The is located at the terminus of Merritt Park Lane, in the S-4 and RS-7 zones; and WHEREAS, on December 20, 1988, the City Council held a hearing on the above- referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: E Findinqs: The City Council finds that no new impacts beyond those discusse within the original underlying tract map initial 1 review have een iden- tified. Therefore, the Negative issued for TTM 87-1 is found to be adequate to address all impacts for this pro ect. Section 2: Firdil That the proposed development is in conformance with the Poway General Plan, in that the proposed density and single-family residential use is with the General Plan designation of Rural Residential C zone. That the proposed development will not have an adverse health, safety, or ly related impact upon adjoining pro- perties because rooflines, building materials, and 1 design are compatible with adjacent tract d That the proposed development is in compliance with the Zoning Ordinance, in that it meets all development standards for the RS-4 and RS-7 zones, That the proposed development encourages the orderly and h appearance of and property wi hin the City because it is similar to and complements the adjacent evelopment and it complies with the design guidelines of the Genera Plan regarding number of housing styles, el varied roofl nes, colors, and Section 3: City Council Decision: The City Council hereby approves Development Review 88-21 subject to the -- following conditions: Resolution No. P-88-126 Page 2 Within 30 days of approval: (1) The applicant shall submit in writing that all of approval have been read and and {2) the pro- perty owner shall execute a Covenant on Real Property. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: A. SITE DEVELOPMENT 1, Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. 2. Revised site plans and building elevations g all conditions of approval shall be to the Planning Services prior to issuance of building permits. 3. Approval of this request shall not waive compliance with all sections of the Zoning Development Code and all other applicable City 0 in effect at the time of building permit The developer shall provide a minimum of 25% of the lots with adequate sideyard area for vehicle storage pursuant to City standards, and the C.C.&R.'s shall prohibit the storage of vehicles in the required front yard setback. PARKING AND VEHICULAR ACCESS - NONE LANDSCAPING The CC&R's shall require the installation of front yard landscaping or otherwise secure the value of front yard for each unit. It shall be installed no later than 180 days following the close of escrow. A Master Plan of the existing on-site trees shall be provided to the Planning Services Department prior to the issuance of building permits and prior to grading, to determine which trees shall be retained. Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the City of Poway Ordinance and shall be planted at an average of every 30 feet on interior streets and 20 feet on exterior streets. Street trees are required to be planted prior to occupancy of the building. The developer may provide a homeowner with a voucher to purchase a 15 gallon tree or larger from the recommended street tree list. The project planner must see proof of the voucher prior to final approval of the building. The developer shall install all front, rear, and sideyard fencing to the of the Planning Director and prior to final occupancy of each unit. Fencing along rear property lines for Lots 2 through 5 shall consist of vinyl coated chain link, a minimum of five feet in height. Posts and rails shall be wood and colored to match the remainder of the project fencing. No. P-88-126 Page 4 D. SIGNS Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance. E. RECREATION The developer shall pay the Park Fee at the established rate at the date of final inspection, or the date of the certificate of occupancy, whichever occurs later. F.
