P 85-55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING REVISED TENTATIVE PARCEL MAP 17183R TIME EXTENSION ASSESSOR'S PARCEL NUMBER 321-180-50,15 WHEREAS, Revised Tentative Parcel Map No. 17183R Time Extension, hereinafter "Map" submitted by Siavash Saremi, applicant, for the pur- pose of subdividing the real property situated in the City of Poway, County of San Diego, State of California, described as Lot D of Belvedere Estates Unit No. 1, according to map thereof No. 4015, filed in the Office of the County Recorder of San Diego County, November 19, 1958, and a portion of Section 7, Township 14 south, Range 1 west, San Bernardino Base and Meridian, according to official plat thereof into four lots, regularly came before the City Council for public hearing and action on August 27, 1985; and WHEREAS, the Director of Planning Services has recommended APPROVAL of the Map subject to all conditions set forth in the Planning Services Department report; and WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council of the City of Poway does resolve as follows: Section 1: Findings: The City Council makes the following findings in regard to revised Tentative Parcel Map 17183R Time Extension and the Map thereof: The tentative parcel map is consistent with the General Plan because the residential land use proposed coincides with the General Plan land use designation. be The design or improvement of the tentative parcel is consistent with the General Plan because all necessary facilities and services can be provided for the proposed residential development. The site is physically suitable for the type of develop- ment proposed because adverse geology/soil conditions and drainage/hydrology, traffic, and water hazards can be mitigated. The site is physically suitable for the density of the development proposed, because adverse geology/soil con- ditions, drainage/hydrology, traffic, and water hazards can be mitigated and the density conforms to the City's General Plan land use designation. Resolution No. P 85-55 Page 2 The tentative parcel map is not likely to cause serious public health problems because public water and septic facilities will be provided. The design of the tentative parcel will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. A mitigated Negative Declaration was issued by the City of Poway with approval of the map which addressed impacts pertaining to traffic and drainage, as well as other conditions noted in the resolution. The pre- viously issued mitigated Negative Declaration satisfies the requirements of California Environmental Quality Act. Section 2: Clarification of Condition 3 Under Section 2 of Resolution P-83-22 A tentative parcel map delineating the location of sep- tic systems on all lots shall be submitted to the Director of Planning Services by September 26, 1985 and shall be accompanied by documentation from both the County Health Department and the Director of Public Services. If this requires a reconfiguration of any lots, the Director of Planning'Services may require all information necessary to determine if these lot(s) meet current zoning and general plan requirements. He may also require that the City Council approve any revised lots if he deems that those revisions are substantial. As an alternative to a septic system, the developer may obtain a letter of availability for sewer service pur- suant to Ordinance No. 83 within 30 days of approval of this map (by September 26, 1985). Should he choose this option, the developer shall have all necessary plans prepared and approved by the City Engineer for the extension of a public sewer system to serve all lots in this subdivision prior to recordation of the final map. If the developer has not obtained an LOA or the approval of the Health Department and the Director of Public Services within 30 days (by September 26, 1985) this map shall automatically expire. Resolution No. P- 85-55 Page 3 Clarification of Condition 2 Under I-E of P-83-22 An open space easement shall be granted to the City over, upon, across, and under the area defined on the tentative map as an equestrian trail and no building, structures or other things shall be constructed, erected, placed, or maintained on subject easements except for the construction and maintenance of said trail and structures appurtenant to the trail. All conditions of approval of City of Poway Resolution P-83-22 shall be fulfilled as required, except that a final map for the tentative parcel map time extension shall expire on October 6, 1986 under the Subdivision Map Act. No further time extension may be granted for Tentative Parcel Map 17183R. APPROVED and ADOPTED by the City Council of the City of Poway, State of California, this 27th day of August, 1985. Robert C.
