A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
DENYING DEVELOPMENT REVIEW 85-07
ASSESSOR'S PARCEL NUMBER 317-490-46
WHEREAS, Development Review 85-07, submitted by Kimberly Park
Apartments, Ltd., applicant, requests approval to construct a 54
unit apartment complex for property located at the terminus of
Silver Lake Dirve, in the RA (Residential Apartment) zone; and
WHEREAS, on December 17, 1985, the City Council held a hearing
on the above-referenced item.
NOW, THEREFORE, the City Council does hereby resolve as
follows:
Section 1:
Findings:
That the proposed development is not in conformance with
the Poway General Plan in that policy 15.a states inten-
sive develoment shall be limited to slopes less than 25
percent. Approximately 40 percent of the project is in
said slope area.
That the proposed development will have an adverse aesthe-
tic, and architectural impact upon adjoining properties
in that building locations and rooflines are not
compatible with adjacent developments.
That the proposed development is not in compliance with
the Zoning Ordinance in that the Residential Apartment
Zone provides for a range of density from 12 to 20
d.u./ac, and because of the site's rugged topography only
development at the lower end of that density range is
acceptable.
That the proposed development does not encourage the
orderly and harmonious appearance of structures and
property within the City in that the proposed development
appears to block the view of the site's rock outcrop from
Poway Road and adjacent properties. Preservation of the
view of said formation contributes to the City's rural
image, and maintains the harmonious appearance of
properties within the City.
Section 2: City Council Decision:
The City Council hereby denies Development Review 85-07.
