WHEREAS, Tentative Tract Map 88-10 and Varian e 89-12 submitted by Thomas
Chert, owner, and R. David Pocock, applicant, for he pu pose of subdividing the
real property situated in the City of Poway, Coun y of an Diego, State of
California described as Parcel 1 of Parcel Map 13 6, in o six lots, regularly
came before the City Council for public hearing and act on on October 3, 1989.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section :
The subject property is not physically suitable for the type of single-
family development which is proposed because surrounding land uses
including a 1 development, soccer park, and major arterial
roadway will have an adverse effect on the proposed development.
The roposed map is not consist nt with the Poway General Plan. Denial
is r quired by Objective 2 of t e Land Use Element of the General Plan
whic states that "the distribu ion of land use should create a pattern
whic organizes land uses to m nimize conflict with adjacent land
uses."
The project does not qualify for allocation of 6 residential sewer
units because there will not be any significant public benefit from the
project.

There are no special circumstances applicable to the property
justifying issuance of a variance nor is the granting of a variance
necessary for the preservation of a substantial property right.
NOW, THEREFORE BE IT RESOLVED, that the City Council does hereby deny pro-
posed Tentative Tract Map 88-10 and Variance 89-12.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
California, this 3rd day of October, 1989/~'~
