P-89-97 F T CIT CO I F T ITY 0 PO APPROV NG N R CON ITI L U E P I 89-09 AS ESS ' PARC L N BER 75- -'7 WHERE S, Minor Condi tonal Use Pemit 89-09 submitted by Dr. and Mrs. James Hill, app icants, reques s approval to convert a 352 square foot tack room to a guest uni above an exis lng detached garage for the property located at 12900 Camino de Valle in the ural C zone; and WHEREAS, on August 29, lg89, the City Council held a hearing on the above- ~ item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: : The City Council finds that this project is categorically exempt (Class 3) from the California E tal Quality Act {CEQA). That the location, size, design, and operating characteristics of the propo ed use will be compatible with and will not adversely affect or be ma erially 1 to adjacent uses, residences, buildings, struc ures, or natural in that the use is accessory to and compa ible with single family residential development. That the scale, bulk, coverage, and density of the project is con- sistent with adjacent uses. The proposed architectural design and finish materials match the house. 3. That there are available public facilities, and utilities. That there will not be a harmful effect upon desirable neighborhood charact in that the subject lot can the added square footage. That the generation of traffic will not adversely impact the surrounding streets and/or the City's Circulation Element because the use remains single-family only. That the site is suitable for the type and intensity of use or develop- ment which is proposed. That there will not be significant haFmful effects upon tal quality and natural because the site is previously distrubed and has been used for residential purposes for many years. ® That there are no other relevant negative impacts of the proposed use that cannot be mitigated. Resolution No. P-89-97 Page 2 ge That the impacts associated with the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or will not be to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity and the use is consistent with the General Plan. 10. That the accessory use is in compliance with each of the applicable p of Ordinance 17.48 { 1 use permit regulations}. Section 3: ~cislon: The City Council hereby approves Minor Conditional Use Permit 89-D9 subject to the following Within 30 days of approval: {1) The applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. ® This approval shall become null and void if building permits are not issued by August 29, 1990. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: Approval of this request shall not waive compliance with all sections of the Zoning Development Code and all other applicable City Ordinances in effect at the time of building permit issuance. 2. The appropriate Building Department approvals shall be received prior to the of construction. 3. Site shall be developed in accordance with the approved site plan on file in the Planning Services Department and the conditions contained herein.
