P-89-75 A OF TH CIT COUNCIL OF TH CITY F P W C LIFORNIA APPROVING .,IN R D V L'P ~T EV EW 89-72, MINOR CON IT ONA S MI 8 -06, AND U DE GRO N 'AI R 9- 3 ASSESSOR'S PARCE N MBE 7~-0 -0 , 4 AND 277-011-04 WHEREAS, Minor Review 86-37, Minor Use Permit 89-06, and Under round Waiver 89-03 by Tom and Susan Ligouri, applicants, request a proval to construct a 2,400 single-family dwelling with a 1,050 square fo t apartment or the property located at 15555 Stage Coach Road in t e Rural 1 A RR-A) zone; and WHEREAS, on July 25, 1989, the City Council held a hearing on the above- item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findinc;: The City Council finds that this project is categorically exempt (Class 3) from the California E 1 Quality Act (CEQA). All new buildings on the parcel shall have underground No. P- 89-75 Page 3 Section 3: City Council Decision: The City Council hereby approves Minor Development Review 89-72, Minor Conditional Use Permit 89-06, and Underground Waiver 89-03 subject to the following conditions: Within 30 days of approval: (1) The applicant shall submit in writing that all conditions of approval have been read and understood; and the property owner shall execute a Covenant on Real Property. Either the apartment or the main residence must be occupied by the owners of the property at all times that either unit is held out for rent. The property owner will not oppose any future undergrounding district and agrees to pay a share of any future undergrounding costs. This approval shall become null and void if building permits are not issued by July 25, 1990. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1.
