P-89-147 F CIT CO CI F H I Y 0 P Y, C LIF NI APPRO IN I 0 DE EL ENT EVI 8 -159 AS ES 0 ' ARC L BER 77- O- 8 WHEREAS, Minor Development Review 89-159, submitted by Manuel and Ida DaSilva, applicants, request approval to construct a 6,270 square foot single- family residence for the property located at 18540 Wild Horse Creek Road in the RR-A zone; and WHEREAS, on December 12, 1989, the City Council held a hearing on the above- referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Envi Ftndi : This project is exempt from Environmental Review under Category 3 of the CEQA guidelines. Section 2: Findi : That the proposed development is in conformance with the Poway General Plan in that the proposed use is a two story, single-family residence and the General Plan designation is Rural Residential A which permits residential uses. ® That the pro osed develo ment will not have an adverse ae thetic, health, safe y, or archi ecturally related impact upon ad oining pro- perties, in hat the gra lng design, building placement, onstruction method, bull lng materia s, and elevations will be compat ble with surrounding properties. That the proposed development is in compliance with the Zoning Ordinance, in that it complies with the setbacks, height limit, and all other property development standards of the RR-A zone. That the proposed development encourages the orderly and h appearance of structures and property within the City, in that all surrounding properties are under the same zoning designation as the subject lot and are to be developed as single-family residences similar to the proposed project. Section 3: Decision: The City Council hereby approves Minor Development Review 89-159 subject to the following conditions: Within 30 days of approval the applicant shall submit in writing that all conditions of approval have been read and understood. Resolutlon No. P-89-147 Page 2 APPLICANT SHALL CONTACT THE DEPART#ENT OF PLANNING SERVICES REGARDING CONPLIANCE WITH THE FOLLOWING CONDITIONS: 1. The appropriate Building Department approvals shall be received prior to initiation of construction. All new and existing utilities for the structure hall be underground. Undergrounding shall be completed prior to certif cation of occupancy. Placement of the new pole was approved under UW 8 -08; however, staff shall review the plans for electrical service with appl cant, neighbors, and SDG&E and, if necessary, shall amend plans to encompass the best possible route for utilities with complete undergrounding if 3. School impact fees shall be paid at the time of issuance of Building Permits. e Water, sewer, and fire p systems plans shall be designed and constructed to meet requirements of the City of Poway and the County of San Diego Health Department. Landscaping shall be installed prior to certi cation of occupancy. {A hydroseed may be substituted to stabilize s opes). 6. Future grading of the hillside portions of the subject lot shall be prohib- ited unless approved by City Council. 7. Self-generating water softeners are prohibited in accordance with Chapter 13.04 of the Municipal Code. 8. This peFmit shall become null and void on December 12, 1990 if building per- mits have not been issued. APPLICANT SHALL CONTACT THE DEPARTMENT OF PUBLIC SERVICES REGARDING COWPLIANCE WITH THE FOLLOWING CONDITIONS: A gradin plan for the development of the property shall be submitted to the City's P blic Services Department for review and approval prior to issuance of agra lng permit and start of grading operation. Construction of a well for domestic and fire flow water needs shall meet all applicable requirements of Chapter 8.68 of the Poway Municipal Code and shall be completed prior to building permit issuance. That "Covenant of Improvement Requirements" recorded March g, 1981 as Doc. No. 81-071473 shall be complied with prior to issuance of a certificate of occupa cy. Said covenant includes i provement requirements to those private roads rom Parcel 1 and Parcel 2 of arcel Map No. 11136 to the nearest public y maintained road (Old Coach oad). Road improvements shall be per City o Poway's Non-Dedicated Rural oad Standards (Ordinance No. 280). Improvement plan for said roads shall be prepared and submitted to the City's Public Services Department for review and shall meet the City Engineer's approval prior to building permit e The applicant shall contact Public Services Department for payment of water, sewer, drainage, traffic mitigation, and park fees, if any, prior to building permit issuance. APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: Roof covering shall meet Class A fire retardant testing as specified in the Uniform Building Standards No. 32-7 for fire retardant roof covering materials, per City of Poway Ordinance No. 64. Approved numbers or addresses shall be placed on the building in such a position as to be plainly visible and legible from the street fronting the property. Said numbers shall contrast with their background. Address will be required at private driveway 3. Each chimney used in conjunction with any fireplace shall be maintained with -- a spark arrester. Dead end access roadways in excess of 150 feet long shall be provided with approved provisions for the turning around of Fire Department apparatus. The dwelling shall have a 10,000 gallon water tank for standby fire fighting for minimum fire flow demand of 500 GPM for 20 minutes. 7. Water shall be available on-site prior to the delivery of materials on site. Due to the difficult access and percent of grade to the site, response time for emergency vehicles will be excessive, installation of a residential sprinkler system is strongly recommended by the Fire Marshal.
