P-03-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 03-24 WHEREAS, Temporary Use Permit 03-24; City of Poway Community Services Department, Applicant, requests approval to hold the Annual Old Fashioned Fourth of July Celebration at Old Poway Park located at 14134 Midland Road from 10:00 a.m. to 4:00 p.m., and the fireworks display at Poway High School located at 15500 Espola Road from 9:00 p.m. to 9:20 p.m. on Friday, July 4, 2003. WHEREAS, on June 10, 2003, the City Council considered the al: item. NOW, THEREFORE, the City Council does hereby follows: Section 1: The City Council finds that Temporary Use Permit 03-24 is Categorically Exempt (Class 4) from the California E Quality Act (CEQA), pursuant to Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature and will have no permanent effects on th t. Section 2: The proposed use is in accordance with the purposes and standards of Section 17.26.030.A of the Poway Municipal Code. Section 3: The City Council hereby approves Temporary Use Permit 03-24, the Annual Old Fashioned Fourth of July Celebration at Old Poway Park located at 14134 Midland Road from 10:00 a.m. to 4:00 p.m. and the fireworks display at Poway High School located at 15500 Espola Road from 9:00 p.m. to 9:20 p.m. on Friday, July 4, 2003, subject to the following conditions: The event and related offsite parking shall be conducted as shown on the site plan and application on file in the Development Services Department. The permit is not valid until the applicant provides authorization from the Poway Unified School District for the use of the Poway High School field. This permit is valid for Old Poway Park during the hours of 7:00 a.m. to 5:00 p.m. and at Poway High School during the hours of 5:30 p.m. to 10:00 p.m. on Friday, July 4, 2003, after which time the site shall be restored to its original condition. Approval of this activity shall not 31iance with all other sections of the Zoning Ordinance and all other applicable State, County, and City Ordinances presently in effect. Resolution No. P-03-28 Page 2 The site shall be developed in accordance with the approved site plan on file in the Development Services Department, Planning Division, except as may otherwise be provided heroin, prior t l of the activity. F. Prior to the event, the applicant shall comply with the following: The following City of Poway departments shall be contacted for appropriate permits, coordination, and inspections: Public Works, Community Services, Development Services (including the Building, Traffic Engineering, and Planning Divisions), Safety Services, and the SherifFs Department. The San Diego County Health Department shall also be contacted. All proposed signs shall be approved by the Development Services Department, Planning Division, and shall be in accordance with Section 17.40 of the Poway Municipal Code. The applicant shall comply with the following to the satisfaction of the Fire Marshal: Prior to and during the event, emergency vehicle access to any stroet, building, firo hydrant, or firo sprinkler system shall not be blocked. Obtain a permit from the Firo Department for any canopy that exceeds 400 square feet. The firoworks company is to obtain a permit from the Fire Department for the fireworks display. Provide a 2A:10BC firo extinguisher at any booth where food is being cooked. 5. Securo any compressed gas cylinders from falling over. 6. Parking at all firo lanes is prohibited. H. At th :the event, the applicant shall comply with the following: Public stroets, off-stroet parking sites, and aroas within and adjoining the proposed aroa for the event, shall be clearod of debris, litter, temporary signs, and all other evidence of the event shall be romoved upon its completion. Section 4: This approval Shall become null and void on Friday, July 4, 2003, at 10:00 p.m., at which time the site shall have been restorod to its original condition.
