Res P-90-37 RESOLUTION NO. P- 90-37 A OF THE CITY COUNCIL OF THE CITY OF POWAY, APPROVING TEMPORARY USE PERMIT 90-16 WHEREAS, Use Permit 90-16, Poway Chamber of requests approval to hold a street fair on Midland Road; and WHEREAS, on May 22, 1990, the City Council held a hearing on the above- ~ item. NOW, THEREFORE, the City Council does hereby resolve as follows: Pursuant to the procedure of the City of Poway, implementing the California Environmental Quality Act of 1970, the above-referenced project is categori- cally exempt, Class 4{el and 11{c). That the proposed use is in with the purposes and Section 17.26.03D of the Poway Municipal Code. of The City Council hereby approves Temporary Use Permit 90-16 subject to the following conditions: APPLXCANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: The site shall be used in accordance with the approved site plan on file in the Planning Services except as may be pro- vided herein, during t of the activity. 2. Fire, and County Sheriff's Departments shall be contacted for appropriate permits and inspections prior to the t of the activity. 3. Temporary signs shall be reviewed by the Planning Services Department for compliance with the Sign Ordinance prior to installation. e Approval of this activity shall not excuse compliance with all other sec- tions of the Zoning Ordinance and all other applicable City pres- ently in effect. 5. This approval shall become null and void on May 28, 1990, at which time the site shall be restored to its original No. P- 90-37 Page 2 Se Be The barricades can be placed at 7:00 a.m. and must be removed by 10:00 p.m. on May 27, 1990. The Poway Chamber of Commerce is required to provide to the City, prior to the event, an insurance policy naming the City as ADDITIONALLY INSURED for a minimum of one million dollars. The Poway Chamber of Commerce is required to sign a City of Poway waiver of liability form covering the event and City equipment used during the event. g. The Poway Chamber of Commerce must require each separate booth or presenting participant to sign a waiver of liability form. 10. A refundable $100 security/cleaning deposit is to be paid to the City to ensure proper cleanup after the event and to cover possible equipment damage. 11. A detailed site plan for the Heritage Park site and for Midland Road booths must be provided. 12. A sign on Midland Road, giving particulars of dates and times of closure, must be posted one week prior to the event. 13. Midland Road businesses and residents along the detour route (Adrian, Eastern, Edgemoor Streets) must be notified in writing detailing the event and road closure. 14. An itemized list of borrowed City equipment is required prior to the event. 15. Portable rest rooms are required at the ratio of 1 to every 50 people up to 500 people. After 500 people, the ratio is ! per 500 people. APPLICANT SHALL CONTACT THE DEPARTMENT OF PUBLIC SERVICES REGARDING CO#PLIANCE WITH THE FOLLOWING CONDITIONS: Public Services will remove the banners on the street light poles by June 3, 1990. APPLICANT SHALL CONTACT THE DEPANTNENT OF SAFETY SERVICES REGARDING CO#PLIANCE WITH THE FOLLOWING CONDITIONS: 1. All barricades are to have attendants at all times. 2. Midland Road is to be to emergency vehicle traffic. -~- 3. All tents are to be tagged with State Fire Marshal approval. No. P- 90-37 Page 3 m All booths or tents having electrical power, using any kind of flammable fuel, or doing any cooking will have a fire extinguisher rated not less than 2AIOBC. 5. Maintain Fire Department access to all buildings affected by the Business Fair. APPLICANT SHALL CONTACT THE SHERIFF'S DEPART#ENT REGARDING CONPLIANCE WITH THE FOLLOWING CONDITIONS: The barricade located on Edgemoor Street to the west of Midland Road and on Edgemoor Street at the south end of Brighton Avenue will be situated to pre- vent traffic other than 2. Barricades shall be placed at Midland Road and Edgemoor Street on the north side and at Midland and Adrian south of the Hamburger Factory entrance.
