P- 89-117 R L TION F CIT 0 I F ITY 0 P Y, APPROVING N DI A ION T C ITI ERMIT 87-17 AS ES ' PARC L BER 2 - - 5 WHEREAS, to Use Permit 87-17 by Trinity Baptist Church, applicant, request approval to install an electronic chime system for the church located at 14315 Garden Road in the RS-7 zone; and WHEREAS, on September 26, 1989, the City Council held a hearing on the above-referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Environmental Find : The City Council finds that this project is categorically exempt {Class 23} from the California Environmental Quality Act {CEQA). Secti¢ : That the location, size, design, and operating characteristics of the propo ed use will be compatible with and will not adversely affect or be ma erially detrimental to adjacent uses, buildings, struc ures, or natural in that the use is accessory to and compa ible the semi-public church use in a residential zone. That the scale, bulk, coverage, and density of the project is con- sistent with adjacent uses, in that no architectural change is occurring to the existing church buildings. 3. That there are available public facilities, and m That there will not be a harmful effect upon desirable neighborhood charact in that the sound level can be electronically adjusted to meet noise level limitations. That the generation of traffic will not adversely impact the surrounding streets and/or the City's Circulation Element because current buildings and their use are not proposed to be altered. Be That the site is suitable for the type and intensity of use or develop- ment which is proposed. That there will not be significant harmful effects upon environmental quality and natural because of the small scale of the pro- Ject. 8. That there are no other relevant negative impacts of the proposed use that cannot be mitigated. No. P-89-117 Page 2 J That the impacts associated with the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be to the public health, safety or welfare, or materially to properties or improvements in the vicinity and the use is consistent with the General Plan. Section 3: Clt }eclslon: The City Council hereby approves Modification to Conditional Use Permit 87-17 subject to the following conditions: Within 30 days of approval: {1) The applicant shall submit in writing that all of approval have been read and ~; and {2) the property owner shall execute a Covenant on Real Property. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: Approval of this request shall not waive compliance with all sections of the Zoning Development Code and all other applicable City Ordinances in effect at the time of building permit 2.
