The subdivision is loca ed on the east side of Midland Road between Somerset and Janette Lane in the R -7 zone; and WHEREAS, on March 28, 1989, the City Council held a hearing on the above referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: E 1 Findinc ~ he Ci Council finds that no new impacts beyond those within the nitia 1 review for the original underlying tract map have been denti iedo Therefore, the Negative Declaration issued for TTM 86-04 is ound o be adequate to address all impacts for this project. Section 2: Findinc : That the proposed is in with the Poway General Plan, in that the proposed density and single-family use is with the General Plan designation of Residential Single- Family 7 zones. That the proposed will not have an adverse health, safety, or architecturally related impact upon adjoining pro- perties because rooflines, building materials, and architectural design are compatible with adjacent tract developments. o That the proposed development is in compliance with the Zoning Ordinance, in that it meets all development standards for the RS-7 zone. That the proposed development encourages the orderly and appearance of structures and property within the City be ause it is simil r to and complements the adjacent development and t complies with he design guidelines of the General Plan and the 0 d Powaj/ Speci ic Plan regarding number of housing styles, el varied roofl nes, colors, and materials. Section 3: City Council The City Council hereby approves Development Review 88-30 subject to the following conditions: No. P- 89-35 Page 2 Within 30 days of approval: (1) The shall submit in writing that all of approval have been read and understood; and {2) the property owner shall execute a Covenant On Real Property. All adopted conditions of approval of the underlying tract map shall be satisfied prior to issuance of building permits. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: SITE DEVELOPMENT 1. Site shall be developed in with the approved site plans on file in the Planning Services Department and the herein. An area shall be reserved at the northeast corner of the ' of Janette Lane and Midland Road for the installation of a monument d the entry into the Old Poway Plan area, and shall be located within the LMD planting area. Approval of this request shall not waive compliance with all sections of the Zoning Development Code and all other applicable City Ordinances in effect at the time of building permit ' The developer shall provide a minimum of 25% of the lots with adequate sideyard area for vehicle storage pursuant to City standards, and the C.C.&R.'s shall prohibit the storage of 1 vehicles in the required front yard setback. LANDSCAPING The developer shall guarantee installation of front yard landscaping and irrigation for each unit. It shall be installed no later than 180 days following the close of escrow for each unit. Security shall be to the satisfaction of the Director of Planning Services. A detailed landscape and irrigation plan shall be submitted to and approved by the Planning Services Department prior to the issuance of building per- mits. o Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the City of Poway Ordinance and shal be planted at an average of every 30 feet on interior streets and 20 eet on exterior streets. As an al to installation the deve oper may provide a coupon to the home buyer for the purchase of street rees, from a City- approved street tree list, at a local nursery. The developer shall install all front, rear, and sideyard fencing to the satisfaction of the Planning Director and prior to final of each unit. SIGNS Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance. RECREATION The developer shall pay the Park Fee at the established rate at the date of final inspection, or the date of the Certificate of Occupancy, whichever occurs later. ADDITIONAL APPROVALS REQUIRED The developer shall display a current Zoning and Land Use Map in the sales office at all times, and/or suitable al to the satisfaction of the Director of Planning No. P- 89-35 Page 4 All sales maps that are distributed or made available to the public shall include but not be limited to trails, future and existing schools, parks, and streets. Costs shall be submitted to the City Engineer for review and approval. Abandon existing main and easement through Midland Road frontage lots and replace in the center of Midland Road. APPLICANT SHALL CONTACT THE SAFETY SERVICES DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: SAFETY SERVICES 1. Fire hydrant required per TTM approval at Midland and Somerset. Resolution No. P-89-35 Page 5 Roof covering shall be fire retardant as per UBC Section 3203(e) and City of Poway Ordinance No. 64. Approved numbers or addresses shall be placed on the building in such a position as to be plainly visible and legible from the street fronting the property. Said numbers shall contrast with their background. Minimum height of address numbers shall be four inches. Address may be required at private driveway entrances.
