A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
DENYING TENTATIVE PARCEL MAP 82-06R TIME EXTENSION
ASSESSOR'S PARCEL NUMBER 277-020-11
WHEREAS, Tentative Parcel Map No. 82-06R TE, hereinafter "Map"
submitted by Michael and Josephine Kan, applicant, for the
purpose of subdividing the real property situated in the City of
Poway, County of San Diego, State of California, described as
Parcel 4 of PM 4152, into four lots, regularly came before the City
Council for public hearing and action on August 6, 1985; and
WHEREAS, the Director of Planning Services has recommended
DENIAL of the Map subject to all conditions set forth in the
Planning Services Department report; and
WHEREAS, the City Council has read and considered said report
and has considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council of the City of Poway does
resolve as follows:
Section 1: Findings:
The City Council makes the following findings in regard to
Tentative Parcel No. 82-06R Time Extension and the Map
thereof:
a. The tentative parcel is not consistent with all applicable
interim and proposed general and specific plans; in that
Section 17.08.180 of the code requires a minimum net area
of 40 acres per parcel for property under the Rural
Residential-A zone designation without city water
available, and with a slope of 25 percent or more. The
total acreage for the site is 41.29 acres, thus the
property cannot be further subdivided.
b. The design or improvement of the tentative parcel map is
not consistent with all applicable interim and proposed
general and specific plans.
c. The site is not physically suitable for the type of
development proposed; in that the topographical
constraints (average slope of the 41.29 acre site is 40.67
percent) and unavailability of City water limits the
density of development to one dwelling unit per 40 net
acres according to Section 17.08.180 of the code.

The site is not physically suitable for the density of
the development proposed; in that the project's slope of
40.67 percent and unavailability of City water limits the
density to one dwelling unit under the RR-A zone
designation.
The design of the tentative parcel map may conflict with
any easement acquired by the public at large, now of
record, for access through or use of the property within
the proposed subdivision.
A Negative Declaration was issued with approval of the
map, satisfying the requirement of the California
Environmental Ouality Act.
The effect of subdivision denial on the housing needs of
the San Diego region has been considered and balanced
against the public service needs of Poway residents and
available fiscal and environmental resources.
Section 2:
Tentative Parcel Map 82-06R, Time Extension a copy of which
is on file in the Planning Services Office, is hereby
denied.
APPROVED and ADOPTED by the City Council of the City of Poway,
State of California, this 6th day of August, 1985.
