A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PERMIT 85-58
WHEREAS, Temporary Use Permit 85-58, Atlantic Richfield,
applicant, requests approval of a temporary use permit to locate a
portable cashier structure in the Arco Mini Mart construction site
at the southeast corner of Poway Road and Carriage Road in the CG
(Commercial General) zone; and
WHEREAS, on September 10, 1985 the City Council held a hearing
on the above-referenced item.
NOW, THEREFORE, the City Council of the City of Poway does
resolve as follows:
Section 1: Findinqs:
That the proposed use is in accordance with the purposes and
standards of Section 17.26.020 of the Zoning Development Code.
Section 2: Environmental Findings:
Pursuant to the procedures of the City of Poway, implementing
the California Environmental Quality Act of 1970, the above-
referenced project is Categorically Exempt, Class 1.
Section 3: City Council Decision:
The City Council hereby approves Temporary Use Permit 85-58
subject to the following conditions:
1. Prior to the commencement of business activity for the
site, the following conditions shall be met:
a. The entire site shall be asphalted in accordance with
approved plans.
b. All on-site curb, gutter, sidewalk, and landscape plan-
ters shall be installed.
2. All landscape irrigation lines shall be installed.
3. The trash enclosure shall be completed.
4. A temporary restroom facility shall be provided on-site.
5. All necessary building permits relating to the placement of
the trailer must be obtained and all inspections completed.

Ail temporary and permanent on-site signs shall conform to
the Sign Ordinance.
An additional 30 day time extension to the TUP may be
granted by the Director of Planning Services.
The trailer shall be located approximately on the site as
shown in Attachment 1. The specific location is subject to
approval of the Director of Planning Services.
Pursuant to the letter dated August 23, 1985, the temporary
sign shall be brought into conformance prior to issuance of
a permit for the trailer.
10. For temporary fuel dispensing to be permitted, all appli-
cable regulations in the Electric and Fire Codes and Air
Pollution Control regulations must be met.
11. The location of the trailer must be at the proper separa-
tion distance from the fuel area and building under
construction as required by the Building and Fire Codes.
Section 4: City Council Decision:
The City Council hereby approves Temporary Use Permit 85-58
subject to the following Standard Conditions:
APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING AND BUILDING
SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS:
SITE DEVELOPMENT
Site shall be developed in accordance with the approved site
plans on file in the Planning Services Department and the
conditions contained herein.
Revised site plans and building elevations incorporating all
conditions of approval shall be submitted to the Planning
Services Department prior to issuance of building permits.
Approval of this request shall not waive compliance with all
sections of the Zoning Development Code and all other
applicable City Ordinances in effect at the time of building
permit issuance.
This approval shall become null and void if building permits
are not issued for this project within one year from the date
of project approval.
Trash receptacle multifamily developments shall be enclosed by
a 6 foot high masonry wall with view-obstructing gates pursuant
to City standards. Location shall be subject to approval by
the Planning Services Department.

5. Building identification and/or addresses shall be placed on all new
and existing buildings so as to be plainly visible from the street
or access road; color of identification and/or addresses shall
contrast with their background color.

1. Any signs proposed for this development shall be designed and
approved in conformance with the Sign Ordinance.
