BER 31 - - 2 WHEREAS, Minor Development Review 8g-77 was submitted by Don Pat and Anne O'Rourke and approved by the Planning Services Department and an appeal of the of approval for MDRA 89-77 was filed by the applicants; and WHEREAS, on August 22, 1989, the City Council held a hearing on the above- referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Environmental Find The City Council finds that this project is exempt under p C Envi Quality Act as a small 3). of the (Class Sectio : That the proposed development is in conformance with the Poway General Plan because the General Plan designates the site for single-family 1 use and the proposed project is an addition to an existing single-family home. The proposed development will not have an adverse aesthetic, health, safety, or architecturally related impacts upon adjoining properties, in that the proposed home incorporates rural design It meets all development standards for the RS-4 zone. That the proposed development is in compliance with the Zoning Development Code, in that all development standards will be met through project construction. e The proposed development encoura es the ord rly and harmonious appearance of structures and pro erties wit in the City because the proposed building will incorpora e architec ural details, materials, and colors that are compatible w th surroun lng residential uses. The City Council hereby affirms staff's approval of Minor Development Review 89-77 subject to the following conditions: Within 30 days of approval: (1) The applicant shall submit in writing that all conditions of approval have been read and understood; and (Z) the property owner shall execute a Covenant on Real Property. Resolution No. P-89-91 Page 3 In lieu of constructing said improvements a condition of issuance of building permit, the applicant shall comply with the applicable ordinance as enacted as of the date of issuance of of occu- pancy. Said payment has been based upon an engineer's cost estimate using the City's Unit Costs. Said payment has been reviewed and approved by the Director of Public Services and the City Engineer. At the applicants option, a Covenant Regarding Real Property for road improve- ments shall be recorded. Said covenant will replace Conditions No. 3, 4, 5 of the Resolution of Approval. 7. Please contact Public Services for payment of water, drainage, sewer, traf- fic mitigation, and park fees, if any, prior to building permit issuance. APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. Roof covering shall be fire as per Uniform Building Code Section 3203{e) and City of Poway Ordinance No. 64. Approved numbers or addresses shall be placed on the building in such a position as to be plainly visible and legible from the street fronting the property. Said numbers shall contrast with their background. Address shall be required at private driveway entrances. 3. Each chimney used in conjunction with any fireplace shall be maintained with a spark attester. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. The appropriate Building Department approvals shall be received prior to initiation of construction. 2. The applicants shall file an underground waiver with the Planning Services Department and pay all applicable fees. 3. A letter of is required from the Poway Unified School District prior to building permit issuance. 4. Water, sewer, and fire p systems plans shall be designed and constructed to meet requirements of the City of Poway. 5. Self-generating water softeners are prohibited in accordance with Chapter 13.04 of the Municipal Code. APPLICANT SHALL CONTACT THE DEPARTMENT OF PUBLIC SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: The a plicant shall pay a $500 inspection fee to the City's Public S rvices Depar merit prior to building permit issuance. A right-of-way permit shall be obtained from the City's Public S rvices Department for any work to b done within the public treet righ -of-way and/or City-held easement, aid work shall include, ut is not o be limited to, construction of riveway approach, sewer ateral ins allation, water service line installat on, street construction ncludtng concrete, curb, gutter, and sidewalk. Permit shall be obtained prior to start of work.
