WHEREAS, Minor Conditional Use Permit 89-14 submitted by Paul and Roselyn Santina
applicants, requests approval to construct a 850 square foot detached guest house
at 14133 Mountain View Court in the Rural Residential C zone; and
WHEREAS, on November 14, 1989, the City Council held a hearing on the above-
referenced item.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: :
The City Council finds that this project is categorically exempt (Class 3)
from the C Environmental Quality Act {CEQA).
Section 2:
That the location, size, design, and operating tstics of the
propo ed use will be compatible with and will not adversely affect or
be ma erially detrimental to adjacent uses, residences, buildings,
struc ures, or natural in that the use is accessory to and
compa ible with single family residential development.
That the scale, bulk, coverage, and density of the project is con-
sistent with adjacent uses. The proposed architectural design and
finish materials match the house.
3. That there are available public facilities,
and utilities.
That there will not be a harmful effect upon desirable neighborhood
characteristics, in that the subject 2.03 acre lot can accommodate the
added square footage.
That the generation of traffic will not adversely impact the
surrounding streets and/or the City's Circulation Element because the
use remains single-family only.
That the site is suitable for the type and intensity of use or develop-
ment which is proposed.
That there will not be significant harmful effects upon tal
quality and natural because of the small scale of the pro-
ject.
8. That there are no other relevant negative impacts of the proposed use
that cannot be mitigated.

That the tmpacts associated with the proposed location, slze, design.
and operating ch of the proposed use and the condlttons
under which It would be operated or maintained will not be detrlmental
to the public health, safety or welfare, or materially injurious to
properties or improvements in the viclnlty and the use is
wlth the General Plan.
10. That the accessory use ts tn compllance with each of the applicable
p of Ordinance 17.48 (conditional use permit regulations).
ouncll Decision:
The City Council hereby approves Minor Conditional Use Permit 89-09 subject
to the following conditions:
Within 30 days of approval: (1) The applicant shall submlt in wrlttng
that all condltlons of approval have been read and understood; and (2)
the property owner shall execute a Covenant on Real Property.
The guest house shall never be leased or rented as a separate living
unit and no kltchen shall ever be Installed.
School impact fees at the rate of $1.56 shall be paid at the time of
building pemit issuance.
This approval shall become null and void if building permits are not
issued by November 14, 1990.
APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE
WITH THE FOLLOWING CONDITIONS:
Approval of this request shall not waive compliance with all sections of the
Zoning Development Code and all other applicable Ctty Ordinances in effect
at the time of bulldlng permit
2. The appropriate Buildlng Department approvals shall be recelved prior to the
initiation of construction.
3. Site shall be developed in accordance with the approved site plan on file in
the Planntng Services Department and the contained herein.
4. All new and existing utilities shall be undergrounded.

The applicant shall comply w th the latest adopted Uniform Building Code,
Uniform Code, Uni om Plumbing Code, National Electric Code,
Uniform Fire Code, and all o her applicable codes and ordinances in effect
at the time of building perm t issuance.
APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICE REGARDING COMPLIANCE
WITH THE FOLLOWING CONDITIONS:
Roof covering shall meet Class A fire retardant testing as specified in the
Uniform Building Standards No. 32-7 for fire retardant roof covering
materials, per City of Poway Ordinance No. 64.
2. Each chimney used in conjunction with any fireplace shall be maintained with
a spark arrester.
3. Smoke detectors shall be installed in each room to the satisfaction of the
Director of Safety Services.
APPLICANT SHALL CONTACT DEPARTMENT OF PUBLIC SERVICES REGARDING COMPLIANCE WITH
THE FOLLOWING CONDITIONS:
The a pllcant shall pay a $500 inspection fee to the City's Public S rvices
Depar merit prior to building permit issuance. Such fee is to be use to pay
for C ty Inspector's time in making inspections of the pro ect
site hat are required prior to issuance of said building permit and or
Certi icate of Occupancy.
A right-of-way permit shall be obtained from the City's Publi Services
Department for any work to be done within the public street r ght-of-way or
any City-held ease ent. Said work shall includ , b,t is not o be limited
to, construction o driveway approach, sewer la era installa ion, water
service line insta lation, street construction inc uding concrete curb,
gutter, and sidewa k). Permit shall be obtaine pr or to start of work.

4. Please contact Public Services for payment of water, drainage, sewer, traf-
fic mitigation, and park fees, if any, prior to building permit issuance.
