P-89-102 A OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 89-57 WHEREAS, Temporary Use Permit 89-57, submitted by the Chamber of Commerce, applicant, requests approval of the Poway Days events to be held at various the City; and WHEREAS, on September 5, 1989, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: E 1 Findi : Pursuant to the procedures of the City of Poway, implementing the California tal Quality Act of 1970, the project is Categorically Exempt, Class 1. Section 2: Fin : That the proposed use is in with the purposes and standards of Section 17.26.020 of the Zoning Development Code. Section 3: ( ouncil A® The following conditions apply to each event and the applicant shall contact each of the following departments regarding compliance with their specific conditions: COUNTY HEALTH DEPARTMENT All food and drink concessions operated for profit Shall secure the necessary Health Department permit and State seller's permit. 2. Vendors preparing food in temporary booths must provide floors, walls, and ceilings for the entire stand. SHERRIFF'S DEPARTMENT One or more identifiable members of the event committee shall be on-site at all times when t e parking are s are in use to assist with security of parked veh cles, to aid n the movement of vehicles in and out of the ors, to provi e to motorists, and to minimize raffic conges ion on surface streets. All beverages shall be dispensed in paper cups -- no bottle or cans are allowed. The event committee shall designate an on-site location for police, fire, and paramedic units out of the main activity areas and maintain sufficient access for emergency vehicles at all times. All music activities shall be on or before 12:30 a.m. on the day following the event, and at no time shall the noise level exceed the permissible decibel {dB) level for the area's zoning designation. No. p_89-102 Page 4 Ce De The following conditions shall apply to the Tour de Poway Bicycle Event to be held on September 24, 1989, with starting and ending points at Lake Poway: The applicant shall be responsible for clearly designating the tour route and posting it as necessary to provide for the safety of the riders and spectators. The sponsors of the event shall with the Department to guarantee traffic control/coordination. Members of the sponsoring agency shall be posted at key intersec- tions along the tour route to provide and to riders. 4. All signs for the tour must be approved. lhe sponsors of the tour shall contact the appropriate departments in the City of San Diego to coordinate the events and determine any conditions that the City of San Diego may deem 6. Bicycles must obey all applicable traffic laws. The following conditions shall apply to the Poway Days' Parade to be held on September 30, 1989 and beginning at Pomerado and Poway Roads, and ending at Bowron Road. The westbound lanes of Poway Road shall be kept open for emergency vehicles. Street intersections along the parade route will be kept clear of spectators for emergency traffic. The Chamber of Commerce, sponsor of the parade, shall place all barricades and cones along the parade and detour routes. The following conditions shall apply to the Poway Days' fireworks display to be on September 30, 1989 from Lot 3 of Pomerado Business Park: Extra security shall be provided for crowd control purposes and to maintain a "clear zone" around the firing site and impact area where no spectators or unauthorized persons will be allowed. The applicants shall btain permission of the adjacent property owner for parking rig ts if necessary and a copy of that agreement shall be provided to he Planning Services Department no later than September 20, 19 9. The area shall be kept free of debris, litter, or any other evi- dence of the temporary use upon completion of the use. Resolution No. p-89-102 Page 5 Fe The following conditions shall apply to the Poway Days' Rodeo and dance to be held on October 6, 7 and 8 at the Poway Valley Riders' Association Arena: 1. One chemical restroom per 200 visitors expected shall be provided. e A temporary "No Parking - Tow-awa Zone" shall be on the west side of Tierra Bonita Rod from Donart Drive north to Poway Valley Road, to provide a w der pedestrian walking area into and out of the PVRA grounds, and o ensure sufficient access for emergency vehicles -- fire, paramedic, and law "No Parking" signs shall be placed along this area app 250 feet on center. The rodeo committee shall designate an on-site location for police, fire, and paramedic units out of the main activity areas and adjacent to the south vehicle gate of the PVRA property. All music activities shall be teminated on or before 12:30 a.m., October 7, lg8g and at no time shall the noise level exceed the permissible decibel {dB) level for the area's zoning designation, i.e., RR-A and RR-C zone. 7:00 a.m. to 10:00 p.m. 50dB 10:00 p.m. to 7:00 a.m. 40dB A waiver of Poway Municipal Code Section 5.12.110 is granted to allow the sale of alcoholic beverages and the attendance of minors at the dance following the rodeo p on October 7, 19B9 between the hours of 10:00 p.m. and 12:30 a.m. J A copy of the Alcoholic Beverage Control license for "Beer Sale Only" shall be provided no later that September 20, 1989. The fairgrounds shall be p trolled by uniformed priv te security guards Ia minimum of two { ) private security guards to assist with crowd control inside he rodeo area during hour of operation and by members of rodeo an dance to maintain securi y of equip- ment and control of personnel remaining/residing on property after hours of operation. A 24-foot access (fire lane) shall be maintained along the northern edge of the property from Tierra Bonita Road to the western boundary with adequate turnaround for fire and medical apparatus. Parking lot areas which are covered with weeds, grass, brush, etc., shall be bladed to bare earth, so as not to constitute a fire hazard. L.
