WHEREAS, C Use Permit 89-02 and Development Review 89-06, sub-
mitred by AK III (Animal Keeper), requests approval of a
small animal care and boarding facility at 12280 Oak Knoll Road in the CG zone;
and
WHEREAS, on June 27, 1989, the City Council held a hearing on the above-
referenced item.
NOW,
the City Council does hereby resolve as follows:
Section 1: E 1 Findin¢ :
The City Council finds that this project will not have a significant adverse
impact on the and hereby issues a Negative Declaration with
mitigation measures as contained in the conditions of approval.
Section 2: :
Conditional Use Permit 89-02
That the location, size, design, and operating ch of the
proposed use will be compatible with and will not adversely affect or
be materially 1 to adjacent uses, residents, buildings,
, or natural in that ~ uses are all com-
mercial or semi-public in nature.
That the scale, bulk, coverage, and density is with adjacent
uses, in that all development of the Zoning Development Code
are met. The project will meet the applicable property
for off-street parking, setbacks, lot coverage, and building
height.
That there are available public facilities, and utilities to
serve the proposed use as all facilities and services can be provided for
through the conditions of approval.
That there will not be a harmful effect upon desirable neighborhood
in that the adequate sound will be pro-
vided in the design of the building.

condition of approval will require the payment of Traffic Mitigation

to the following conditions:

all conditions of approval have been read and understood; and (2) the pro-
perty owner shall execute a Covenant on Real Property.

APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE
WITH THE FOLLOWING CONDITIONS:
SITE DEVELOPMENT
1. Site shall be developed in accordance with the approved site plans on file
in the Planning Services Department and the conditions contained herein.
Revised site plans and building elevations incorporating all conditions of
approval shall be submitted to the Planning Services Department prior to
issuance of building permits.
Approval of this request shall not waive compliance with all sections of the
Zoning Development Code and all other applicable City Ordinances in effect
at the time of building permit '
Trash receptacle shall be enclosed by a six foot high masonry wall with
view-obstructing gates pursuant to City standards. Location shall be sub-
ject to approval by the Planning Services Department.
All roof app including air conditioners, shall be architecturally
integrated, shielded from view and sound buffered from adjacent properties
and streets as required by the Planning Services
Prior to any use of the project site or business activity being commenced
thereon, all conditions of approval contained herein shall be completed to
the satisfaction of the Director of Planning Services.

Uniform Mechanical Code, Uni orm Plumbing Code, National Electric Code,
Uniform Fire Code, and all o her applicable codes and ordinances in effect
at the time of building perm t '
For a new ' 1 or industrial development, or addition to an existing
development, the applicant shall pay development fees at the established
rate. Such fees may include, but not be limited to: Permit and Plan
Checking Fees, Water and Sewer Service Fees. These fees shall be paid prior
to building permit '
9. This approval shall become null and void if building permits are not issued
for this project within one year from the date of project approval.
PARKING AND VEHICULAR ACCESS
All parking lot landscaping shall consist of a minimum of one 15 gallon size
tree for every three parking spaces. For parking lot islands, a minimum 12
inch wide walk adjacent to parking stalls shall be provided and be separated
from vehicular areas by a six inch high, six inch wide portland concrete
cement curbing.

All exterior lights shall be low pressure sodium and have a maximum height
of 18 feet from the finished grade of the parking surface and be directed
away from all property lines, adjacent streets and residences.
All two-way traffic aisles shall be a minimum of 24 feet wide and emergency
access shall be provided, ~ free and clear, a minimum of 24 feet
wide at all times during construction in accordance with Safety Services
Department
4. All parking spaces shall be double striped.
LANDSCAPING
A detailed landscape and irrigation plan shall be submitted to and approved
by the Planning Services Department prior to the issuance of building per-
mits.
Street trees, a minimum of 15 gallon size or larger, shall be installed in
accordance with the City of Poway Ordinance and shall be planted at an
average of every 30 feet on interior streets and 20 feet on exterior
streets.
3. All landscaped areas shall be in a healthy and thriving con-
dition, free from weeos, tras~l, and debris.
SIGNS
Any signs proposed for this development shall be designed and approved in
conformance with the Sign Ordinance.
ADDITIONAL APPROVALS REQUI lED
Working drawings shall include a certification by a recognized 1
expert that the rec of the City of Poway's noise ordinance will be
met.
At the completion f and prior to occupancy, interior and
exterior CNEL shal be determined by field testing at developer's expense.
Tests to be conduc ed by a recognized expert. No occupancy per-
mits shall be gran ed until this condition is met to the satisfaction of the
Building Code (latest adopted edition) "Sound T Control."
APPLICANT SHALL CONTACT THE PUBLIC SERVICES DEPARTMENT REGARDING COMPLIANCE WITH
THE FOLLOWING CONDITIONS:

vehicles exiting the property. Said analysis shall be submitted
with the first of street ' plan. Sight distance shall
be based upon a design speed of 35 mph.
Should it be found that the line of sight for safe sight distance is outside
the street , an easement for clear space and/or
street right-of-way shall be dedicated to the City prior to building permit
GRADING
Any grading of the subject property shall be in accordance with the Uniform
Building Code, City Grading Ordinance, approved grading plan and geotech-
nical report, and accepted grading
A soils report shall be prepared by a qualified engineer licensed by the
State of California to perform such work prior to building permit '
STREETS AND SIDEWALKS
The northerly half of Oak Knoll Road fronting the development shall be
improved to City's C' Element - Local Collector Standards.

street width of 20 feet, construction of concrete curb, gutter, sidewalk,
and installation of street lights.

GENERAL REQUIREMENTS AND APPROVALS
1. At no time shall animals be boarded or left outside the
building.
2. All animal, food, and medical waste shall be disposed of in a proper manner
to prevent odor or hygiene
3. All on site shall be conducted so as not to violate the City's
noise ordinance.
4. The use permit/d review approval shall expire on May
30, 1990 unless an application for time is received 90 days prior
to expiration in accordance with the City's Subdivision Ordinance.
