WHEREAS, on November 28, 1989 the City Council held a hearing on the above-

NOW, THEREFORE, the City Council does hereby resolve as follows:

through conditions of approval. In a dition, the fenced storage area
will be removed which currently inter eres with maintenance of the
public sewer and storm drain easement.
That there will not be a harmful effect upon desirable neighborhood
cb tics, in that the required conditions of approval for
handling materials in the event of a spill will protect the
adjacent b from adverse impacts.

That the generation of traffic will not adver ely impact the
surrounding streets and/or the City's Circula ion Element in that traf-
fic generated from the use is less than 50 tr ps per day by delivery
trucks plus employees and traffic mitigation ees were paid with the
construction of the building.
That he site is suitable for the type and intensity of use and devel-
opmen proposed in that the use is within a portion of an existing
build ng that meets the development standards for the South Poway
Speci ic Plan.

That there will not be significant harmful effects upon the environ-
mental quality and natural
That there are no other relevant negative impacts of the proposed use
that cannot be mitigated.

That the impacts, as described above, in the location of the proposed
use will not adversely affect the City of Poway General Plan for future

III. )eclslon:
The City Council hereby approves Conditional Use Permit 89-09 subject to the
following conditions:
Within 30 days of approval: (1) The applicant shall submit in writing that
all conditions of approval have been read and understood; and {2) the pro-
perty owner shall execute a Covenant on Real Property.
APPLICANT SHALL CONTACT THE DEPANTNENT OF PLANNING SERVICES REGARDING COMPLIANCE
WITH THE FOLLOWING CONDITIOHS.

completed and sum tted to the Department of Health Services and Air
Pollution Contro -istrict.
2. The permit is subject to annual review beginning in March lg90 per Section

WITH THE FOLLOgING CONDITIONS.
1. Remove existing fence over public sewer and storm drain easement within 30
days.
Floor drains or area drains in material storage area cannot be directly con-
nected to storm drain or sewer systems. Verify compliance with the Public
Services Department.
3. Limit transportation of hazardous materials to certain roads in the business
park as determined by the Director of Public Services.
