P-80-101 A OF THE CITY COU IL OF TH CI Y OF POWAY, CALIFO IA APPROVI G T NTATIVE TRACT MAP -06 ASSESSO 'S ARCEL NUMBER 323-0 -06 WHEREAS, Tentative Parcel Map No. 88-06, hereinafter "Map" submitted by Richard and Allan Kuebler, applicants, for the purpose of subdividing the real property situated in the City of Poway, C unty of San Diego, State of California, as the southerly 40 feet of the quarter of the quarter of Section 17 Township 4 South Range i West, San Base Meridian excepting therefrom the wes erly 575 feet into five lots and one remainder parcel, regularly came before the City Council for public hearing and action on October 4, 1988; and WHEREAS, the Director of Planning Services has recommended approval of the Map subject to all conditions set forth in the Planning Services Department report; and WHEREAS, the City Council has read and considered said report, the environ- mental initial study, proposed Negative D and other evidence pre- sented at the public hearing. NOW, THEREFORE, the City Council of the City of Poway does resolve as follows: Section 1: F The City Council finds that the project will not have a significant adverse impact on the and hereby issues a Negative Section 2: F' dinc: The City Council makes the following findings in regard to Map 88-06 and the Map thereof: Tract The tract map is with all applicable general and specific plans, in that the General Plan designates the site for resi- dential development on lots ranging from one to four acres in size. The design or improvement of the tract map is with all applicable general and specific plans, in that the proposed parcels are designated for residential use and meet the minimum lot size and configuration required for such development. The site is physically suitable for the type of development proposed, in that the overall slope gradient is 9.5 percent and little grading will be required to create suitable building pads for single family homes. No. P- 88-101 Page 2 The site is physically suitable for the density of the development pro- posed, in that the project meets the slope criteria of the RR-C zone to allow five lots of one acre and a parcel. The design of the is not likely to cause damage and injury to humands and wildlife or their habitat, in that the proposed conditions of approval will miti- gate potential impacts to a level of insignificance. The tract map is not likely to cause serious public health problems, in that City water and sewer service will be provided. The design of the tract map will not conflict with any ease- ment acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. Section 3: City Council Decision: Tract Map 88-06, a copy of which is on file in the Planning Services office, is hereby approved subject to all of the following Within 30 days of approval, the applicant shall submit in writing that all of approval have been read and understood. ADDITIONAL APPROVALS REQUIRED Development Review or Minor Development Review shall be accomplished prior to the issuance of building permits. APPLICANT SHALL CONTACT THE PUBLIC SERVICES DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: H. GRADING Grading of the subject property shall be in with the Uniform Building Code, City Grading Ordinance, approved grading plan and geotech- nical report, and accepted grading p The grading plan shall contain a certificate signed by a registered civil engineer that the grading plan has preserved a minimum of 100 square feet of solar access for each dwelling unit and for each future building site within the subdivision. A soils report shall be prepared by a qualified engineer licensed by the State of California to perform such work at first submittal of a grading plan. A geological report shall be prepared by a qualified engineer or geologist and submitted at the time of application for grading plan check. The final grading plan shall be subject to review and approval by the Planning Services and Public Services and shall be completed prior to issuance of building permits, A pr -blast survey of surrounding property shall be to the satis- fact on of the City Engineer prior to any rock blasting.
