P-89-107 F CIT CO I F T ITY 0 P v, C LIF I APPROV NG N R CON IT L U E P I 89-11 PARC L BER WHEREAS, Minor Conditional Use Permit 89-11 submitted by Allen Royster, applicant, requests approval to construct a 705 square foot detached guest house at 13590 Summit Circle in the Rural 1 B zone; and WHEREAS, on September 5, 1989, the City Council held a hearing on the above- ~ item. NOW, THEREFORE, the City Council does hereby resolve as follows: Sect The City Council finds that this project is categorically exempt {Class 3} from the California Envi Quality Act {CEQA). Section 2: F : That the location, size, design, and operating characteristics of the propo ed use will be compatible with and will not adversely affect or be ma erially detrimental to adjacent uses, residences, buildings, struc ures, or natural , in that the use is accessory to and compa ible with single family development. That the scale, bulk, coverage, and density of the project is con- sistent with adjacent uses. The proposed architectural design and finish materials match the house. 3. That there are available public facilities, services, and utilities. e That there will not be a harmful effect upon desirable neighborhood characteristics, in that the subject four acre lot can accommodate the added square footage. Se That the generation of traffic will not adversely impact the surrounding streets and/or the City's Circulation Element because the use remains single-family only. Se That the site is suitable for the type and intensity of use or develop- ment which is proposed. e That there will not be significant harmful effects upon environmental quality and natural because of the small scale of the pro- ject. 8. That there are no other relevant negative impacts of the proposed use that cannot be Resolution No. P- 89-107 Page 2 That the impacts associated with the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity and the use is consistent with the General Plan. I0. That the accessory use is in compliance with each of the applicable provisions of Ordinance 17.48 (conditional use permit regulations). Section 3: Ct recision: The City Council hereby approves Minor Conditional Use Permit 89-09 subject to the following conditions: Within 30 days of approval: (1) The applicant shall submit in writing that all of approval have been read and ~; and {2) the property owner shall execute a Covenant on Real The guest house shall never be leased or rented as a separate living unit and no kitchen shall ever be installed. School impact fees at the rate of $1.56 shall be paid at the time of building permit issuance. This approval shall become null and void if building permits are not issued by September 5, 1990. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: Approval of this request shall not waive compliance with all sections of the Zoning Development Code and all other applicable City 0 in effect at the time of building permit ' 2. The appropriate Building Department approvals shall be received prior to the initiation of construction. 3. Site shall be developed in accordance with the approved site plan on file in the Planning Services Department and the conditions contained herein. The applicant shall comply w th the latest adopted Uniform Building Code, Uniform Mechanical Code, Uni orm Plumbing Code, National Electric Code, Uniform Fire Code, and all o her applicable codes and in effect at the time of building perm t issuance. APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICE REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: R No. P- 89-107 Page 3 e C Roof covering shall meet Class A fire retardant testing as specified in the Uniform Building Standards No. 32-7 for fire retardant roof covering materials, per City of Poway Ordinance No. 64.
