P- 90-42 A RE OL N F TH CIT COUN IL OF T E P W , C LIFOR IA APPROVIN C T NA E P RMIT 2-10M AN D 0 EN VIE gO-O ASSESS R' R L 'U ER 14-19 -23 WHEREAS, Conditional Use Perm t 82-10M and Develo ent Review 90-03, sub- mitted by Mary Tamayo, Poway Court ry Preschool, Appll ant, requests approval to increase the maximum number of ch ldren permitted at he facility, at any one time, from 45 to 60 and approval o add a 960 square oot modular unit to the existing preschool. The .64 acre site is located at 4411 Norwalk Lane in the RS-4 {Residential Single-Family) zone; and WHEREAS, on June 12, 1990, the City Council held a duly advertised public hearing to solicit con~nents from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby resolve as follows: That this project will not create adverse impacts on the environment and a Negative Declaration with conditions for noise, traffic circulation, sewage disposal, and tree removal is issued. That the location, size, design, and operating char cteri tics of the proposed use will be compatible with and will not affect or be materially detrimental to adjacent uses, residen s, bu ldings, structures, or natural because the charac erist cs of surrounding uses have similar urban qualities. That the harmony in scale, bulk, coverage, and density is consistent with adjacent uses because the adjacent residential uses are separated f om the building envelope by assive and active open space and road a ignments and because surroun lng uses are complementary with the use o the site for a preschool, rchltectural features of the structure b end with the surrounding res dential buildings. 3. That there are available public facilities, services, and utilities. That there will not be a harmful effect upon desirable neighborhood characteristics because the use of the site as a child center is com- patible with surrounding residential uses. Condition No. 5 of Resolution No. P-85-073 shall be amended as follows: A maximum of 60 children, ages 2 through 10, shall be permitted on the site at any one time. e The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and enjoyment of surrounding residential and commercial uses. Revised site plans and building incorporating all of approval shall be submitted to the Planning Services Department prior to issuance of building permits. 3. The proposed modular unit must be approved by the State of California as an E occupancy. 4. The modular unit shall be provided with a minimum of two exits in accordance with Uniform Building Code Table No. 33-A. ® All access to the modular unit shall comply with the State of California Building Standards Code Disabled Access Regulations including landings, ramps, handrails, sidewalks, etc. 6. Engineered foundation and seismic tie-down details shall be provided prior to permit approval. PARKING AND VEHICULAR ACCESS All parking spaces shall be doub e striped with a minimum inside dimension of 8.5 x 18.5 feet. LANDSCAPING A Master Plan of the existing on-site trees shall be provided to the Planning Services Department prior to the issuance of building permits and prior to grading, to determine which trees shall be retained.
