Res P-89-150RESOLUTION NO. p- 89-150 F CIT OU I F H I 0 P Y, C L FO I A PR V N VE OP T RE I W - 8 AS ES 0 ~ RC L BER 1 -2 - 3 WHEREAS, Development Review 89-28, submitted by Panosprey, applicant, requests approval for construction of an industrial buildlng located on Lot 38 in the Pomerado Business Park, In the PC (Planned Community) zone; and WHEREAS, on December 19, 1989, the City Council held a hearing on the above- item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: E 1 Find : The City Council finds that the potential tal impacts of this pro- ject were adequately discussed in the EIR and subsequent EIR for the South Poway Planned Community. Se( That the proposed developm nt is in conformance with the Poway General Plan and the South Poway P armed Community Development Plan, in that the proposed light industr al building conforms to the land use plan and development standards or the planned community. Tha the roposed development will not have an adverse aesthetic, hea th, s fety, or architecturally related impact upon adjoining pro- per les, n that the proposed building is similar to and will comple- men exis lng buildings in the area. e That the proposed development is in compliance with the Zoning Ordinance because it conforms to the SPPC Development Standards text. e That the proposed development encourages the orderly and appearance of structures and property within the City through their consistency with the SPPC plan which provides high standards of deve- lopment for a planned community. Section il Decision: The City Council hereby approves Development Review 89-28 subject to the following conditions: Within 30 days of approval the applicant shall submit in writing that all of approval have been read and Resolution No. P-$g-150 Page 2 APPLZCANT SHALL CONTACT THE DEPARTNENT OF PLANNZNG SERV]CE$ REGARD]NG CONPL]ANCE WITH THE FOLLOWING CONDITIONS: SITE DEVELOP#ENT 1. Site shall be tn wtth the approved site plans on file in the Planning Services Department and the heretn. 2. All work other than loadlng and unloading must be done withln the walls of the buildings. 3e Revised site plan and building elevations Incorporating all conditions of approval shall be submitted to the P]annlng Services Department prior to Issuance of butldtng permlts. e Approval of this request shall not waive compliance with all sections of the Zoning Development Code and all other applicable City Ordinances in effect at the time of building permit issuance. Se Prior to any use of the project site or business activity being thereon, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning Services. e The applicant shall comply w th the latest adopted Uniform Building Code, Uniform Mechanical Code, Uni orm Plumbing Code, National Electrical Code, Uniform Fire Code, and all o her applicable codes and ordinances in effect at the time of building perm t issuance. All concrete surfaces are to be either painted, textured, or sandblasted. ge Desi n, construction, and location of trash enclosures shall satisfy the requ rements of the Planning Services Department. Trash enclosure walls may be t lt-up panels to match the building or split face block. The six foot reta ning wall at the western side of the property line shall be constructed of decorative block or concrete. Plain cement block walls will not be approved. Such fees may Include, but not be 11mtted to: Permtt and P an Checklng Fees, Water and Sewer Servtce Fees. The fees shall be pa d prior to butldtng permlt 11. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. A six month may be granted by the Council provided an application is submitted by October 12, 1990. PARKING AND VEHICULAR ACCESS arklng lot landscaping shall consist of a mi imum of one 15 gallon size ree for every three parking spaces. LANDSCAPING A detailed landscape and irrigation plan shall be submitted to and a proved by the Plannin Services Department prior to the issuance of buildin per- mits. The an scape plan shall include climbing vines ad acent o the retaining wa 1 along the eastern property line and a total f one ree for every three parking spaces around the peri- meter of the site. 2. All landscape areas shall be maintainted in a healthly and thriving con- dition, free from weeds, trash, and debris. Resolution No. P-89-150 Page 4 SIGNS Any signs proposed for this development shall be designed and approved tn conformance with the Sign Ordinance and the sign standards contained in Volume ti of the South Poway Development Plan. APPLICANT SHALL CONTACT THE PUBLIC SERVICES DEPANTNENT REGARDING CONPLIANCE WITH THE FOLLOWING CONDITIONS. GRADING Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading approved grading plan and geotech- ntcal report, and the South Poway Planned Community development A soils report shall be prepared by a qualified engineer licensed by the State of C to perform such work at first submittal of a grading plan. Buildings and parking lots shall be at least five feet from tops and toes of slopes. A letter from the project civil engineer certifying the site grading shall be submitted prior to issuance of building permits. 5. All new slopes shall be a minimum of 2:1 {h to vertical). ® A final compaction report shall be submitted and approved prior to the issuance of building permits. The final grading plan shall be subject to review and approval by the Planning Services and Public Services Department and shall be completed prior to issuance of grading permit. ® Existing settlement monuments shall be identified on the grading plans and protected during construction. Monuments shall be p y protected or relocated when they conflict with the permanent improvement. STREETS AND SIDEWALKS All parking lot structural sections shall be submitted to, and approved by the Director of Public Services. Pavement sections shall conform to the minimum required by the Poway Municipal Code Section 12.20.88. 2. Plan check and inspection expenses shall be paid by the deve- oper. Private improvements that incl de, but are not limited to, sidewalks, dri- veways, wheel chair ramps, cur and gutter, cross gutter, and parking lot paving shall be constructed pr or to the occupancy of the units to the satisfaction of the Director o Public Services. All damaged off-site public works facilities, including parkway trees, shall be repaired or replaced prior to exoneration of bonds and improve-merits, to the satisfaction of the Department of Public Services. Prior to any work being performed in the public right-of-way, an encroach- ment permit shall be obtained from the Public Services office and appropriate fees paid, in addition to any other permits required. DRAINAGE AND FLOOD CONTROL On-site drainage shall connect to the existing stubs unless other- wise approved by the City Engineer. Portland cement concrete cross gutters shall be installed where water crosses the roadways. 4. Concentrated flows across driveways and/or sidewalks shall not be permitted. UTILITXES 1. All proposed utilities within the project shall be installed underground. Utility easements shall be provided to the specification of the serving utility companies and the Director of Public Services. 3. The developer shall be responsible for the relocation and undergrounding of existing public utilities, as required. Resolution No. p-89-150 Page 6 4e Water, sewer, and fire protection systems plans shall be designed and constructed to meet requirements of the Ctty of Poway and the Health Department of the County of San Dtego, T e applicant shall pay for a water system analysis to the proper s ze and location for the public water system. The amount will be deter- m ned by the cost of the analysis and shall be paid upon demand by the C ty. Existing telephone, gas, electric and all other utilities and appurtenances shall be shown on the grading plans. All on-site water mains shall be public. A 20 foot wide easement shall be granted to the City over all water mains, prior to occupancy. Be Improvement plans for the water mains shall be prepared on standard size sheets, upon demand by the City, signed by a registered civil engineer and submitted to City for approval. Developer shall construct a light system conforming to City of Poway Standards at no cost to the public. The addition of on-site fire hydrants is required. The location of the hydrants shall be determined by the City Fi re Marshal. All fi re hydrants shall be Jones 3775. A Knox Security System box and padlocks shall be required for each building and post indicator valve. Electric override shall be provided on the gate access to rear of the building. 4. Material Safety Data Sheets shall be required for all hazardous and/or toxic substances used in each building. The buildings shall display their numeric address in a manner visible for the access street. Building addresses shall also be displayed on the roof in a manner satisfactory to the Director of Safety Services. The minimum size of building numbers shall be 18 inches on face of building. In addition, the first lift of asphalt pay ng shall be in place to provide adequate, permanent access for emergency veh cles. The final lift of asphalt shall not be installed until all other construction activity has been substantially completed to the satisfaction of the City. An emergency contingency plan and hazardous materials d is required to be filed with the San Diego County Department of Health and copies pro- vided to the Poway Fire Department.
