discussion of the Residential Mobilehome area in Subarea 4 shall include a statement indicating that the City desires that the area develop as owner-occupied units. Transportation Ail street section designs including street widths, medians, bicycle lanes, sidewalks, and general utility easements (pages 34-37) shall be designed in accordance with City standards and requirements to the satisfaction of the City Engineer and the revised street designs shall be incorporated graphically into Volume 1. Public transit facilities including turn-outs, bus bench enclosures, and trash containers shall be provided where necessary to the satisfaction of the Directors of Community and Public Services (page 41). Resolution No. P 85-44 Page 4 e The pedestrian system (page 41) shall be modified to include sidewalks within the general utility easements and a jogging system within the utility easements or connecting to the equestrian trails. Sidewalks shall generally be provided along both sides of prime arterials, major arterials, and commercial/industrial collectors. This requirement shall be reviewed with each tentative subdivision map received and the utility of sidewalk in each area shall be the basis for a determination by the Directors of Planning and Public Services as to the requirement for installation. e The equestrian trails facilities and system (page 45) shall be installed as part of the implementation of the development program for the SPPC by the individual developers. Additionally, connections to existing off-site trails shall be made where possible to achieve equestrian/pedestrian access to and from areas surrounding South Poway. Also, the location of the west trail in Beeler Canyon in Subareas 3 and 5 shall be reviewed at the tentative map stage and a determination shall be made regarding its exact location in relation to the dedicated rural road in those areas. An additional alternative for the termination of Gate Drive shall be added to the discussion on circulation (page 39). This additional alternative shall state that a double cul-de-sac might be utilized so that the residential portion of Gate Drive has access only to the future Poway Creek Road. e Discussion regarding the possible utilization of a bridge for the South Poway Arterial as it crosses Pomerado Road to reduce the grading required to accomodate the arterial, and discussion of the possible use of a bi-level road for the Community Road extension into South Poway shall be included (pages 38-39). o The Transportation Element shall also include a discussion of options for the future of Metate Lane (cul-de-sac at various locations or remain as a through street). Public Facilities The water, sewer, and drainage system improvements shall be designed to the satisfaction of the Director of Public Services. The location of the Montauk reservoir shall be reviewed in detail to determine if it can be relocated to be less visible. All reservoirs within South Poway shall be screened with dense plantings of trees around their perimeters (pages 48-50). Resolution No. P 85-44 Page 5 0 In addition to the need for a 2.0 acre site for a future fire station, the Safety Services Department may need a temporary site and facility when development in the South Poway and surrounding area can no longer be adequately served by Station No. 1 (page 51). e Because many of the buildings in South Poway will be industrial with large floor and roof areas, it will be necessary to fight any major fire with large volumes of water delievered from an overhead source. This requires the provision of a truck with specialized "squirt" apparatus whose average cost ranges from $225,000 to $250,000 (page 57). 5o A section shall be added to the Public Facilities Element discussing the need for an active recreation area(s) including softball fields, picnic areas, and a par course to be privately constructed, operated, and maintained or maintained as part of a landscape maintenance district. In addition, the City will consider the use of a facilities fee to provide the equestrian trails, staging area, and South Poway Arterial equestrian underpass and the recreational facilities mentioned above. Community Design The mini-park located in Subarea 3 shall be relocated in a westerly direction to the adjacent north/south trending ridge (Figure 25). o Discuss the recommended inclusion of softball fields, picnic areas, and a par course as a private recreational facility (page 89). 3. Discuss the difference of plant types occurring on the north and south facing slopes of South Poway (pages 90-91). o Include within the landscaping plan a method for introducing some larger native plants (trees and shrubs) on the open space and rural residential north, west and south slopes, and include Hollyleaf Cherry (Prunus ilicifolia) as a plant type in these areas. e Include within the landscaping plan a discussion of the replacement of all mature trees removed on a one-for-one basis with a minimum of 36-inch box specimens. 0 Include within the section regarding open space (page 87) a discussion indicating that open space areas shall be privately owned but may be included within a landscape maintenance district. Resolution No. P 85-44 Page 6 Implementation Plan Table 8 (page 159) shall be modified to include road improvements relating to major points of access as discussed on page 157. Volume 2 - Development Standards The following modifications shall be included in the final version of the Development Standards: Area-Wide Development Standards 1. The street standards shall be modified as recommended for Volume 1 (pages 2-8). The equestrian/hiking trail standards shall conform to the City Standards for a Rural Community Trail and the trail underpass shall provide a minimum clearance of eleven (11) feet (pages 9-10). 3. The Hollyleaf Cherry (Prunus ilicifolia) shall be added to the plant list for exterior slopes (pages 21-23). 4. The landscaped setback for the South Poway Arterial shall be fifty (50) feet (page 31). 5. The landscaping within parking areas shall include one (1) tree for every three (3) parking spaces (page 38). In the LI and IP zones only, forty (40) percent of the employee parking may be provided by compact spaces, .however all visitor spaces shall be full-sized. Should the use of compact spaces in these zones create any on-street parking problems, the standard for such spaces may be amended at the direction of the City Council. Industrial and Commercial Development Standards City governmental services and facilities such as fire stations, police stations, and other such facilities shall be permitted uses in the IP and LI zones (page 56). 2. Cogeneration systems (2 megawatts and less) shall be a permitted use in the IP and LI zones (page 56). Resolution No. P 85-44 Page 6 Implementation Plan 1. Table 8 (page 159) shall be modified to include road improve- ments relating to major points of access as discussed on page 157. Volume 2 - Development Standards The following modifications shall be included in the final version of the Development Standards: Area-Wide Development Standards The street standards shall be modified as recommended for Volume 1 (pages 2-8). The following shall be addressed as development occurrs for South Poway in any development plan or tract: the preservation of wildlife habitat and provisions for wildlife roadway crossings; B. the exclusion or inclusion of the north loop road; the status of the wells and septic systems of the existing homes; D. the alignment of Pomerado Road; E. the soils condition and slide potential in the area; F. the possibility of low-income, owner-occupied housing; and G. the establishment of long-term controls on open space areas. Resolution No. P 85-44 Page 7 Industrial and Commercial Development Standards 1. City governmental services and facilities such as fire sta- tions, police stations, and other such facilities shall be per- mitted uses in the IP and LI zones (page 56). 2. Cogeneration systems (2 megawatts and less) shall be a per- mitted use in the IP and LI zones (page 56). 3. Fast food restaurants with drive-in or drive-through shall require a conditional use permit (page 58). 4. The front yard setbacks shall be a minimum of 35 feet and the minimum setback from the South Poway Arterial shall be 50 feet (pages 63-69). 5. Interior side and rear yard buildings setbacks shall be zero (0) feet or twenty (20) feet or greater (pages 63-69). Pro~ect Review 1. This Planned Community shall be reviewed annually by the Department of Planning Services and a report of development progress will be prepared for City Council review. 2. Within 90 days the developer shall provide the Department of Planning Services with 15 bound copies of the corrected Development Plan and Development Standards texts, exhibits and maps including a copy of the resolution of approval. Section 3: Environmental Review: The mitigation measures as described in the resolution certifying the Final Environmental Impact and describing the Findings and Statement of Overriding Considerations shall be included as requirements for the implementation of the Development Plan and all future projects in the South Poway Planned Community.
