P- 89-28 OF THE C TY CO CIL 0 THE CITY .F POWAY, APPRO ING MINOR EVELOPMEN REVI ' 88-205 AS ESSOR'S PA CEL NUMBE 321- 0-03 WHEREAS, Minor Development Review 88-205, by Jim Gormican to construct a 3,831 square foot single-family residence at 15650 Blue Crystal Trail, within an area identified on the "Major Topographical Features" map, in the RR-A (Rural 1 A) zone; and WHEREAS, on March 7, 1989, the City Council held a hearing on the above- referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: E Findin~ [ The City Council finds that this project is categorically exempt (Class 3) from the California E Quality Act. Section 3: City Council The City Council hereby approves Minor Development Review 88-205 subject to the following conditions: Within 30 days of approval: (1) The applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the pro- perty owner shall execute a Covenant on Real Property. The etached garage shall not be used for living quarters nor shall it be u ilized for ' 1 business activities, including but not limi ed to, auto repair and cabinet making. A covenant to that effect shal be recorded over the property prior to building permit Resolution No. P-89_28 Page 2 A riding and hiking trail shall be dedicated to the City of Poway along the southerly ten feet of the property subject to the approval of the Director of Water well, as a source of water supply for domestic and fire require- ment needs, shall meet the requirements of the County of San Diego Health and the State of California water well APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. Site shall be in with the approved site plans on file in the Planning Services Department and the conditions contained herein. Approval of this request shall not waive compliance with all sections of the Zoning Development Code and all other applicable City 0 in effect at the time of building permit ' The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit ' For a new residential dwelling unit(), the applicant shall pay devel pment fees at the established rate. Such ees may include, but not be limi ed to: Permit and Plan Checking Fees, Schoo Fees {in with City-a opted policy and/or ), Water and ewer Service Fees. These fees s all be paid prior to building permit ' 5. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. Building and/or shall be placed on all new and existing bull ings so as to be plainly visible from the street or access road; color o identification and/or addresses shall contrast with their background co or. o Existing on-site trees shall be retained wherever possible and shall be trimmed and/or topped. Dead, decaying or potentially dangerous trees shall e approved for removal at the d' of the Planning Services · epartment during the review of the Master Plan of existing on-site trees. hose trees which are approved for removal shall be replaced on a tree-for- ree basis as required by the Planning Services Department. APPLICANT SHALL CONTACT THE PUBLIC SERVICES DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: No. P- 89-28 Page 3 The private road, known as Blue Crystal Trail, fronting the property shall be improved to the City's Rural Street S of said improvement must be made prior to issuance of a C of Occupancy. A road and agreement f r that private road fronting the property (Blue Crystal Trail), in a form sa isfactory to the City Attorney, shall be executed by the developer an /or owner prior to building permit ' Said agreement is to comply w th City No. 280. 3. Leach field layout for sewage disposal system, shall be approved by the City Engineer prior to building permit ' APPLICANT SHALL CONTACT THE SAFETY SERVICES DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: Roof covering shall meet Class A fire retardant testing as specified in the Uniform Building Standards No. 32-7 for fire retardant roof. Approved numbers or addresses shall be placed on the building in such a position as to be plainly visible and legible from the street fronting the property. Said numbers shall contrast with their background. Minimum height of address numbers shall be four inches. Address shall be required at private driveway 4. Each chimney used in with any fireplace shall be ~ with a spark arrester. 5. On-site water storage, if needed for fire control, shall meet the require- ments of the City's Fire Marshal.
